RECEIVE FOR INFORMATION (a) PD -119-89 - Report of Rezoning Applications for the months of February and March, 1989. (b) PD -121-89 - Monthly Report on Animal Control for March, 1989. (c) WD -46-89 - Report on Dust, Noise and Garbage in the Vicinity of Absec Property Developments, Village of Newcastle. (d) WD -47-89 - Report on Parking - Registry Office, Liberty Street, Bowmanville. 2. REZONING APPLICATION - TEADE ARENDS - PART IAT 11, CONCESSION 2, FORMER TOWN OF BOWMANVILLE - DEV 89-16 THAT Report PD -110-89 be received; and THAT the rezoning application submitted by Mr. Teade to permit an existing fourplex, be referred back to Staff for a subsequent report; and THAT the applicant be so advised, 3. REZONING APPLICATION - LIZA DEVELOPMENTS - PART LOT 9, CONCESSION 2, FORMER TOWN OF BOWMANVILLE - FILE: DEV 89-20 (X/REF: 18T-89013) THAT Report PD -111-89 be received; and THAT the application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by Tunney Planning on behalf of Liza Development, be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and THAT a copy of Council's decision be forwarded to the interested parties in Report PD -111-89. Report #1 - 2 - May 8, 1989 4. REZONING APPLICATION - VELTRI AND SONS CORPORATION - PART LOT 7, CONCESSION 1, FORMER TOWNSHIP OF CLARKE - FILE: DEV 89-29 THAT Report PD -112-89 be received; and THAT the application to amend the Town of Newcastle Comprehensive By-law 84-63, as amended, submitted by G. M. Sernas & Associates Ltd. on behalf of Veltri and Sons Corporation, be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and THAT a copy of Council's decision be forwarded to the interested parties attached to Report PD -112-89. 5. PROPOSED AMENDMENTS TO COMPREHENSIVE ZONING BY-LAW WITH RESPECT TO DEFINITION OF FAMILY, DWELLING UNIT AND SEMI-DETACHED DWELLING THAT Report PD -113-89 be received; and THAT the proposed amendments to the Town's Comprehensive Zoning By-law with respect to the definition of Dwelling Unit, Semi -Detached Dwelling and the side yard requirements pertaining to a semi-detached dwelling, be approved, and By-law 89-72 be forwarded to Council for approval; and THAT a copy of By-law 89-72 be advertised in all local newspapers as notification to the general public and a copy be forwarded to Mr. Komarnicki, Region of Durham Planning Department and other agencies as per the requirements of the Planning Act. 6. REZONING APPLICATION - BELTON MASONRY (FORMERLY J. SILVA - VENTURY HOMES) PART LOT 16, B.F. CONCESSION, FORMER TOWNSHIP OF DARLINGTON - FILE: DEV 86-85 (REVISED) THAT Report PD -114-89 be received; and THAT the Rezoning Application submitted by Belton Masonry for permission of outside storage in Part Lot 16, B. F. Concession, Darlington Township, be approved and By-law 89-73 be passed; and THAT a copy of By-law 89-73 be forwarded to the applicant, the Region of Durham Planning Department and others as per the circulation requirement of the Planning Act. REZONING APPLICATION - POWERSCREEN OF CANADA LIMITED - PART LOT 9, BROKEN FRONT CONCESSION, FORMER TOWN OF BOWMANVILLE - FILE: DEV 87-99 THAT Report PD -115-89 be received; and THAT the application submitted by Powerscreen of Canada Ltd. to rezone the property at Part of Lot 9, Broken Front Concession, former Town of Bowmanville from "Light Industrial (M1)" to "General Industrial (M2)" be approved and By-law 89-74 be passed; and THAT a copy of By-law 89-74 be forwarded to the applicant, his agent, the Region of Durham Planning Department and others as per the circulation requirement of the Planning Act. 8. REZONING APPLICATION - DURHAM REGION NON-PROFIT HOUSING CORPORATION - PART LOT 8, CONCESSION 2, FORMER TOWN OF BOWMANVILLE - FILE: DEV 88-42 THAT Report PD -116-89 be received; and THAT Rezoning Application DEV 88-42 submitted by Durham Region Non -Profit Housing Corporation be approved and By-law 89-75 be passed, and that the removal of the "Holding (H)" symbol be deferred pending execution of a Site Plan Agreement; and THAT a copy of Council's decision and By-law 89-75 be forwarded to the applicant, interested parties indicated in Report PD -116-89 and others as per the circulation requirement of the Planning Act. 9. REZONING AND OFFICIAL PLAN AMENDMENT APPLICATIONS - COWAN PONTIAC BUICK LTD. - PART LOT 11, CONCESSION 1, FORMER TOWN OF BOWMANVILLE - FILES: DEV 88-93 AND OPA 88-80/N THAT Report PD -117-89 be received; and THAT the applications for Official Plan Amendment File 88-80/N and Zoning By-law Amendment File DEV 88-93, submitted by Cowan Pontiac Buick Ltd. to permit the creation of an employee parking lot be approved and an amending By-law be presented to Council for approval; and THAT a copy of Council's decision and amending By-law be forwarded to the applicant, interested parties indicated in Report PD -117-89 and others as per the circulation requirement of the Planning Act. Report #1 - 4 - May 8, 1989 10. MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT FOR MEETINGS HELD ON FEBRUARY 23, 1989, MARCH 16, 1989, MARCH 23, 1989 AND APRIL 6, 1989 THAT Report PD -118-89 be received; and THAT Council concur with the decisions of the Committee of Adjustment on Applications A 12/89 to A 32/89, inclusive; and THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decision of the Committee of Adjustment in the event of an appeal. 11. SITING TASK FORCE - LOW LEVEL RADIOACTIVE WASTE MANAGEMENT THAT Report PD -120-89 be received for information; and THAT a copy of Report PD -120-89 be forwarded to the Port Granby, Newcastle Environment Committee. 12. REQUEST FOR AN INCREASE IN RATES BY LOCAL TAXICAB COMPANIES THAT Report CD -9-89 be received; and THAT Bowmanville Taxi and Deluxe Taxi be granted an increase in the Tariff of Rates as detailed in Report CD -9-89; and THAT By-law 89-76 authorizing the increase in rates be forwarded to Council for approval; and THAT the applicants be so advised. 13. FEE STRUCTURE - CLERK'S DEPARTMENT THAT Report CD -10-89 be received; and THAT the following fees be in effect for the Town of Newcastle: Council Agenda $500 Annually Council Minutes $120 Annually G.P.A. Agenda $900 Annually G.P.A. Minutes $200 Annually Agenda Pages $50 Annually (Council or G.P.A.) THAT the rate per page for copies of any record, book or document in the possession or under the control of the Clerk be increased to $.50 per page; and THAT the charge to any person for furnishing a certified copy of any record, book or document in the possession or under the control of the Clerk be $1.00 per certification. Report #1 - 5 - May 8, 1989 14. TENDER T89-8, TWO ONLY FRONT MOUNT RIDING MOWERS THAT Report TR -37-89 be received; and THAT R.C.M. Equipment Ltd., Markham, Ontario, with a total bid of $16,432.20 for Part I and $11,804.40 for Part II, being the lowest responsible bidder meeting all terms, conditions and specifications of Tender T89-8, be awarded the contract to supply and deliver one only Front Mount Riding Mower with a 82" Floating Cutting Unit (Part 1) and one only Front Mount Riding Mower with a 52" Cutting Unit with Rear Discharge (Part II), to the Town of Newcastle as required by the Department of Community Services; and THAT the funds required for Part I be drawn from the approved 1989 Community Services Capital Budget, Account #7603-00001-0505; and THAT the funds required for Part II be drawn from the approved 1989 Community Services Capital Budget, Account #7402-00000-0505. 15. TENDER T89-7, ONE ONLY 3/4 TON CREW CAB PICK-UP TRUCK THAT Report TR -38-89 be received; and THAT Cowan Pontiac Buick Ltd., Bowmanville, Ontario, with a total bid of $18,323.28, being the lowest responsible bidder meeting all terms, conditions and specifications of Tender T89-7, be awarded the contract, to supply and deliver one only 1 -Ton Crew Cab Pick-up Truck, to the Town of Newcastle as required by the Department of Community Services; and THAT the funds be drawn from the 1989 approved Community Services Capital Budget, Account #7602-00000-0505. 16. CASH ACTIVITY REPORT - MARCH 1989 - PART A THAT Report TR -39-89 be received; and THAT, in accordance with provision of Chapter 302, Section 81(1) of the Municipal Act, R.S.O. 1980, the Treasurer reports to Committee that the cash position of the Town of Newcastle for the month ended March 31, 1989 is as shown on the Schedule to Report TR -39-89; and THAT Part A of the expenditures for the month of March, 1989 be confirmed. Report #1 - 6 - May 8, 1989 17. HAZARDOUS MATERIAL COURSE - 40 HOURS - MAY 15-19, 1989 THAT Fire Department Report FD -8-89 be received; and THAT approval be given for the two Fire Captains to attend the Hazardous Material 5 -day Course conducted by the Ontario Fire Marshal's Office and held at Oshawa Fire Department Headquarters. 