OFFICIAL PLAN AMENDMENT, REZONING AND SUBDIVISION APPLICATIONS WESTLAKE (821010 ONTARIO LIMITED) - PART LOT 25, CONCESSION 6, FORMER TOWNSHIP OF DARLINGTON - FILES: OPA-42/D/N, DEV 89-55 & 18T-89038 THAT Report PD -199-89 be received; THAT the application submitted by 821010 Ontario Limited to amend the Durham Region Official Plan and Newcastle Official Plan, to permit the development of a forty-five (45) lot residential subdivision (as revised), be referred back to Staff for a subsequent report pending receipt of all outstanding comments; THAT the rezoning and subdivision applications attached to Report PD -199-89 be referred back to Staff; THAT the applicant, the delegations and persons listed, be notified of Council's decision. 3. REZONING APPLICATION - 828741 ONTARIO LIMITED - PART LOT 30, CONCESSION 2, FORMER TOWNSHIP OF CLARKE - FILE: DEV 89-63 THAT Report PD -204-89 be received; ( ) THAT the application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by 828741 Ontario Limited on behalf of John Arnold Bould and Barbara Elizabeth Bould be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and THAT the persons listed to be notified of Council's decision, be forwarded a copy of Report PD -204-89. REMOVAL OF "HOLDING (H)" SYMBOL TO IMPLEMENT PLAN OF SUBDIVISIION 18T-87054 (FORMERLY MEPHIS HOLDINGS) NOW CARHOLM INVESTMENTS LIMITED - PART OF LOTS 8 & 9, BROKEN FRONT CONCESSION - FORMER TOWN OF BOWMANVILLE FILE: DEV 87-82 AND 18T-87054 THAT Report PD -206-89 be received; THAT the rezoning application submitted by Inducon Consultants of Canada on behalf of Carholme Investments Limited requesting the removal of the "Holding (H)" symbol from the subject lands within draft Plan of Subdivision 18T-87054, being Part of Lots 8 & 9, Broken Front Concession; former Town of Bowmanville be approved and the By-law attached to Report PD -206-89 be forwarded to Council for approval; and THAT the applicant be so advised. 8. PROPOSED PLAN OF SUBDIVISION - NEWCASTLE MEADOWS (FORMERLY R. ZAKAROW) PART LOTS 11/12, CONCESSION 2, FORMER TOWN OF BOWMANVILLE - SUBDIVISION AGREEMENT - AUTHORIZING BY-LAW - FILE: 18T-82037 THAT Report PD -207-89 be received; and THAT the Mayor and Clerk be authorized, by by-law, to execute a Subdivision Agreement between the applicant/owner and the Corporation of the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning. Report #1 - 4 - September 11, 1989 9. REZONING SITE PLAN APPLICATION - E. VANDEWALKER - PART LOT 25, CONCESSION 1, CLARKE - FILE: DEV 88-28 THAT Report PD -208-89 be received; THAT the application submitted by Mr. E. E. VanDeWalker to rezone a parcel of land within Part of Lot 25, Concession 1, former Township of Clarke to permit the expansion to 29 units and year-round accommodation within the existing Trailer Park be DENIED, and that the applicant be given one (1) year to September 5, 1990, to comply with the Town of Newcastle Comprehensive Zoning By-law 84-63 as amended, and to comply with the 1981 Site Plan Agreement; THAT the Region of Durham and Regional Planning be so advised and forwarded a copy of Report PD -208-89; and THAT the delegations and persons listed to be notified in Report PD -208-89 be informed of Council's decision. 10. REZONING APPLICATION - CHRIS SMITH AND ASSOCIATES - PART L(YP 13 & 14, CONCESSION 2, BOWMANVILLE - FILE: DEV 89-30 THAT Report PD -209-89 be tabled until the next General Purpose and Administration Committee meeting to be held on September 18, 1989. 11. BOWMANVILLE NORTH DEVELOPERS GROUP - PART LOTS 12, 13, 14, CONCESSION 2, FORMER TOWN OF BOWMANVILLE - FILES: 60.35.423, 60.35.424, 60.35.425, 60.35.426 t THAT Report PD -210-89 be tabled until the next General Purpose and Administration Committee meeting to be held on September 18, 1989, and further thant Town Staff contact the area spokesmen to advise of the contents of this application. 12. REZONING AND SITE PLAN APPLICATION - SANDRA KIY - PART LT 19, CONCESSION 5, FORMER TOWNSHIP OF DARLINGTON (HAMLET OF HAMPTON) - FILE: DEV 88-60 THAT Report PD -211-89 be received; THAT the rezoning application submitted by Mrs. Sandra Kiy to rezone a parcel of land to permit the restoration and sale of automobiles be approved and the amending by-law be forwarded to Council at such time as the site plan agreement has been executed; and THAT the applicant, delegations and persons listed in Report PD -211-89 be so advised. OFFICIAL PLAN AMENDMENT APPLICATION - LORNE HARTFORD - PART LOT 13, CONCESSION 3, FORMER TOWNSHIP OF DARLINGTON - FILE: OPA 89-20/D THAT Report PD -212-89 be received; THAT the Official Plan Amendment application submitted by Lorne Hartford, to permit the development of a fourteen (14) lot estate residential subdivision be DENIED; and THAT the Region of Durham and applicant be so advised and forwarded a copy of Report PD -212-89. 