BY-LAW NO. 2008-171
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the
Corporation of the former Town of Newcastle
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the former Town of
Newcastle to implement ZBA 2007-0031;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:

"Section 14.6 SPECIAL EXCEPTIONS -URBAN RESIDENTIAL TYPE THREE (R3)
ZONE" is hereby amended by adding a new Sub-section 14.6.33 as follows:
"Section 14.6.33 URBAN RESIDENTIAL EXCEPTION (R3-33) ZONE
Notwithstanding Section 14.4, those lands zoned R3-33 on the Schedules to this By-
law shall be used far linked townhouse dwelling units subject to the following zone
regulations:
a) Density (maximum)
hectare
b) Front Yard
and a
66 units per
a minimum width of 4.5 metres
maximum width of 6.5

metres
c) Exterior Side Yard
and
metres
a minimum width of 4.5 metres
a maximum width of 6.5
d) No parking spaces shall be located in any yard between a dwelling and a lot
line dividing the lot from an improved public street.
Schedule "4" to By-law 84-63, as amended, is hereby further amended by changing
the zone designation from:
"Holding-Urban Residential Exception ((H) R1-42) Zone" to "Holding-Urban
Residential Exception ((H)R1-70) Zone"
"Holding-Urban Residential Exception ((H) R1-42) Zone" to "Holding-Urban
Residential Exception ((H)R2-62) Zone"
"Holding-Urban Residential Exception ((H) R1-42) Zone" to "Holding-Urban
Residential Exception ((H)R2-60) Zone"
"Holding-Urban Residential Exception ((H) R1-42) Zone" to "Holding-Urban
Residential Exception ((H)R2-59) Zone"
"Holding-Urban Residential Exception ((H) R1-42) Zone" to "Holding-Urban
Residential Exception ((H)R3-33) Zone"
3. Schedule "A" attached hereto shall form part of this By-law.
4. This By-law shall come into effect on the date of the passing hereof, subject to the
provisions of Sections 34 and 36 of the Planning Act.
