RECEIVE FOR INFORMATION (a) PD -263-89 - Information Report of Rezoning Applications For the Month of August 1989 (b) PD -266.89 - Status Report - Laidlaw Waste Systems (Durham) Ltd. (c) PD -267-89 - Economic Development Activity Status Report (d) PD -269-89 - Monthly Report on Building Permit Activity for September 1989 (e) PD -271-89 - By-law Enforcement Monthly Report for September 1989 (f) PD -272-89 - Parking Enforcement Monthly Report for September 1989 (g) TR -86-89 - Tax Receipt Policy (h) CS -35-89 - Community Services Department Capital Project Update (i) CS -36-89 - Community Services Department Program Division Review 2. Rezoning Application - Tunney Planning Part Lot 12, Concession 2, Town of Bowmanville Files: DEV 89.05 (X -REF.• 1ST -86069) THAT the Addendum to Report PD -240-89 be received; THAT Report PD -240-89 be lifted from the table; THAT the proposed Plan of Subdivision 18T-86069 as revised dated July 1989, as per Attachment No. 1, be APPROVED subject to the conditions contained in Report PD -240-89; THAT the Mayor and Clerk be authorized, by by-law, to execute a Subdivision Agreement between the applicant/owner and the Corporation of the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and Director of Planning; THAT the amendment to By-law 84-63 attached to Report PD -240-89, be APPROVED and that the "Holding (H)" symbol be removed by By-law upon execution of a Subdivision Agreement; THAT Staff be authorized to enter into negotiations with the applicant/owner for the sale of the triangular portion of the Lord Elgin Park approximately 615 m2; , REPORT #1 - 3 - October 30, 1989 6. Rezoning Application - Templeton-Lepek Part Lot 9, Concession 2, Former Town of Bowmanville Files: DEV 89-82 (X -REF.• 18T-89064) THAT Report PD -258-89 be received; THAT the Applicaton to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Templeton-Lepek on behalf of 819363 Ontario Limited, be referred back to Staff for further processing and the preparation of a subsequent report pending the receipt of all outstanding comments; and THAT a copy of Council's decision be forwarded to the interested parties attached to Report PD -258-89. 7. Rezoning Application - Templeton-Lepek Part Lot 12, Concession 2, Former Town of Bowmanville Files: DEV 89-58 (X -REF: 18T-89044) THAT Report PD -259-89 be received; THAT the Application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Templeton-Lepek on behalf of 807877 Ontario Limited, be referred back to Staff for further processing and the preparation of a subsequent report pending the receipt of all outstanding comments; and THAT a copy of Council's decision be forwarded to the interested parties attached to Report PD -259-89. 8. Applications for Subdivision and Zoning By-law Amendment - Bowmanviile West Development Ltd. Part Lot 17, Concession 1, Former Town of Bowmanville Files: DEV 88-59 (X -REF: 18T-88047) THAT Report PD -260-89 be received; THAT the proposed Plan of Subdivision 18T-88047 as revised dated June 1989 as per Attachment No. 1, be APPROVED subject to the conditions contained in Report PD -260-89; THAT the Mayor and Clerk be authorized, by by-law, to execute a Subdivision Agreement between the applicant/owner and the Corporation of the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and director of Planning, THAT the amendment to By-law 84-63 attached to Report PD -260-89 be APPROVED and that the "Holding (H)" symbol be removed by By-law upon execution of a Subdivision Agreement; and THAT a copy of Report PD -260-89 and Council's decision be forwarded to the Region of Durham Planning Department and the interested parties indicated in Report PD -260-89. REPORT #1 -5 - 13. INDUSTRIAL DEVELOPMENT October 30, 1989 WHEREAS the promotion of economic development in commercial areas in the Municipality is a primary focus of Council; WHEREAS an opportunity exists during the Christmas season to participate in upscale events such as the Santa Claus Parade; and WHEREAS the B.I.A s in Orono, Newcastle Pillage and Bowmanville have planned Christmas events; BE IT RESOLVED: 1. THAT Council endorse the purchase of a Christmas Tree for the Courtyard for a Special Tree Lighting Ceremony-, and 2. THAT the amount of $11,000.00 from Industrial Development Reserve be approved for lighting of the Town Hall and the entrance to the Town 14. BUSINESS IMPROVEMENT AREAS - LIAISON OFFICER THAT Walter Evans be assigned the task of acting as Liaison Officer to the Business Improvement Areas. 