Barr, Member Councillor William Clarke, Member Councillor Ivan M. Hobbs, Member Councillor Maurice Prout, Member Mayor G. B. Rickard, Member Deputy Clerk, G.Gray, Secretary Absent: Councillor J. W. Holliday, Member Also Present: Director of Planning, Don Smith Long Range Planner, Terry Edwards Resolution #PD -66-80 Moved by Con. Hobbs, seconded by Con. Prout Adoption THAT the minutes of the meeting held on of Minutes February 18, 1980 be adopted as read. "CARRIED" Public The meeting had been advertised as a Public Meeting Meeting to hear the views and comments of the public on the Proposed proposed Development Plan for the Hamlet of Tyrone. Development Plan for the The Chairman gave a history of the Plan up to this Hamlet of Tyrone point. The Long Range Planner, Mr. Edwards, explained the Plan and the modifications which had been made since the previous proposal had been shown to the Public. The meeting was then open to comments and questions from the Public. Planning and Development - 2 - March 3, 1980 Mr. Charles Ewert, representing Mr. C. Byam questioned the boundaries in the previous proposal and was told that the Regional Mr. C. Ewert Official Plan does not define these areas for Mr. O. Byam as residential. When the hamlet boundaries are defined, the surrounding areas revert to previous designation, which is agricultural. Mr. Ewert also questioned the size of the lots, 14 acres, and the staging policy of 5 lots per year. Mr. Edwards stated that the proposed staging policy for hamlets was an item to be considered later on the Agenda. Mr. Smith stated that there was a Provincially approved policy for monitoring growth in Hamlets. Mr. Ewert asked if there were now available tests which could determine the water quality etch and felt that this should be done now rather than prepare a plan and then monitor it and amend it in the future. Mr. Smith stated that an engineering study will be required under each Plan of Subdivision and the Plan will be reviewed on an on-going basis. Mr. M. Marchant Mr. M. Marchant spoke for himself and Mr. Ray Abbott. Mr. Ray Abbott He presented a letter from the Durham Health Unit relative to septic systems on their proposed lots in Tyrone. The Health Unit had approved this proposal on 3/4 acre lots and he questioned the need for 114 acre lots. He also asked that a Professional Study be done before the Plan was approved. Mr. Smith replied that the Region had done a Professional Study which indicated problems with servicing and they had formulated the policy. The Town could do a study and charge it to the developers in the future. J. Abbott Mr. J. Abbott asked in what year the Underwood McLellan Study was done and the aerial photos taken. Planning and Development - 3 - March 3, 1980 Mr. Smith - The Study was done in 1976 but more recent photos had been taken. Councillor Councillor Clarke - We have heard from the Clarke developers, what about the residents of Tyrone. Has there been any objection from residents regarding the proposed rate of growth for the Hamlet. Jim Rowan Mr. Jim Rowan - No lots to develop but he wondered why there was to be development in Tyrone when there was no school there. The only service is a General Store. Mr. Elliott Mr. Elliott - lives in the N/E Quadrant. now has an adequate water supply - what will happen if development causes his well to dry up and what rights does he have. Mr. Smith - The developer is responsible for wells running dry during the initial period of construction. However, when he sells the lots it is difficult to assess responsibility. Mr. Al Strike Mr. Al Strike representing Mr. B. Heming questioned for Mr. B. Heming the proposed lots sizes. He agrees with the monitoring program. He suggested that the lot size be reduced to i acre or even no lower limit. The Darlington By-law suggested 2 acre lots. Delegations Mr. Mario Veltri addressed the Committee relative to his Rezoning Application Z -A-2-4-7, on Queen M. Veltri Street in Bowmanville. He wishes to build an re apartment for Senior Citizens and was told to Rezoning wait until the Bowmanville Downtown Study had been Z -A-2-4-7 prepared and sewer and water were available. He Queen Street felt the rezoning should be allowed and he would Bowmanville be prepared when sewer capacity was available. Resolution #PD -67-80 Moved by Mayor Rickard, seconded by Con. Barr THAT the following be heard Mr. Leland Payne, Mr. Jim Chow and Mr. S. Mastrangelo. "CARRIED" Planning and Development - 4 - March 3, 1980 Mr. M. Fordham Mr. Monty Fordham, representing Mr. Leland Payne for Mr. L. Payne asked the status of the Newtonville Plan, and was advised that the proposed plan had been forwarded to the Region for comments and would be coming back to the Committee. Mrs. Florence Webb, from the floor, asked if Group Mrs. F. Webb Homes for Senior Citizens would be discussed and Group Hames was advised to contact the Planning Staff for information. Resolution #PD -68-80 Moved by Con. Prout, seconded by Con. Hobbs THAT the recommendation in Report P-31-80 relative to Hamlet Staging be endorsed and: Hamlet 1) The report be received Staging 2) The attached staging policies for the hamlets of Enniskillen, Newtonville and Tyrone be forwarded to Regional Council for comment in accordance with Section 10.4.2.2 of the Durham Regional Official Plan Mr. Merrill Brown spoke for Mr. J. Chow relative to Rezoning Application Z -A-2-4-8, for a fast food outlet at King and Scugog. He said that he Mr. M. Brown for had been in touch with the Regional Works Department Mr. J. Chow and they had suggested aerobic septic system as Rezoning Z -A-2-4-8 a temporary measure until the problem with lack of sewer capacity was alleviated. He questioned the inclusion in the report of the matter of fill on the site. He stated that the owner was willing to enter into a site plan agreement. Mr. Mastrangelo addressed the Committee relative to report P-34-80 and the dismissal of his appeal Mr. S. Mastrangelo against a