circulated a copy of her presentation dated April 29. 2002
wherein she noted that her groundwater is already contaminated
by the spreading of manure on the site or from the ditch full of
garbage from which the bacteria entered and polluted the
ground water coming towards her and her neighbours'
properties. She requested that an inorganic test of her well
water be taken by the Regional Environmental Laboratory and
that the Municipality of Clarington foot the bill for such test to
have the water tested at any other laboratory. She also
requested that the municipality establish a series of by-laws to
protect the residents from their water being contaminated by
farming or private activities.

The Clerk's Department sent public notice for the rezoning application by
first class mail on or before April 6, 2002 to all property owners within
120 metres of the subject property in accordance with the latest
municipal assessment record. Public notices were also posted on the
property in question. The notice procedure followed is in compliance
with the Ontario Regulations made under the Planning Act.
(a) Report PSD-039-02 - Rezoning and Site Plan Aopiications - The
purpose and effect is to rezone the property from the Service Station
Commercial (C7) and Special Purpose CommerCial (C5) Zones to
permit the development of a convenience store and car wash in
addition to the existing Service Station.
No one spoke in opposition to or In support of this application.
Murray Evans, Evans Planning, 28 Ellery Drive, Richmond Hill,
L4C aZ6 and Terry Addington, Imperial 011 Limited, P.O. Box 58613,
8601 Warden Avenue, Markham, L3R OM6 displayed a digitally
enhanced rendering of the proposal, stating that this plan will "modernize
and freshen up. the site. The applicant has met with the adjoining
neighbours to discuss the proposal and a solid wood fence will be
installed around the perimeter of the site.

9.2 In accordance with special conditions set out in the Subdivision Agreement,
Blocks 114-129 are to be transferred free and clear of all encumbrances to the
abutting lots. As a condition of this transfer, Blocks 113 to 129 must be rezoned
to an appropriate residential zoning category. The Subdivision Agreement states
that an application for rezoning must be submitted within one year of registration
of 40M-2066, which was registered in September 2001. Should the rezoning be
approved, Block 113 could be developed for 2 semi-detached units.

9.3 Staff has requested that future and current purchasers of lots affected by the
rezoning and subsequent transfer of lands be notified of the proposal and that an
acknowledgement of the resulting changes be secured from them. Those who
have already purchased lots have been requested by the applicant to execute an
Amendment to their Agreement of Purchase and Sale. At the time of writing of
this report, 13 of the total 16 affected lots had been sold and their purChasers
have agreed to the Amendment.

10.1 As the purpose of this report is to satisfy the requirements for the Public Meeting

meeting, Mr. George Colbourne of 90 Queen Street. Mr. Colbourne's requests and the
response of the applicant and staff (shown in italics) are as follows:
a. A diagonal fence linking the existing fence behind the 77-95 King Street plaza with
the existing fence behind the house and garage at 88 Queen Street, and eliminating
a jog or corner that would otherwise exist and create a potentially unsafe blind or
hiding spot;
The applicant's April 29, 2002 plan, as revised, has included the diagonal fence.
b. An incraase in the height of all three (3) above segments of fence from the current
1.67m to 2m (5.5 to 6.5 ft.) to an even 2.44m (8 ft.) through the building of the
diagonal fence at 2.44m or 8 ft. and the adding of a 0.61 m (2 ft.) height extension to

The applicant will not raise the fence height because the existing fence does not
practically allow height extension. A safe and reasonably attractive height extension

1.0 BACKGROUND

The firm of Totten Sims Hubicki Associates has prepared a report entitled the Old ..
Bowmanville Neighbourhood Streetscape and Infrastructure Implementation Plan at the
direction of Council. The report was in response to concerns raised by the Old .-
Bowmanville Neighbourhood Association (OBNA) regarding plannea improvements to
the municipal infrastructure in the older residential area of Bowmanviile. The final report -
was submitted to staff in March of 2001. The Plan noted that the OBNA had identified
the triangle area bounded by Wellington Street, ~jberty Street. Gina Concession Street -
as unique and to be preserved and enhanced as part of any Inirastructure renewal

program (Attachment 1). The Plan suggested that a "special designation" be
considered by Council for this section of Bowmanville.

On June 25, 2001, Mr. Bill Humber of 15 Beech Avenue, Bowmanville, appeared as a
delegation before Council on behalf of the OBNA. He requested that Council direct the
Planning Department to commence the process of reviewing with the Association an
appropriate designation for the neighbourhood to be used as a foundation for its future.
Through Resolution #C-419-01 Council subsequently directed staff to commence
discussions with the Association regarding the process of designating the area outlined
in the Old Bowmanville Neighbourhood Streetscape and Infrastructure Implementation
Plan.

During discussions with the OBNA it was indicated that the special designation they _
might be seeking could be the designation of the area as a Heritage Conservation
District (HCD) under the Ontario Heritage Act. Planning Services staff met with -
representatives of the OBNA in July to discuss the procedures and implications of
having the area formally designated. The information was presented to the OBNA at ..
their general meeting in September. In October the Planning Services Department
..
received a formal requb.sL to begin the process of having the area designated as a
Heritage Conservation District (Attachment 2.) The letter also requested that the
-
Municipality approve the interim control by-law to be used as a measure of protection
until the District is approved.