14. OFFICIAL PLAN AMENDMENT, REZONING AND SUBDIVISION APPLICATIONS: VELTRI & SON LTD., PART IAT 5 & 6, CONCESSION 2, FORMER TOWNSHIP OF CLARKE FILES: 88-095 D/N, DEV 88-117. 18T-88082 THAT Report PD -30-89 be tabled for a period of two months until the General Purpose and Administration Committee meeting of November 6, 1989 to allow the new applicant time to address Town of Newcastle requirements. 15. APPLICATION FOR SUBDIVISION APPROVAL AND ZONING BY-LAW AMENDMENT NOR -ARM DEVELOPMENTS - PART LOT 9, CONCESSION 1, BOWMANVILLE FILES: 18T-88071 (X -REF: DEV 88-96) THAT Report PD -187-89 be referred to the next General Purpose and Administration Committee meeting to be held on September 18, 1989. 16. HOUSE NUMBERING POLICY - MRS. JANET WOOLARD THAT notwithstanding the provision within the Town of Newcastle House Numbering policy which requires, where a building is located on a corner lot, the number will be assigned based upon the orientation of the building entrance, staff be directed to issue to Mrs. Janet Woolard the municipal address "2 Whitecliffe Drive" for lot number 18 on Plan 1OM-797. 17. VIDEO SHOPS - COMMERCIAL AREA That the Director of Planning be requested to review and prepare a report pertaining to video shops in the commercial area at a subsequent General Purpose and Administration Committee meeting. } Report #1 - 6 - September 11, 1989 18. LIVESTOCK CLAIM - DIANE D'ANDREA - FILE: 68.2.4 THAT Report CD -19-89 be received; THAT the livestock claim submitted by Mrs. Diane D'Andrea in the amount of $66.00 for damages caused by raccoons be denied; THAT all future livestock claims for damages caused by wild animals other than wolves or dogs be denied; THAT Mrs. Diane D'Andrea, Mr. Syd Worden and Mr. Arnot Wotten be advised of Council's decision. 19. CASH ACTIVITY REPORT - JUNE, 1989 - PART A THAT Report TR -71-89 be received; ( ) THAT, in accordance with provision of Chapter 302, Section 81(1) of the Municipal Act, R.S.O. 1980, the Treasurer reports to Committee that the cash position of the Town of Newcastle for the month ended June 30, 1989 is as shown on the schedule attached to Report TR -71-89; and THAT Part A of the expenditures for the month of June, 1989 be confirmed. 20. RESERVE FOR ANIMAL CONTROL BUILDING REPLACEMENT That Report TR -72-89 be received; and THAT the by-law attached to Report TR -72-89 which establishes a reserve for Animal Control Building Replacement/Conservation, be forwarded to Council for approval. 21. COMMUNITY AND RECREATION BOARDS THAT Report TR -74-89 be received; THAT, in accordance with the Auditor's recommendations, and in compliance with the Municipal Act, Sections 81 & 82, the local Recreation and Community Boards (with the exception of the Orono Arena, Newcastle Arena and the Newcastle Community Hall) be dissolved as established Boards of Council; THAT these Community and Recreation Boards be allowed to operate in similar fashion to the way they have historically, with the exception that they would not be required to submit their records for consolidation with those of the Town, and that there would be a mutual agreement established whereby the Town would lease the currently occupied premises for a nominal fee of $2.00 per year; and THAT the local Recreation and Community Boards affected be notified that this procedure will be effective for the year ending December 31, 1989 and that they will be contacted prior to that date regarding an appropriate agreement. Report #1 - 7 - September 11, 1989 22. 1989 BUDGET REALLOCATION THAT Report TR -75-89 be received; and THAT approval be given for the reallocation of funds from the contingency account to the various salary and benefit accounts within the 1989 budget to reflect recent benefit and monetary settlements made by the Town with its employees (unionized and non-union personnel). 