decision of the Land Division Committee, Second House on by the O.M.B. He stated that he had not appealed Property to the Cabinet. He felt that he should be allowed Solina Road to build a second house on his property on Solina Road. Mrs. Florence Webb, from the floor, asked if Group Mrs. F. Webb Homes for Senior Citizens would be discussed and Group Hames was advised to contact the Planning Staff for information. Resolution #PD -68-80 Moved by Con. Prout, seconded by Con. Hobbs THAT the recommendation in Report P-31-80 relative to Hamlet Staging be endorsed and: Hamlet 1) The report be received Staging 2) The attached staging policies for the hamlets of Enniskillen, Newtonville and Tyrone be forwarded to Regional Council for comment in accordance with Section 10.4.2.2 of the Durham Regional Official Plan Planning and Development - 5 - March 3, 1980 3) Planning Staff report back to the Planning Committee at their first appropriate meeting following receipt of regional comments, and, if possible, to do so in conjunction with the duly advertised public meeting for discussion of the respective hamlet development plans. Prout THAT the recommendation in Report P-32-80, Rezoning relative to application for Rezoning Z -A-3- 2-4, Z -A-3-2-4 Part lot 28, Conc. 1, former Township of Clarke, "The Clay Pot" "The Clay Pot" be endorsed and 1) the application for Rezoning Z -A-3-2-4 be denied and 2) a copy of this report be forwarded to the By -Law Enforcement Officer for appropriate action. "CARRIED" Resolution #PD -71-80 Moved by Con. Hobbs, seconded by Con. Prout THAT the recommendation in Report P-33-80, relative to Status of Airstrip, Part Lots 31 and 32, Conc. 1 former Darlington (Gabourie) be endorsed and Status of 1) a copy of the report be forwarded to the By -Law Air Strip Enforcement Officer for appropriate action and (Gabourie) 2) A copy of this report be forwarded to Mr. D.A. Wesson in reply to his letter to Council of January 7th, 1980. "CARRIED" Planning and Development - 6 - March 3, 1980 Resolution #PD -72-80 Moved by Mayor Rickard, seconded by Con. Clarke THAT the recommendation in Report P-34-80, relative S. Mastrangelo to correspondence from Mr. S. Mastrangelo regarding Severance severance Part lot 25, Cone. 3, former Darlington, be endorsed and a copy of this report be forwarded to Mr. S. Mastrangelo for his information. "CARRIED" Resolution #PD -73-80 Moved by Mayor Rickard, seconded by Con. Clarke THAT the recommendation in Report P-35-80, relative Fines for to Fines for By-law infractions - Proposed amendment By -Law to the Restricted Area (Zoning) By-laws of the Infractions former Township of Darlington, Township of Clarke and Town of Bowmanville, be endorsed and 1) the report be received for information and 2) the attached by-law be forwarded to Council for consideration. "CARRIED" Resolution #PD -74-80 Moved by Con. Prout, seconded by Con. Barr THAT the recommendation in Report 36-80 be endorsed and: 1) report P-36-80 be received Group 2) Staff be authorized to prepare the necessary Homes by-law amendments to be circulated to appropriate agencies for comment and report back to the Planning and Development Committee at the earliest opportunity; and that 3) the Region of Durham be advised that the Town of of Newcastle has no objection to proposed Amendment 80-1/D to the Durham Regional Official Plan; and that Planning and Development - 7 - March 3, 1980 4) The Provincial Secretary for Social Development be advised that the Town of Newcastle supports Group the principle of Group Homes and shall incorporate Homes appropriate provisions within the Town's existing zoning by-laws and the District Plan presently being prepared. "CARRIED" Resolution #PD -77-80 Moved by Con. Hobbs, seconded by Con. Prout Rezoning THAT the recommendation in Report P-38-80 relative Z -A-2-4-7 to Rezoning Application Z -A-2-4-7, Queen Street M. Veltri Bowmanville, M. Veltri, be endorsed. "CARRIED AS AMENDED" Resolution #PD -78-80 Moved by Mayor Rickard, seconded by Con. Clarke THAT the foregoing resolution be amended and the following be endorsed: 1) The report be received for information Planning and Development - 8 - March 3, 1980 2) As sewage capacity is not available to this site at this time, the application be deemed premature. 3) That Application for Rezoning Number Z -A-2-4-7 be denied; and 4) The Regional Municipality of Durham be advised of the actions of the Town of Newcastle in this regard. Clarke THAT the correspondence from East Woodbridge East Woodbridge Developments Limited, dated February 14, 1980 Development Ltd. relative to Romney Mead - Village of Newcastle, Romney Mead be received for information and referred to Village of Staff for comment. Newcastle "CARRIED" Resolution #PD -80 - Moved by Con. Hobbs, seconded by Con. Prout Addendum THAT the items on the Addendum be considered. "CARRIED" Resolution #PD -81-80 Moved by Mayor Rickard, seconded by Con Clarke THAT the recommendation in Report P-39-80 relative Rezoning to Rezoning Application Z -A-1-6-5, part lot 34, Application Concession 2, Darlington (Texaco Canada Inc.) Z -A-1-6-5 be endorsed and:it be recommended to Council Texaco that the following resolution be adopted: Planning and Development - 9 - March 3, 1980 "WHEREAS the Council of the Town of Newcastle is concerned about the effect of the commercial uses on Part of Lot 34, Concession 2, Township of Darlington (Texaco Canada Site) on surrounding lands; Rezoning AND WHEREAS the Council of the Town of Newcastle Texaco is not opposed to recognizing the commercial uses on the site; COUNCIL HEREBY REQUESTS the owner to enter into a Site Plan Agreement with the Town to be considered in conjunction with a rezoning by-law recognizing the commercial uses on the subject property". Prout, seconded by Mayor Rickard Region of Durham THAT the correspondence from the Region of Development Durham Development Department dated February 11, Department 1980, be received for information.