2.0 COMMENTS

The Ontario Heritage Act, RSO 1990, c.O.18, is the principal piece of legislation that
enables municipalities to conserve, manage, and protect heritage properties. Part IV of
the Act enables municipalities to designate individual buildings. structures or places that
are of historical and/or architectural interest. Part V of the Act enables a municipality to
designate groups or areas of buildings and their settings provided that the municipal
Official Plan contains provisions relating to the establishment of a Heritage
Conservation District. Such provision is included in Section 8.3.1 of the Clarington
Official Plan which states that the Municipality, with the advice and assistance of the
Local Architectural Conservation Advisory Committee (LACAC), will identify or
designate a group or groups of heritage properties as a Heritage Conservation District.

A Heritage Conservation District is an area with architectural, historic, scenic and/or
archaeological features worth conserving. It contains buildings and open spaces that,
as a group, are an asset to a community. A District can be as small as a few buildings
or can be as large as an entire municipality. It is to have a special character and/or
associations that distinguish it from its surroundings.

There are currently 51 designated Heritage Conservation Districts within Ontario and a
further 23 are under study. All HCDs are approved by the Ontario Municipal Board.
They are not approved by local Council. The majority of municipalities have engaged
professional consultants to guide them through the procedures of obtaining OMB
approval. However, there are municipalities which have already been through the
process of designation with the assistance of a consultant that have taken .on the project
solely in house.

3.0 THE PROCESS AND IMPLICATIONS OF APPROVAL

The Ministry of Tourism, Culture and Recreation have prepared Guidelines outlining the
key ingredients for a successful Heritage Conservation District. These would include: _
· A sound examination of and rational for aistnct designation. especially for the
..
delineation of district boundaries;
· Active public participation in the designation process;
· A clear and compiete designation by-law: ana
· Clear ana well publicized policies for controlling development in the district to _
protect and enhance its special, unique character.

The designation of a District is a lengthy process encompassing a number of steps. _
Experience of other municipalities and advice from the Ministry have noted that the
Ontario Municipal Board will give much consideration to the amount of public support for ..
the designation and the justification of the District boundary. The following steps and
procedures are based on the Ministry Guidelines and the successful practices of other _
municipalities.
3.1
Neighbourhood Consultation
The Ontario Heritage Act does not specifically define how the public should be consulted
throughout the designation process. It only requires consultation be held with the Local
Architectural Conservation Advisory Committee before the passing of a by-law to define an
area to be examined for future designation. The Ministry recommends that efforts should
be made to inform all interested parties of the work in progress. A neighbourhood meeting
should be held prior to Council approving a study area by-law. Additional meetings will be
required to keep the stakeholders informed of the progress of the designation.

process. Passing a by-law to study an area does not stop demolition, additions,
unsympathetic infills or any other activity from being conducted if that activity complies
with the current regulations in place.
Council may concurrently pass a study area by-law and an interim control by-law for a
period of one year. with a one year option to renew. if it wishes to control development
within the study area. The OBNA has requested an interim control by-law be
implemented. This option will be reviewed by staff and a recommendation made at the
time the study area by-law IS presented for approval.
3.3
District Steering Committee
Upon approval of the study area by-law it will be necessary to form a District Steering
Committee to guide the preparation of the Heritage Conservation District Study and
Guidelines. The Committea should be made up of the Ward Councillor for the
neighbourhood who shall serve as the Chair of the Steering Committee, two members
of the Clarington LACAc, municipal staff from the Planning Services Department and
the Engineering Services Department, and several neighbourhood residents, including
representatives of the OBNA for a total of nine.

3,4 Heritage Conservation District Study
It has been recommended that the establishment of an HCD proceed as two separate
phases. Phase one would be to conduct a Heritage Conservation District Study. The
Study serves as a primary support to justifying the area as being historically significant.
The objectives of the study are to examine:
· The historical growth and development of the prospective district within the
context of Bowmanville's settlement history;
· The streetscape and landscape attributes of the neighbourhood;
· The planning policies that may impede or enhance heritage conservation;
· The heritage resources in the proposed district and their architectural and
historical associations; and
· The appropriate boundaries for the designated area.

Upon completion of the Study it will be presented at a neighbourhood meeting. The
comments received will be evaluated by the District Steering Committee and a _
recommendation will be made to the Clarington LACAC whether or not to recommend
approval of the District Study and proceed with the preparation of the Guidelines which _
constitute Phase Two of the HCD designation process.
The Clarington LACAC shall consider the recommendations of the Steering Committee
and make a formal recommendation to Council. The final decision regarding approval

Heritage Conservation District Guidelines
The Heritage Conservation District Guidelines will provide the basis for the
management and protection of the area's heritage resources including the buildings, the ..
open spaces, and the landscape features. The intent of the Guidelines are to conserve
and maintain the original building form with particular emphasis on what is visible from _
the street. The document will address the following:

· A description of the heritage character of the District and a statement of the
conservation principles;
· Designation guidelines for alterations and additions to existing buildings;
· Conservation of heritage fabric and features;
· Landscape conservation guidelines for both public and private property; and
· Planning and administrative guidelines for change in the district as a whole _
including public works undertaken by the municipality or other agencies.