18. COMMUNITY SERVICES DEPARTMENT - OPERATING DIVISION, 1989 PARKS DEVELOPMENT/UPGRADING WORK PROGRAM THAT Report CS -12-89 be received for information; and THAT a copy of Report CS -12-89 be forwarded to the Port -Granby, Newcastle Environment Committee. 19. COMMUNITY SERVICES DEPARTMENT - OPERATIONS DIVISION - 1989 FACILITIES CAPITAL PROJECTS WORK PROGRAM THAT Report CS -13-89 be received for information; and THAT a copy of Report CS -13-89 be forwarded to the Port -Granby, Newcastle Environment Committee. 20. MARCH BREAK 1989 PROGRAM REVIEW THAT Report CS -14-89 be received for information; and THAT Staff be congratulated for their efforts and endeavours for a successful 6th Annual March Break Bonanza. Report #1 - 7 - May 8, 1989 21. RESOLUTION #C-140-89 THAT the recommendations contained in Confidential Report CS -15-89 be approved. 22. STATE OF NASH ROAD - COURTICE WEST AREA THAT Report WD -43-49 be received; and THAT street lights be installed in 1989, on Nash Road from Trulls Road to Courtice Road and that the estimated cost of $14,000 be funded from the Public Works Lot Levy Reserve Reserve, Account #1110-157-X; and THAT a copy of Report WD -43-49 be forwarded to Mr. David A. Sharp, 4 Carriage Lane, R.R. #3, Bowmanville, Ontario, L1C 3K4. 23. WALTER SCHLEISS AND RAYMOND D. HOLLAND - PLAN 1OM-757 AND 1OM-769 - "CERTIFICATE OF ACCEPTANCE' - ROADWAYS AND STORM SEWER SYSTEM THAT Report WD -44-89 be received; and THAT the Director of Public Works provide Walter Schleiss and Raymond D. Holland "Certificate of Acceptance" for the storm sewer system and the roadways within Plan 1OM-757, 1OM-759 and 1OM-769. 24. DRAINAGE PROBLEM ON PHAIR AVENUE AND LYNDALE CRESCENT, COURTICE THAT Report WD -45-89 be received for information; and THAT the Public Works Department Staff monitor the final grading, restoration and sodding of the entire area to ensure that the final product will not adversely affect existing properties in any way; and THAT a copy of Report WD -45-89 be forwarded to Keith Richardson, President, Courtice & Area Community Association, R. R. #3, Nash Road, Bowmanville, Ontario, L1C 3K4. 25. DELEGATION OF AUTHORITY FOR THE PRE -SERVICING OF PLANS OF SUBDIVISION TO THE DIRECTOR OF PLANNING AND DIRECTOR OF PUBLIC WORKS THAT Report WD -48-49 be received; and THAT the Director of Planning and Director of Public Works be delegated the authority to permit the pre -servicing of plans of subdivision at their discretion and to their satisfaction. Report #1 - 8 - May 8, 1989 26. STOP SIGNS AT DEVONDALE AND GOLDPINE AVENUE, COURTICE THAT Report WD -49-89 be received; and THAT Report WD -49-89 be tabled for a period of two weeks to allow review by Staff; and THAT Mr. R. W. Allen, Goldpine Avenue, Bowmanville, Ontario, L1C 4A9, be so advised. 27. RENAMING OF INGLIS AVENUE TO INGLIS COURT AND AMENDMENT TO BY-LAW 86-112 THAT Report WD -50-89 be received; THAT By-law 86-112, being a By-law to establish a Street Name Map and Street Name Inventory in the Town of Newcastle be amended to change the name of Inglis Avenue to Inglis Court from Yorkville Drive to a point approximately 60 metres north of Yorkville Drive; and THAT Council authorize the Mayor and Clerk to execute an amending By-law to amend By-law 86-112, being a By-law to establish the Street Name Map and Street Name inventory in the Town of Newcastle. 28. PROPOSED CLOSURE OF GIVEN ROAD, VILLAGE OF NEWCASTLE THAT Report WD -51-89 be received and approved; and THAT a copy of Report WD -51-89 be forwarded to the residents of Given Road and their comments be requested. 29. REQUEST FOR FOUR-WAY STOP AT THE INTERSECTION OF NASH ROAD AND VARCOE ROAD THAT the request for a Four -Way Stop at the intersection of Nash Road and Varcoe Road, Courtice, be approved and By-law 89-89 be passed at the Council Meeting of May 8, 1989; and THAT Mr. Gordon Lohnert, 1537 Nash Road, Oshawa, L1K 1A5 and Mrs. B. Lawson, 1440 Nash Road, Oshawa, L1K 1A6, be advised of Council's decision.