16� TREE TRIMMING THAT tree trimming in the Orono, Newcastle and Bowmanville Business Improvement Areas be a consideration in the next tree contract and that the Department of Public Works review and report in the 1990 budget. 16. PARKING - DOWNTOWN BOWMANVILLE AREA THAT Staff review and report on long-range plans for parking in the Downtown Bowmanville Area and prepare an update on the Silver Street Parking Lot. 17. Heritage Designations St. Saviour's Church, Orono Daniel Hogarth House - Mr. & Mrs. J. Brudek Abram Varnum House - Mr. & Mrs W Murray THAT Report CD -20-89 be received; THAT the Mayor and Clerk be authorized to execute the appropriate by-laws; and THAT the Clerk be authorized to carry out all actions necessary to complete the process of property designation pursuant to the Ontario Heritage Act, 1974, and detailed within Report CD -20-89. REPORT #1 - 7- October 30,1989 22. Tender T89-34. Oils and Lubricants - File, 10.2.8 THAT Report TR -91-89 be received; THAT Ken -Mar Energy Inc., Bowmanville, Ontario, with a total bid in the amount of $56,099.46, being the lowest responsible bidder meeting all terms, conditions and specifications of Tender T89-34, be awarded the contract to supply oils and lubricants as required by the Town of Newcastle; THAT in accordance with Section 64 of the Ontario Municipal Board Act, the contract award be subject to approval by the Ontario Municipal Board; and THAT the funds expended be drawn from the Current Years' Operating Fleet budget. 23. Feasibility Study for a Community Facility - Courtice Urban Area THAT Report CS -37-89 be received; THAT the firm of Marshall Macklin and Monaghan Limited in conjunction with Moffat Kinoshita Associates Incorporated be selected to conduct a Feasibility Study for a community facility in the Courtice Urban Area in accordance with the firm's proposal dated July 1989, at a fee not to exceed $47,000; and THAT funds received for purposes of conducting a Feasibility Study be credited to the Community Services Development Reserve. 24; Cemetery Fee Schedule - REF CS -33-89 - File: 68 31 100 THAT Report CS -38-89 be received; THAT.Report CS -33-89 be lifted from the table; and THAT appropriate staff be authorized to initiate changes in the By-law 79-104 to permit up to 6 ash internments for a vacant lot or a lot occupied by a single or double casket; THAT Schedule A to Report CS -33.89 be approved and adopted by Council effective January 1, 1990; and THAT Report CS -33-89 and By-law 79-104 as approved be forwarded to the Ministry of Consumer and Commercial Relations for endorsement of the revised fee schedule and changes to By-law 79-104. 25. Street Lighting Proeram THAT Report WD -77-89 be received; THAT the Street Lighting Program listed on Attachment No. I to Report WD -77-89 be approved; and THAT the costs be financed from The Public Works 1989 Capital Budget Accounts, Street Lighting ($20,000.00), Construction at Unspecified Locations ($4,000.00) and the Public Works Lot Levy Reserve Account ($6,637.32). REPORT #1 -9- THAT Confidential Report Admin -18-89 be approved. October 30,1989 Moved by Seconded by WHEREAS the Town requires engineering consultants to review the various technical reports submitted by Laidlaw Waste Systems (Durham) Ltd. in support of its various planning applications; and WHEREAS the Region has indicated to the Town it will cost -share the hiring of Consultants in this regard; and WHEREAS the Region and the Town may take diverging viewpoints on the various planning applications made by Laidlaw Waste Systems (Durham) Ltd. and it is considered to be in the Town's best interest not to be involved in a joint retainer of consultants; NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE TOWN OF NEWCASTLE: THAT the Region of Durham be advised that the Town declines the Region's offer to participate on a cost -shared basis in the hiring of the consultants in the review of various technical reports prepared by Laidlaw at this time.