Designation By-law
Upon completion of the Study and accompanying Guidelines Council is to approve a by-
law designating the neighbourhood as a Heritage Conservation District. The By-law is to _
be forwarded to the Ontario Municipal Board within 14 days of approval. Notice is also to
be provided to the Ontario Heritage Foundation. The Board will hold a hearing to review lIlIII
the application for designation. Upon approval an amendment to the Clarington Official
Plan and possibly the Zoning By-law will also be required in order to recognize the ...

3.7 Monitoring
Once designated, no one can erect, demolish, remove any building or structure, or alter
any exterior feature within the District without the approval of Council. It will be
necessary to establish a District Advisory Committee which is to contain representatives
of LACAC, the neighbourhood residents and municipal staff. This Committee, in
consultation with the Chief Building Official, will participate in a building permit review
program in order to make a recommendation to Council on applications for building
permits. Council may delegate the approval of minor projects to the Director of
Planning Services.
Council has 90 days to make a decision on a permit application. If the permit is refused
the owner can appeal the decision to the Ontario Municipal Board. If the permit is
approved by Council the decision cannot be appealed by another neighbourhood
resident. The Municipality is not required to go through the approval process for any
activity within its road allowances or on any Municipally owned lands. Lastly, a resident
cannot appeal a decision on another's lands or a Municipal decision on Municipal lands.
3.8 Timing and Costs
The amount of time involved and the overall costs of having a District designated is
entirely dependant on the size of the area being studied and the amount of support or
opposition for the project. The designated districts currently within Ontario have ranged
from an approval period of 1 year to 10 years. Projects that are completed in house are
certainly less expensive to conduct from an upfront dollar expenditure, but do have a
hidden cost in regards to the staff tima involved. Consultant fees can range from
$20,000 for a small project to in excess of $100,000 for larger areas. Due to the length
of time involved in completing the process some municipalities have allocated a set
amount for consultant fees in their yearly budget so that there are sufficient funds.
Council has approved the allocation of $15,000.00 in the 2002 Budget for consultant
fees for the Heritage Conservation District proposal. This is sufficient funding to engage
a consultant to begin the project and provide direction. We are relying on the OBNA
and LACAC to undertake a portion of the background work necessary for this project.

4.0 CONCLUSION
- Clarington's position at the eastern edge of the Greater Toronto Area has been
beneficial to its preservation of built heritage as redevelopment pressure in this
- municipality has not been as intense as it has been in those further west. The
'Aunicica/ity inventory of hentage resources currently lists 706 individual properties.
- )ne nunored and nrnety-eight are located within the 80wmanvtlle urban area.
Approximately one haft of these are concentrated in the area proposed for District
- ~estgnation. Of this one half. seven properties have Deen Tormaliv designated under

The designation of a Heritage Conservation District in Bowmanville will not only serve to
recognize and protect the area so designated, it will guide change within the

I am writing on behalf of the Old Bowmanville Neighbourhood
Association to formally request that the Municipality of Clarington
begin the process leading to the designation of the Old Bowmanville
Neighbourhood as a Heritage Conservation District, recognizing that
this a multi-step process encompassing public notification, a bylaw
initiating the process, a comprehensive study of the area by staff
and residents alike, a further definition of the area to be
designatedl and ratification through the Ontario Municipal Board.

We request as well that the Municipality introduce an interim
control bylaw both to support the objectives of this proposal and
to provide measures to protect the area from actions harmful to the
intent of this process.

To provide maximum flexibility we propose that the studied area
include those areas contiguous to the Old Bowmanville Neighbourhood
(which has been defined as the area bound by Concession Street
West, Liberty Street and Wellington Street) whose character
conforms to the nature of the neighbourhood.

1.0 BACKGROUND
1.1 At a meeting held on October 29, 2001. the Council of the Municipality of
Clarington considered the letter dated October 4, 2001 from the Newcastle Bond
Head Ratepayers Association expressing traffic concerns with the narrow railway
under passes on Highway 2 east of Farrow Avenue and Mill Street South, south
of Toronto Street. This item was referred to the Oirector of Englneenng.
1.2 At a meeting held on January 28, 2002, the Council of the Municipality of
Clanngton conSidered the letter dated January 22. 2002 from the Newcastle
Bond Head Ratepayers Association expressing traffic concerns with the
intersection of Port of Newcastle Drive and Mill Street South. This item was
referred to the Director of Engineering and the Clarington Traffic Management
Advisory Committee.
2.0 COMMENT
2.1 Railway Underpass On Highway 2 East of Farrow Avenue
This arched structure supports the Canadian Pacific Railway line and the
roadway is under the Jurisdiction of the Regional Municipality of Durham. The
structure is posted as "One lane only when used by trucks" and enhanced by
advance flashing yellow warning lights. The Region of Durham notes that this
structure operates satisfactorily based on the existing traffic volumes and
percentage of truck traffic, but has become the location of secondary accidents
when traffic has been detoured off Highway 401 during emergency road
closures. Municipal Staff requested that the Region of Durham review the
operation of this structure and the Region has subsequently agreed to upgrade
the raflective signage and delineation at this structure during 2002. The existing
flashing warning lights are considered appropriate and will remain in place. The
Region of Durham does recognize that this structure has a defidoncy due to the
restricted traffic flow of heavy vehicles, but there is no replacement date
scheduled in the Regional long-range forecast.