23. LEASE AGREEMENT - 247 KING STREET EAST, NEWCASTLE THAT Report TR -77-89 be received; THAT the by-law attached to Report TR -77-89 be passed, authorizing the Mayor and the Clerk to sign a rental agreement with Claude Miller; and THAT Claude Miller be advised of Council's actions. j 24. TENDER T89-25, ONE (1) ONLY 34,000 B.V.W. - PUMPER CAB AND CHASSIS 1500 GALLON TANK THAT Report TR -78-89 be received; THAT Almonte Fire Trucks Limited, Carleton Place, Ontario with a total bid in the amount of $83,505.00 being the lowest responsible bidder meeting all terms, conditions and specifications of Tender T89-30 be awarded the contract to supply one (1) only 34,000 G.V.W. Pumper Cab and Chassis/1500 Gallon Tank, as required by the 7hwn of Newcastle Fire Department; and THAT the funds expended be provided from the approved 1989 Fire Department Capitl Budget Account #7102-00001-0504. 25. EVERGREEN COUNTRY ESTATE - 464367 ONTARIO LIMITED AND RITA KLOMPMAKER PLAN 1OM-768 - 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' ROADWAYS AND STORM DRAINAGE SYSTEM THAT Report WD -71-89 be received; THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system and street lighting constructed within Plan 1OM-768; and THAT Council approve the by-law attached to Report WD -71-89 assuming the streets within Plan 1OM-768 as public highways, and assumed by the Town for public use. Report #1 - 8 - September 11, 1989 26. ASSUMPTION BY-LAWS FOR THE STREETS WITHIN PLANS 1OM-756, 1OM-757, 1OM-759 1OM-761, 1OM-762 AND IOM -769 THAT Report WD -72-89 be received; and THAT Council approve the by-laws attached to Report WD -72-89 assuming the streets referred to in Plans 1OM-756, 1OM-757, 1OM-759, 1OM-759, 1OM-761, 1OM-762 and 1OM-769, as public highways and assumed by the Town for public use. 27. RILLS OF LIBERTY - EAST WOODBRIDGE DEVELOPMENTS LTD. AND MUTT ENTERPRISES LTD. 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' - ROADWAYS AND STORM DRAINAGE SYSTEM THAT Report WD -73-89 be received; THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' dated September 11, 1989 for the roads, drainage works and street lights constructed in Stage II within Plan 1OM-749; and THAT Council approve the by-law attached to Report WD -73-89 assuming the streets within Plan 1OM-749 as public highways, and assumed by the Town for public use. 28. MAINTENANCE OF PRIVATE LANEWAYS - GRACE, TREWIN AND URIADKA THAT Report WD -74-89 be received; THAT the Town enter into an agreement with Mr. Arthur Trewin to provide for dedication to the Town of a 21.65 m (66') wide roadway more or less centered on the existing laneway including sufficient land at the end of the laneway to construct a turn -around circle, at no cost to the Town other than survey and legal costs, and that the Town agree to dedicate this land as a public highway; THAT an agreement be entered into with Mr. Harry Grace to provide the Town to perform year-round maintenance of his laneway until such time as the property changes hands, after which time the Town will no longer carry -out any maintenance of the laneway and that this agreement be registered on title; THAT $14,000 be provided in the 1990 Budget to cover survey and legal costs and the upgrading of the Trewin and Grace laneways to acceptable standards for year-round maintenance; and THAT a oopy of this report be sent to Mr. Arthur Trewin, Mr. Harry Grace and Mr. Mecola Uriadka. Report #1 - 9 - September 11, 1989 29. TOM OF NEWCASTLE TRANSIT STUDY THAT Report WD -69-89 be received; J THAT provision be made in the 1990 Budget, for Council's consideration, for sufficient funds for a study to determine the feasibility and costs for a Public Transit System in the Town; and THAT Charterway and Deck -way Services Limited be advised of Council's decision. THAT a copy of Report WD -69-89 be forwarded to the Commissioner of Planning and Harold Dalkie, Senior Transportation Planner, Region of Durham. 30. SAFETY OF PEDESTRIANS ON TOWNLINE ROAD NORTH THAT the Director of Works and appropriate staff be directed to investigate all possible avenues to improve the safety of pedestrians on Townline Road North where a small child was recently fatally injured by a vehicle. 31. CONFIDENTIAL REPORT TR -76-89 THAT Confidential Report TR -76-89, as amended, be approved. 32. ERECTION OF A PLAQUE AND BURIAL OF A TIME CAPSULE - DARLINGTON NUCLEAR GENERATING STATION THAT the Director of Works' verbal report be approved and he be authorized to proceed.
