2. REZONING APPLICATION - LINCOLN HOLDINGS PICKERING LTD.
PART LOT 12, CONCESSION 2, TOWN OF BOWMANVILLE
FILES: DEV 89-66 (X -REF: 18T 89021 AND OPA 89-21/N
THAT Report PD -234-89 be received;
THAT application to amend the Town of Newcastle Comprehensive Zoning By-law
84-63, as amended, submitted by G. M. Sernas and Associates on behalf of
Lincoln Holdings Pickering Ltd., be referred back to Staff for further
processing and the preparation of a subsequent report upon receipt of all
1 outstanding comments; and
THAT a copy of Council's decision be forwarded to the interested parties
attached to Report PD -234-89.

THAT Report PD -236-89 be received;
THAT Official Plan Amendment Application 89-57/D/N and Rezoning Application
DEV 89-80 be DENIED as premature;
THAT the Region of Durham and the applicant be so advised and forwarded a copy
of the Report PD -236-89; and
THAT the delegations and interested partibed be notified and informed of
Council's decision.
5. OFFICIAL PLAN AMENDMENT AND NEIGHBOURHOOD PLAN AMENDMENT APPLICATIONS
ROSEBRIDGE NEWCASTLE INC. - PART LOT 34, CONCESSION 2, FORMER TOWNSHIP
OF DARLINGTON - FILES: OPA 89-72/N AND 2.2.1.(8)
THAT Report PD -237-89 be received;
THAT the Official Plan Amendment and Neighbourhood Plan Amendment
applications submitted by Rosebridge Newcastle Inc. be referred back to
Staff for further review and the preparation of a subsequent report upon
receipt of all outstanding comments and the completion of the Courtice
West/ Highway No. 2 Corridor Study;
THAT the Region of Durham and the applicant be so advised and forwarded a
copy of the Report PD -237-89; and
THAT the delegations and interested parties be informed of Council's
decision.
6. PROPOSED AMENDMENTS TO THE TOWN OF NEWCASTLE OFFICIAL PLAN AND THE
COURTICE WEST NEIGHBOURHOOD DEVELOPMENT PLAN - FILE: OP 2.2.1(4)
THAT Report PD -238-89 be received;
THAT the proposed amendments to the Town of Newcastle Official Plan and the
Courtice West Neighbourhood Development Plan, being Attachment Nos. 1 & 2
respectively, be referred back to Staff for further review and the preparation
of a subsequent report upon the receipt of outstanding agency comments;
THAT the Region of Durham be so advised and forwarded a copy of Report
PD -238-89; and
THAT the delegations be informed of Council's decision.

7. REZONING APPLICATION - JOHN AND JANE DEJONG - PART LOT 15,
CONCESSION 3, DARLINGTON - FILE: DEV 88-22 (18T 87036)
THAT Report PD -239-89 be received;
THAT Application to amend the Town of Newcastle Comprehensive Zoning By-law
84-63, as amended, submitted by John Dejong to permit the development of four
(4) Estate Residential lots be APPROVED; and
THAT a copy of Council's decision be forwarded to the Region of Durham
Planning Department and the interested parties attached to Report PD -239-89.
8. REZONING APPLICATION - TUNNEY PLANNING - PART LOT 12, CONCESSION 2,
TOWN OF BOWMANVILLE - FILE: DEV 89-05 (X -REF: 18T-86069)
THAT Report PD -240-89 be tabled for a maximum of 2 months.
9. EXEMPTION FROM PART LOT CONTROL - SUBDIVISION 18T-84011
FOSTER CREEK DEVELOPMENTS LTD. (PLAN 1OM-810) - PART LOT 29,
CONCESSION 1, FORMER VILLAGE OF NEWCASTLE - FILE: 18T-84011
THAT Report PD -241-89 be received;
THAT the request by Foster Creek Developments Ltd. for removal of Part Lot
Control on Lot 41 on Plan 1OM-810, be APPROVED; and
THAT the by-law attached to Report PD -241-89 be approved and forwarded to the
Regional Municipality of Durham pursuant to Section 49, Subsection (7) of the
Planning Act.
10. SCHEDULE OF FEES - PLANNING AND DEVELOPMENT APPLICATIONS