2.2 Railway Underpass on Mill Street South, South of Toronto Street
This structure supports the Canadian National Railway line and the Municipality
of Clarington has jurisdiction over this section of Mill Street South. This structure
is tentatively scheduled for replacement in 2004 with design drawings to be
prepared in 2003. The new structure would provide for two full lanes of vehicular
traffic and pedestrian movement.

2.3 Detour Signing During Highway 401 Closures
Municipal Staff contacted the Ministry of Transportation, MTO-Central Region. to
determine if they would consider the installation or permanent detour signing to
be used in the event of Highway 401 closures in the Newcastle to Newtonville
area. The MTO-Eastern Region installed this type of detour signing from
Newtonville Road and easterly into Northumberland County during 2001, to
assist during such Highway 401 closures. The MTO-Central Region, which has
jurisdiction of Highway 401 west of Newtonville Road, has established a working
group, which includes the Region of Durham, to determine if the signing is
effective and if it could be implemented through Durham Region. Staff can
advise the Newcastle Bond Head Ratepayers group when a decision has been
reached ,

2.4 Intersection of Mill Street South/Port of Newcastle Drive/Clarke Street
The letter of January 22,2002 mentioned a number of concerns, which have
been reviewed as shown below:

Street LiQhts
The street lighting has been upgraded a number of times in this area
over the past few years with the most recent changes occurring
during the completion of the new Graham Creek Bridge. Illumination
is at acceptable levels and no further improvements are scheduled
but will be reviewed during the design of the new underpass
scheduled for 2004.

Excessive Vehicular Speeds
Speed studies undertaken by Municipal staff showed that the
average operating speed of traffic through the intersection was just
below 50 km/hr in this urban 50 km/hr speed zone. Observations
by Durham Regional Police also indicated that although the
occasional motorist may be operating at higher speeds. the
average speed is considered reasonable througn this intersection.
Traffic ConGestion
Traffic volumes observed and recorded at the Intersection dUring
the 8-9 a.m. and 3-4 p.m. school peaks did not indicate a
congestion problem, A total of six school buses entered the
intersection during the a.m. period with four recorded during the
p.m. period. Traffic did not appear to have any problems observing
the buses or the students.
Request for an All-Way Stop
Prior to development of Port of Newcastle Drive, Mill Street had the right-of-way
with traffic on Clarke Street required to stop. When Port of Newcastle Drive was
constructed, it was necessary to control traffic northbound on Mill Street. The
re~idents requested and received a yield sign on a trial basis rather than the
usual stop control device. After review of traffic safety, it was determined that a
percentage of traffic northbound on Mill Street was not paying proper attention to
the yield condition and were entering the intersection without taking proper
precautions. This situation was discussed with the Traffic Management Advisory
Committee and the Durham Regional Police and it was agreed that the yield sign
should be changed to a stop condition prior to opening of the Graham Creek
Bridge in January 2002.
The intersection is not considered congested with vehicle volumes of 148
vehicles during the 8-9 a.m. peak period and 175 vehicles during the 3-4 p.m.
school period peak. These volumes fall well short of provincial guidelines for the

installation of an all-way stop. Sightlines are acceptable in this 50 km/hr zone,
operating speeds are averaging 49.6 km/hr and the intersection has been
accident free over the past three years. Based on these findings there does not
appear to be any grounds to introduce an all-way stop.

2.6 Clarington Traffic Management Advisory Committee
The CTMAC at its meeting of April 18. 2002 reviewed a presentation on traffic
roundabouts and made the following motion:

'THAT the municipality investigate the possibility of installing a
roundabout at the Mill Street and Port of Newcastle Drive
intersection"
-
-
Engineering Staff recognize that a roundabout design is one of a number of
possible considerations for traffic control/traffic calming in certain situations, but
are not in a position to prepare a detailed study for this intersection at this time
for the following reasons:

-
· No existing problems associated with speed, collisions or visibility
· Volumes are at low manageable levels
· Intersection was reconstructed December 2001 providing a new road
alignment to facilitate the new Graham Creek Bridge and tractor trailer
traffic.

Staff do not anticipate any serious problems developing at this intersection as a
result of the reconstruction of the railway underpass in 2004 or additional
development in the Port of Newcastle community. If problems should develop or
reconstruction is required, a roundabout or other corrective measures could be
considered.

2.7 Other Safety Measures
During the intersection review it was noted that a percentage of traffic on Mill
Street heading north into the intersection were still treating the location as a yield
condition and were failing to come to a complete stop. Durham Regional Police
should be requested to blitz this location for "fail to stop" violations to improve
compliance and safety.
3.0 CONCLUSION
3.1 By-law Amendment
To properly by-law the existing right of way control of the Mill Street South/Port of
Newcastle Drive intersection and other new streets in the Port of Newcastle
development, a by-law amendment is required to Traffic By-law 91-58, which is
attached for Council's consideration.

1.0 BACKGROUND
1.1 On February 28, 2002 a Public Information Workshop was held in Hall S' of the
Courtice Community Centre from 6:30 p.m. to 8:30 p.m. to provide the public with
an opportunity to comment on preliminary design drawings prepared by SRM
Associates for the proposed reconstruction of Prestonvale Road from 660 m
south of Bloor Street to Glenabbey Drive. The Public information Centre was
advertised in the local newspaper and notices were hana delivered to homes
located along the subject section of roadway. The meeting was originally
scheduled for January 31, 2002. but was re-scheaujea due to inclement weather.
Twenty-six people signed the register and/or submitted written comments at or
subsequent to, the meeting. A copy of the register and written comments are
provided as Attachment 2.

