Minutes THAT the minutes of the meeting held on March 17, 1980
be adopted as read.

Newtonville The meeting had been called as a Public Meeting to
Hamlet present the revised Newtonville Hamlet Development
Development Plan and to hear comments from the public.
Plan
Public Mr. Terry Edwards, Long Range Planner gave a brief
Meeting update on the proposed plan, pointing out the revisions
which had been made following the last public meeting.
Mr. Tom Huzar, owner of land on the east side of Ovens
Tom Huzar Road between Highway #2 and the dead end at Highway 401
pointed out that soil tests had been done on his property
which were satisfactory and that he had owned the land
for some time with the expectation that he would be able
to develop it. He asked that the east side of Ovens
Road be included in the Plan.

Mr. Smith, Planning Director, pointed out that the
total area in the Plan had been reduced to allow for
29 additional units. The staging would allow 5 Units
per year with the result that the Plan would be good
for 6 years. This staging would allow the effect of
development on ground water to be monitored. At the
end of the 6 years, the plan could be amended to
include more land.
Mario Veltri spoke to the 40 acres of land east of
Mr. Huzar's property which he had owned for some time.
He stated that the revised proposed plan eliminated all
Mario of his property. He had revised his plan of subdivision
Veltri to comply with the 3/4 acre minimum size of lot (17 lots)
which comprises only half of his land. The remainder
could be used for parkland. He suggested using aquarobic
septic systems. He objected to the fact that the
zoning on his land would be changed from residential
to Agriculture. The land is not suitable for farming and
should be allowed to develop as residential. He asked
that his land be included in the Hamlet Plan.
H. B. Horstman Mr. H. B. Horstman who has 2 acres of land on Ovens Road
stated that he would like to have his land divided into
two building lots. It is now zoned agricultural.

Ben Angi Mr. Angi stated that he had been a resident of Newtonville
for 6 or 7 years and was paying for street lights and felt
that his property was not included in the revised plan for
the Hamlet. He also presented the following petition, signed
by approximately 62 persons:
"We, the undersigned residents and property owners of the
Petition Hamlet of Newtonville, wish to inform the Newcastle Council
and Planning Committee that we are in favour of including the
properties fronting on the east side of Ovens Road between (King St)
Highway #2 and the 401 Highway within the Hamlet Plan and
request an amendment be adopted to the proposed plan to that
effect".

THAT Mr. Martilla and Mr. L. Payne be heard.

Mr. Martilla, a Consulting Engineer, spoke on
behalf of Mr. Payne who owns property south of
B. Martilla Highway #2 and east of the extension of Jones
Avenue. He stated that the Underwood McLellan
Report which the Region of Durham had prepared,
contradicted the findings of his company relative
to the suitability of the land for septic systems.
Mr. Leland Payne stated that his property was included
Leland in the old plan of Newtonville and suggested that
Payne lots 7, 8, 9 and 10 be included in the proposed
Hamlet Plan.

Mr. O'Neill stated that he is the owner of 90 acres
of land in Lot 10, Concession 2, north west side of
M. O'Neill the proposed plan. The revised plan does not include
his property and he asked why the north boundary of
the plan did not go straight across to the Concession
Road rather than angle down to Highway #2.

D. Robbins Mr. Robbins asked what was the Town$ policy on
the use of prime agricultural land for residential
designation.
Mr. Smith replied that the Planning Staff used the
Ministry of Agriculture and Food Guidelines and he
realized that some of the land in the north east
portion of the plan was good agricultural land.
Mr. Robbins also questioned the boundaries of the
plan and what would happen should his well go dry
when new wells were dug to the north of his property;
who would be responsible.
Mr. Smith stated that, under Subdivision agreements
the subdivider would be responsible while he owned
the property.
There was a considerable discussion relative to the
problems of wells going dry caused by development.
Mr. B. Savage, a resident of Newtonville, north of
#2 Highway was concerned with allowing development
in the northern section of the hamlet. He had several
concerns: use of agricultural land; present problems
B. Savage and future problems with wells in that area; drainage
problems caused by the proposed development to the north;
and pollution caused by north south drainage onto present
development; and he felt there was a better water supply
in the southern portion of the hamlet. He asked what
guarantee could be given that problems will not be further
aggravated by development.

THAT the recommendation in Report P-52-80, relative to
the Newtonville Hamlet Development Plan be endorsed.

Moved by Mayor Rickard, seconded by Con. Clarke
THAT Report P-52-80 be referred back to Staff to take
P-52-80 into account a 10 year projected growth, that the plan
Newtonville be deepened to incorporate a street on the south side
Hamlet Plan of Newtonville from Ovens Road to the east and the
provision of 5 lots per year for the first 2 years,
5 in 1980 and 5 in 1981 and the proposed amendment,
Section 4.2 of Appendix 1.

THAT Mr. Sid Cornish be heard.

Mr. Cornish spoke to the proposed Hamlet Development
Plan for Tyrone. He stated that Tyrone is shaped like
Sid Cornish a saucer and there are already sewage and water problems
re Tyrone there. He felt that development should proceed with
caution. He also mentioned the agricultural operations
such as feed lots and cattle operations within one-half
mile of the Hamlet and questioned the impact of more
development on the agricultural area.

THAT any others wishing to speak to the Tyrone
Plan be heard.

Mr. B. Heming - disagreed with Mr. Cornish relative
B. Heming to water problems. He stated that there had been
sump pumps in Tyrone for many years. He stated that
he agreed with the proposed boundaries of the plan
but felt that the lot size should be 'z acre.
Mr. G. Byam said that his land had been eliminated from
G. Byam the plan as presently proposed and he would like to have
it included.
Mr. Spry - stated that he had 10 acres, the front portion
of which was zoned R2 and the back deferred. He wished
Mr. Spry to have the front portion, two large lots, included in
the proposed plan. He also spoke to Report P-68-80,
which was relative to an appeal from a decision of the
Land Committee regarding his two lots.
Mr. Cornish spoke again to the sewage problem in Tyrone.

THAT the recommendation in Report P-54-80 be endorsed and
Tyrone 1) Report P-54-80 be received
Hamlet 2) The Hamlet Development Plan for Tyrone, as revised
Development be forwarded to the Council of the Regional Municipality
Plan of Durham in accordance with Section 10.4.2.2 of the
Durham R(glonal Official Plan; and that
3) Planning Staff report back to the Planning and Development
Committee at their first appropriate meeting following
receipt of Regional comments.