THAT Report PD -242-89 be received;
THAT the By-law attached to Report PD -242-89 detailing the fee schedule for
various types of Planning and Development applications, be APPROVED.
11. LEGAL FEE FOR ONTARIO MUNICIPAL BOARD HEARING
THAT Report PD -243-89 be received;
THAT the applicant/owner of all development applications shall be required to
bear the Zbwn's legal cost for an Ontario Municipal Board Hearing in situations
where his application is either approved or recommended for approval by Town
Council; and
THAT prior to an Ontario Municipal Board Hearing, the applicant shall provide a
Letter of Undertaking to the Director of Planning and Development agreeing to
bear the Town's legal cost in the ensuring Board's Hearing. In the event the
applicant fails to do so, the Director reserves the right not to participate in
any Ontario Municipal Board Hearing in support of the applicant.

12. HIGHWAY 401 WIDENING - BROCK ROAD TO COURTICE ROAD - PRELIMINARY
DESIGN STUDY - FILE: PLN 23.5.1
THAT Report PD -245-89 be received;
THAT Council endorse Alternative #3 as the preferred option for the
reconstruction of the Courtice Road interchange before or during the widening
of Highway No. 401 in the Town of Newcastle; and
THAT the Ministry of Transportation and the Region of Durham be so advised and
forwarded a copy of Report PD -245-89.
13. HIGHWAY 407 OVERVIEW STUDY - FILE: PLN 23.5.2
THAT Report PD -246-89 be received and endorsed as the Town's comments on
the Highway 407 Overview Study (Highway 48 to Highway 35/115); and
THAT a copy of Report PD -246-89 be forwarded to the Region of Durham and
Ministry of Transportation, Transportation Planning Office.
14. AMENDMENT NO. 39 TO THE VICTORIA COUNTY OFFICIAL PLAN TO AMEND THE
CONSENT POLICIES IN THE URBAN AND HAMLET DESIGNATIONS - FILE: PLN 2.4
THAT Report PD -247-89 be received;
THAT the Ministry of Municipal Affairs, the County of Victoria and the
Region of Durham be advised that the Town of Newcastle has no objection to
Amendment No. 39 to the Victoria County Official Plan and be forwarded a
copy of Report PD -247-89.
15. AMENDMENT NO. 40 TO THE VICTORIA COUNTY OFFICIAL PLAN RURAL INDUSTRIAL
POLICIES - FILE: PLN 2.4
THAT Report PD -248-89 be received; and
THAT the Ministry of Municipal Affairs, the County of Victoria and the
Region of Durham be advised that the Town of Newcastle objects to the
approval of Amendment No. 40 to the Victoria County Official Plan until
such time as modifications are made to satisfy the Town's concerns; and
THAT a copy of Report PD -248-89 be forwarded to the Ministry of Municipal
Affairs, the County of Victoria and the Region of Durham.

16. BY-LAWS TO APPOINT BUILDING AND PLUMBING INSPECTORS
THAT Report PD -250-89 be received;
THAT the By-laws attached to Report PD -250-89, appointing Building and
Plumbing Inspectors be approved.
17. BY-LAW TO LICENSE AND REGULATE PLUMBING AND DRAIN CONTRACTORS
THAT Report PD -251-89 be received;
THAT the By-law attached to Report PD -251-89 be approved; and
THAT Brent Rutherford, R.R. #2, Blackstock, Ontario, LOB 1BO, be so advised.
18. REVISED SUBDIVISION APPLICATION - IONA CORPORATION - PART LOT 28,
CONCESSION 1, FORMER TOWNSHIP OF CLARKE - FILE: 18T-76021
THAT Report PD -254-89 be received;
THAT the revised proposed Plan of Subdivision 18T-76021 date February 21,
1989 as per attachment No. 1, be Approved subject to the conditions
contained in Report PD -254-89;
THAT the Mayor and Clerk be authorized, by by-law, to execute a
Subdivision Agreement between the applicant/owner and the Corporation of
the Town of Newcastle at such time as an agreement has been finalized to
the satisfaction of the Director of Public Works and Director of
Planning; and
THAT a copy of Report PD -254-89 and Committee and Council's
recommendation be forwarded to the Ministry of Housing, the Regional
Planning Department, the delegation and all interested parties attached to
Report PD -254-89.
19. BILL 46, AN ACT TO ESTABLISH A COMMERCIAL CONCENTRATION TAX
THAT Report TR -84-89 be received; and
THAT the resolution attached to Report TR -84-89 as "Schedule A" be approved
by Council.