1.2 Over the past several years there has been considerable development pressure
in the southwest quadrant of Courtice. Numerous residential subdivisions are
either under construction or in the development review process, a new school is
being constructed west of Prestonvale Road just north of Bloor Street, and the
Municipality of Clarington is moving ahead with plans to develop the South
Courtice Community Park (SCCP) on the east side of Prestonvale Road, south of
Bloor Street. These considerations have resulted in the need for the Engineering
Services Department to consider improvements to Prestonvale Road from 660 m
south of Bloor Street to Glenabbey Drive.

1.3 At an Information Centre for review of plans for the SCCP held on November 21,
2001 at the Courtice Community Centre, concern was raised by a number of
residents about potential traffic impacts on Prestonvale Road resulting from
development of the proposed community park. As a result, Totten Sims Hubicki
Associates (TSH) were retained by the Municipality to prepare a comprehensive
"Traffic Analysis and Classification Review" for Prestonvale Road. An executive
summary of the report was available for review at the Prestonvale Road
Information Centre. It is attached to this report as Attachment 3.

2.0 PROPOSED DESIGN
2.1 As a result of public concern for vehicle speed, property constraints and the
varying road classifications in effect along Prestonvale Road, a number of
different cross sections have been incorporated into the Prestonvale Road
design. The design as proposed will meet the long term transportation and
infrastructure needs of the Municipality of Clarington and the Region of Durham
as well as addressing local residents' concerns. The location where various road
cross sections are proposed is illustrated on Attachment 1. A description of the
particular cross section proposed and the reason for aoplication to a specific road
sections is provided as follows:

· From 660 m south of Bloor Street to the north limit of the proposed SCCP,
a 10m urban cross section is proposed. This is consistent with the
designation of Prestonvale Road as an arterial road south of Bloor Street
and is consistent with the road needs generated by a facility such as the
proposed SCCP.

· From the north limit of the SCCP to approximately 250 m north of Bloor
Street, an interim rural road section with a 6.7 m asphalt surface and 1.2m
gravel shoulders is proposed to be constructed at the future urban grade.
This section would eventually be urbanized and widened to 10m once more
specific development plans for the lands adjacent to this section of
roadway are finalized and the design details of the proposed Bloor Street
realignment are known. Should this information be available prior to
tendering, there may be some long term cost benefit to foregoing the
interim rural cross section and constructing the ultimate urban design.

· Between Glenabbey Drive and the future Meadowglade Road, Prestonval.e
Road is designed to the Municipality's local road standard width of 8.5 m.
This allows for 2 lanes of traffic and on-street parking for the future
residential lots to be developed along the west side of Prestonvale Road.

The pavement width is consistent with the current classification of
Prestonvale Road as a local road from Robert Adams Drive to Bloor Street,
and also allows the roadway to be constructed within the existing road
allowance and with no property acquisition required.

· Just north of the future Meadowglade Road. a pavement narrowing or
"bump-out" is proposed where the pavement Width will be reduced to 7.0
m. The "bump-out" is a traffic calming measure that will help reduce traffic
speeds along Prestonvale Road adjacent to eXisting homes and the
proposed school site. As with the section described above, the reduced
pavement width is consistent with the current classification of Prestonvale
Road as a local road from Robert Adams Drive to Bloor Street. Minimal
property acquisition may be required to construct the roadway and relocate
utilities within the existing road allowance.

3.0 PUBLIC COMMENT
3.1 Verbal and written comments received by consultants and staff regarding the
design proposals available for review at the Information Centre indicate that the
proposed improvements to Prestonvale Road were generally well received by the
public, Several people expressed concern regarding the need for traffic signals
at the Bloor Street/Prestonvale Road intersection. These comments have been
passed on to the Region of Durham for their consideration as Bloor Street is a
Regional road.

3.2 Several long term residents disagree with the recommendation included in the
Executive Summary of the "Traffic Analysis and Classification Review" which _
calls for an amendment to the Official Plan to re-designate Prestonvale Road
from Bloor Street to Robert Adams Drive as a "collector" roadway. It is currently ...
classified as a "'ocal" roadway. The report indicates that the "collector"

only way to realistically reduce this role to that of a "local" street would be to
physically close the road to through traffic which would result in increased traffic
volumes on Robert Adams Drive and Glenabbey Drive. These streets have
already been the subject of numerous traffic c:Jmplaints from local residents.

3.3 The redesignation of Prestonvale Road from Bloor Street to Robert Adams Drive
as proposed in the TSH report is consistent with motions passed by the
Clarington Traffic Management Advisory Committee at their meetings of
February 15. 2001 and January 17, 2002. Copies at the reievant section of
minutes from these meetings and supporting motions are attached as
Attachment 4.

3.4 Engineering Services Staff recommend that the "Traffic Analysis and
Classification Review" report prepared for Prestonvale Road by TSH be
submitted to the Clarington Traffic Management Advisory Committee along with
comments received at the Information Centre for their information.

3.5 Staff concur that there is considerable technical evidence supporting the need to
re-c1assify Prestonvale Road, from Bloor Street to Robert Adams Drive, from a
"local" to a "collector" roadway and recommend that a formal application to
amend the Clarington Official Plan in this regard be pursued.

4.0 PROJECT STATUS
4.1 Since the Information Centre, plans have been circulated to utilities and a
number of utility relocation issues have been identified. The satisfactory
resolution of utility conflicts with the works proposed for Prestonvale Road is
contingent on utility relocation works associated with the proposed Bloor Street
realignment. A preliminary schedule for the realignme!1t of Bloor Street calls for
the design drawings to be circulated for review late in May 2002 with the work to
be tendered early in July 2002.

4.2 As it is critical on a number of fronts to coordinate the Prestonvale Road
improvements with the Bloor Street realignment, the design for Prestonvale Road
cannot be finalized until the plans for Bloor Street are completed. As such, it is
anticipated that the Prestonvale Road improvements will not be tendered until
early August 2002. Construction would commence in early September 2002 and
be carried over into 2003. It is anticipated that all road worKS Will be completed
well in advance of the opening of the SCCP, tentatively scheduled for late August
of 2003.

4.3 In order to accurately define the financial implications of constructing a rural
versus urban road section between the north limit of the SCCP to 250 m north of
Bloor Street intersection, both alternatives will be tendered. A recommendation
will be made to Council at the time of the tender award as to which alternative is
most cost effective given the status of surrounding development initiatives,
servicing issues and budgetary factors.

TSH staff have reviewed current and historic transportation information relating to .",
Preston vale Road as well as completing an assessment of the impact of traffic generated
from future growth in South Courtice on Prestonvale Road. The purpose of the review and
assessment was to determine an appropriate classification, cross-section and standard for _
Prestonvale Road between Robert Adams Drive and Bloor Street.
Based on the analysis conducted as part of this study as well as the work completed on ...
previous transportation studies for this area, the following has been concluded:
1.
The technical and planning considerations summarized In this report, confirm that
Prestonvale Road should be. classified as a collector road from Robert Adams Drive
to Bloor Street. From Bloor Street South It should continue to be cl88lifled as a
Type C arterial. There Is a potential argument, based upon prevailing and future
volumes, supporting the classification of Prestonvale Road as a Type C arterial from
Highway 2 to Bloor Street. However, recognizing that the roadway ~atisfles more
McrlteriaM for a McollectorM standard facility, It has been concluded that the
McoIlector. designation would be more appropriate;
2.
Previous decisions to classify Prestonvale Road as a MlocalM roadway from a
technical perspective, are considered Inappropriate and did not reflect the true
function of this facility.
3. Although it Is suggested that Prestonvale Road between Robert Adami DrIve and
Bloor Street be classified as a collector, it must be recognized that It should be
considesred a Mhlgher standardM collector than either Glenabbey Drive, Robert
Adams Drive or Sandringham Drive. Although neither the Municipality of Clarington

Walter Evans did a Chronology Study. In his rcrort it was recommended that a new
Prcstonvalc Road b~ constructed.' It was to be an arterial road with a 86 foot road
Jllowance and a four lane cross section. This road was to be located to the west of the
existing Pr~lonvulc Road, The residents objected to this because the developer wanted
to put this Toad through the hllckyard~ of the residents on Prestonvalc. The residents
wanted this road moved further to the west It was recommended that this arterial road
\vas needed, but the developer didn't want the expense of puttmg a large costly arterial
road in his subdivision, ft is very diflicuh to sell homes on allerial roads because of the
trame, Somehow the developer had this arterial road downgraded to a collector road
status. thus profiting greatly.
Also in the Chronology study it states that council adopted the: Courtice South
Neighborhood Plan. Although Prcstonvn)e is shown L" a local road on the approved plan
the background and preliminary drawings proposed Prestonvale Road be designated a
collector road.
Just to clarify this statement. It was the new Prcstonvalc Road, which is now renamed
Ro"'m Adams Drive. that was to be the collector road. In fact 1 have a town map for July
1980 showing 1he existing Prestonvale Rd. with a cul-de-sac at Robert Adams Drive.
This new arterial road that WIS planned should never have been called Prcstonvale Road,
Evidence dearly shows that PrestonvaJe Roed was always to remain a local road.
There are col1eclor roeds on both sides of Prcstonvalc which were designed to carry the
trdftiC for these new subdivisions. Robert Adams, the conector road to the west was
barricaded for 6 years whilo construction was going on forcing the traffic to use
Prestonvalo. Sandringham which is the collector road to the cast has had no traffic lights
at the # 2 highway. It was also suUCStcd darina tho planning s1ap& that Sandringham be
moved rurther to the east, but this did not happen. Thererore the residents use Claret
(whieh is also a local road) to Prcstonvale to go out with the lights, We have been trying
to get lights It the Sandringharn intersection for over 10 years,finally they will be
installed this year. Olennabby Drive which is supposed to be the east - west collector

watched Olennabby get fOUT 3 and 4 way stop sian.4I at every intersection because they
complained about the tl'llmc. This is a collector road desiped to carry trame, h also had

up residents complained about the traffic. Because of their objection there is a new CISt
west majUf road designed to the south ofGlennabby. Whon we applied for a 4 way stop
at Claret and Prestonvale it was not recommended as a traffic control. Finally last year
we got Ute 4 way stop, after the school crossing sign had been run over at least 3 times
that I know of. This is also whe", our children cross the road. Townline Road which is
the direct route to aU the shopping facilities in the Irea is also a dead end and it is a