20. CASH ACTIVITY REPORT - AUGUST 31, 1989 - PART A
THAT Report TR -85-89 be received;
THAT, in accordance with provision of Chapter 302, Section 81(1) of the
Municipal Act, R.S.O. 1980, the Treasurer reports to Committee that the cash
position of the Town of Newcastle for the month ended August 31, 1989 is as
shown on the attached schedule; and
THAT Part A of the expenditures for the month of August 31, 1989 be confirmed.
21. FIRE DEPARTMENT ACTIVITIES
THAT the Acting Fire Chief be requested to publish the activities of the
Fire Department on a weekly basis.
22. COMMUNITY SERVICES DEVELOPMENT RESERVE
THAT Report CS -31-89 be received; and
THAT the By-law attached to Report CS -31-89 which establishes a Reserve for
Community Services Development be approved.
23. BOWMANVILLE RECREATION COMPLEX PROPOSED KITCHEN FACILITIES
THAT Report CS -32-89 be received; and
THAT Staff include a proposal for consideration in the 1990 Capital Budget to
develop a kitchen facility in the Multi Purpose Room storage area.
24. AMENDMENT TO THE CEMETERY BY-LAW REGULATING BURIAL PLOTS/REVISED
FEE SCHEDULE
THAT Report No. CS -33-89 be tabled until comparative information from other
municipalities is acquired from the Director of Community Services; and
THAT a subsequent report be forwarded to the General Purpose and Administration
Committee.

25. BOWMANVILLE HIGH SCHOOL 100TH BIRTHDAY RESOLUTION #C-544-89
THAT Report No. CS -34-89 be received;
THAT Council direct staff in conjunction with Mr. Doug Jackman to proceed with
a Bowmanville High School Centennial Trade Dollar Project as endorsed by the
Bowmanville High School Centennial Committee;
THAT staff be authorized to withdraw funds from the unallocated Administration
Contingency Account Number 7007-00000-0298 to an upset limit of $10,000 for
the purchase of commemorative coins, promotion and related costs;
THAT any coins which are not sold be retained by the Town for promotion of the
Municipality;
THAT the Town be reimbursed for any expenses incurred from the project and that
any profits realized be used to develop an honorarium or plaque for the
Bowmanville High School if applicable; and
THAT Mr. Doug Jackman and the Bowmanville High School Centennial Committee
received a copy of Report CS -34-89 and be advised of action taken by Council.
26. LEAF COLLECTION AND COMPOSTING
THAT Report WD -75-89 be received;
THAT By-law 88-155 be amended to reflect the change in the contract with
Browning-Ferris Industries to provide for the collection of leaves at cost plus
158 for profit; and
THAT Browning-Ferris Industries be advised of Council's decision.
27. REQUEST FOR CLOSURE AND CONVEYANCE OF PART OF PORTER STREET (UNOPENED)
PLAN 1OR-3290, PART 3 - PART LOT 9, CONCESSION 2, FORMER TOWN OF BOWMP.NVILLE
REPORT WD -76-89
THAT the Town of Newcastle's Policy on Road Closure and Conveyance be referred
to D. Hefferon, Shibley, Righton & McCutcheon for request of a legal opinion;
and
THAT D. Hefferon be requested to produce the deed and confirm ownership of the
unopened part of Porter Street described as Part 3, Plan 1OR-3290, former Town
of Bowmanville.
28. CONFIDENTIAL FIRE DEPARTMENT REPORT - PERSONNEL MATTER
THAT the actions taken "In Camera" be approved.