major arterial road. People have no choice but to backtrack to Prestonvalc to get to the
;12 highway or to use Grandvlew in Oshawa, which is also a local road.
Prestonvalc Road was widened to 33 ti:~t ( 10M) on a 66 road allowance to collector road
standards without any notification to the residents,and because ol'this I have no
boulevard on my side of the road.
Devclopers have profited greatly by not having the expense or arterial roads, and the
uepreciatOO value of the homes on these roads. Why should we the longtime resIdents
who bought on a loe;;]! road, and w~re assured by the town thatlhis development would
not intcrf~re with our Iifesty!e be forced to put up \\fith all of the trallie, noise. pollution,
specdli~~.and decreased value on our properties for years. so the developers can profit,
Prcstonvale is not nC\,,'dcd as a collcctor road, when there arc already two collector roads
running parallel. When the lights go in at Sandringham and the #2 this smng it will help
alleviate a lot of traOic at the north end of Prestonvale. When the Townline Road is
bridged, It \\fill tiJke a great deal of traftic off our road. I don't know how development
bas beCI\ allOwed to continue, especially south of Bloor and Townline without the
tranllportation network, Again the developers have profited at our expense.
Now we have the new Sports Complex going in at Bloor and Prestonvale. PrestonV".de
Road is an arterial road south ofBtoor Street. We have always tried to keep on top of
developmem, and it W8~ our suggestion quite awhile ago, to have Prestonvalc south of
Bloor turn at the bend llnd instead of going cast to meet the local Prestonvale, it should
turn w~t nnd jOln up with the new arterial road being built. A number of people thought
lhls WclS a good idea. You earn jOin a local road Wlth an artenal road. Also It would save a
great deal of money because the valley would not have to be filled in. You can't have an
intersection like that at the top of a hill,

This fight has been goinS on ror 20 years and we should not have to continue to fight this
when it has already becn settled sevcral1imes..

ago, we thought great, they shollld be able to help with our traffic concerns. We sent a
letter with a brief history and explaining what has been done to us. We have been in
contact with Ron Baker a number of times, and then find out that their solution is to turn
our road into a coHeetor road. They had a tnffie study done when the traffic: has been
forced onto our road, and then recommend to have it rezoned to a collector road
We would like to have some road calming devises on our road, and Phair Avtnue
opened up. which has been a dead end since the development came, Then the traffic
congestion could be shared with Claret which is also a local road, and I think this is the
very least we d~rvc after everything that has been done to us.

PRESTONV ALE ROAD TRAFFIC ANALYSIS
AND CLASSIFICATION REVIEW
EXECUTIVE SUMMARY
TSH staff have reviewed current and historic transportation Information relating to
Prestonvale Road as well as completing an assessment of the impact of traffic generated
from future growth in South Courtice on Prestonvale Road. The purpose of the review and
assessment was to determine an appropriate classification, cross-section and standard for
Prestonvale Road between Robert Adams Drive and Bloor Street.
Based on the analysis conducted as part of this study as well as the work completed on
previous transportation studies for this area, the following has been concluded:
1.
The technical and planning considerations summarized in this report, confirm that
Prestonvale Road should be classified as a collector road from Robert Adams Drive
to Bloor Street. From Bloor Street South it should continue to be classified as a
Type C arterial. There is a potential argument, based upon prevailing and future
volumes, supporting the classification of Prestonvale Road as a Type C arterial from
Highway 2 to Bloor Street. However, recognizing that the roadway satisfies more
"criteria" for a "collector" standard facility, it has been concluded that the
"collector" designation would be more appropriate;
2.
Previous decisions to classify Prestonvale Road as a "local" roadway from a
technical perspective, are considered inappropriate and did not reflect the true
function of this facility.
3.
Although it is suggested that Prestonvale Road between Robert Adams Drive and
Bloor Street be classified as a collector, it must be recognized that it should be
considesred a "higher standard" collector than either Glenabbey Drive, Robert
Adams Drive or Sandringham Drive. Although neither the MuniCipality of Clarington
or the Region of Durham recognize a "higher collector", this classification may be
appropriate for Prestonvale Road in comparison to Robert Adams Drive or
Glenabbey Drive. Robert Adams Drive and Glenabbey Drive actually connect to
Prestonvele Road;
4. Prestonvale Road from Glenabbey Drive to Bloor Street should be reconstructed as a
collector standard roadway with a pavement width of 10m where possible;

If Council determines that Preston vale Road should be classified as a local roadway,
road closure or other physical measures would be required to reduce the traffic
volumes consistent with a local status. This would have a significant and negative
effect on traffic volumes on Robert Adams Drive and Glenabbey Drive and result in
these roadways potentially exceeding a "threshold of good environment".

Consistent with other collector roadways within the Municipality of Clarington,
there is a need to ensure that the residents' concerns relating to speed are
adequately addressed. In this regard, there is an opportunity through sensitive
streetscaping and the responsible use of traffic calming measures associated with
the planned roadway reconstruction, to potentially deal with these issues.

· New members were encouraged to field visit the roadway to evaluate the
function and operation. There is general agreement that the operation and
current design conditions signal motorists that it is safe to operate a vehicle
above the normal speeds for a local road, 40kmlh. The northerly section is
built at a standard that suggests a collector road function.

development that make the problem of Preston vale Road more complex.

depending on the type of development in the area. Local ~ in the
historical Downtown of Bowmanville are different than local roads in rural

operate as collector and arterial roads while, in the context of subdivision type
development, a local road definition is more finely tuned.

BACKGROUND
Council approved at their meeting of June 25, 2001 the award of the general
contract for the construction of the addition to the Municipal Administrative Centre
and renovations to the eXisting building to Aquicon Construction.
The contractor commenced worK on the site the weeK or August 12. 2001 and has
nade conslaeraole orogress In accordance With the aoprovea scneauie submitted to
Lne Building Committee on October 31,2001.
Site meetings are held every other week to review work progress, site details and
construction co ordinations. Both the Director of Operations and the Library Director
are part of the Building and Project Committee and have been actively involved with
the design and site meetings since 2000.
The new addition will comprise of four floors, penthouse and a mezzanine area. The
Clarington Library will occupy the first two floors and mezzanine. Planning Services
and Engineering Services will occupy the third floor of the new addition. The fourth
floor will include Library Administration and Clarington Information Technology
Department. There is approximately 2,200 square feet of unassigned municipal
space on the fourth floor for further municipal administration expansion.

CONSTRUCTION SCHEDULE
The approved construction schedule indicates a total project completion by April 15,
2003. Due to the fact that the project will be handled in two phases the new addition
including the Library and MAC Administrative space is expected to be completed
substantially by early December 2002. The renovations and connecting corridors to
the existing MAC will be completed by April 2003.

We are continuallv reviewing the scnedule with the Contractor to minimize
inconveniences to our Municipal operations, as well as to explore opportunities in
fast tracking the project. We have been fortunate to relocate staff outside of the
MAC during construction allowing the contractor some flexibility in fast tracking

PROJECT PROGRESS
As of May 10, 2002 the project is on schedule. The structure is complete and the
brick veneer installation has started. Windows are being installed as the brickwork is
being completed.
Metal studs are Installed for approximately 90% of the walls and mechanical and
electrical rough ins within the walls and ceilings are aoproximatelv 50%complete.
Major mechanical equipment including generator, chiller and main heat recovery
units are installed with the penthouse but yet to be connected.
By the end of June the building envelope will be substantially complete and the
interior drywall installation will begin.

BACKGROUND AND COMMENT
1. BACKGROUND
1.1 Our report covers the month of April, 2002. It is our intent to provide Committee
with infonnation relevant to this department, in a timely manner.
., REPORT
2.1 The department responded to 204 calls in April and recorded total tire loss at
$195,420. A breakdown of calls responded to follows in the table attached.
*Standby
As indicated in the table attached, Station 1 part-time firefighters were activated twice,
and Station 2 part-time firefighters once in April to standby, while Pumper 1 and Pumper
4 responded to emergency calls.
Station 4 part-time firefighters were called out four times. Twice to standby while full
time crews toured D.N.G.S. and twice while Pumper 1 & Pumper 4 were tied up at
emergency calls.

~s a result of interviews two staff members have been selected to fill the vacancy left by Ms.
Mainguy's move and the departure of the part-lime officer, Joa Lee Radford. The two new J
officers Stephen Grigg and Kathe Groen will commence their duties on Mav 21st, 2002, on a
temporary basis. lasting untli August 31 ". 2002. At that time. slaff will review the situation and j
make permanent recommendations.
As Council is aware Jacqueline Mainguy was recently awarded the position of Municipal Law
Enforcement Officer. Ms. Mainguy will commence her new duties on May 27th, 2002.

In order to carry out their duties as Municipal Law Enforcement Officers, Ms. Mainguy, Mr.
Grigg and Ms. Groen must be appointed by Council and subsequently Swom in by a Justice of J
the Peace. In addition, Ms. Mainguy must be designated as an Enforcement Officer for the
purpose of enforcing the Municipal Tree By-law.

BACKGROUND AND COMMENT
Subsequent to Council approval of Report COD-01 0-02 requesting early budget approval,
tenders were publicly advertised and invited for the supply and delivery of One (1) 2002 Cab &
Chassis, 35,000 GVW, as required by the Operations Department.
Tenders were received and tabulated as per Schedule "A" attached.
It is staff's opinion that the trade-in offered ($18.000.00) for the 1994 Ford F450 with 30' Bucket
Ariel device exceeds that which would be realized at the Regional Auction Sale and it's
therefore recommended that it be accepted.
After further review and analysis of the tender by Operations and Purchasing, it was mutually
agreed that Altec Industries Ltd., Milton, Ontario, be recommended for the contract to supply
and deliver One (1) 2002 Cab & Chassis, 35,000 GVW, to the Municipality of Clarington, as
required by the Operations Department.
The required funds in the amount of $154,361.05, is within the 2002 Capital Budget allocation of
$160,000.00.
The Finance Director has reviewed the funding requirements and concurs with the
recommendations. Queries with respect to department needs, specifications, etc., should be
referred to the Director of Operations.
The subject firm has not previously provided service for the Municipality of Clarington, but have
provided satisfactory service for the City of Toronto and the City of Weiland.
