(a) Russ Powell, Chief Administrative Officer, Jill McColl, Policy Coordinator, and Perry Sissons, CLOC, 100 Whiting Avenue, Oshawa, L 1 H 3T3 advised that the Oshawa Creek Watershed Management Plan is the first in a series of Watershed Plans to be updated as well as Lynn Creek and Bowmanville Soper Creek which are targeted as the next two plans to be undertaken. Monitoring systems will be developed and areas to be improved or restored will be identified. He noted that the Watershed Management Plan is a document which will need constant review. DELEGATION ... ... ... - PUBLIC MEETING - ... ... ... ... ... ... ... ... ... - - ... - 3 - October 7, 2002 (a) Harvey Thompson, 4720 Concession Rd. #6, Newtonville, LOA 1JO advise that he is satisfied with the recommendations contained in the Report PSD-1 01-02 with the exception of the Membership and Structure of the Committee. In his estimation, the people who have most at state have the least representation on the Committee. He requested that the Member representing the Agricultural Community should be a Port Granby Resident and he suggested that the Member from the Education Group should also be a Port Granby area resident. Councillor Schell chaired this portion of the meeting. Pursuant to the Planning Act, the Council of the Municipality of Clarington, through its General Purpose and Administration Committee, is holding a Public Meeting for the following applications: (a) Official Plan Amendment, Rezoning and Draft Plan of Subdivision Applications Applicant: Waverly Road Properties Inc. The Planning Services Department sent public notice for the subdivision application by first class mail on or before September 18, 2002 to all property owners within 120 metres of the subject property in accordance with the latest municipal assessment record. A public notice was also posted on the property in question. The notice procedure followed is in compliance with the Ontario Regulation made under the Planning Act. (a) Report PSD-098-02 - Official Plan Amendment, Rezoning and Draft Plan of Subdivision Applications - The purpose and effect of the application is to subdivide the subject lands into nine commercial lots. The applicant intends to develop the lands with an auto mall, restaurants and a hotel. No one spoke in opposition to or in support of this application. Glenn Genge, DG Biddle & Associates Ltd., 96 King Street East, Oshawa, L 1 H 1 B6 expressed concurrence with the recommendations contained in Report PSD-098-02 and informed Members of the Committee that negotiations are underway with a Toyota Dealership, a major hotel chain and two restaurants. He advised that a Traffic Study will be undertaken to determine if a second access/egress is required. The existing residential use conforms with the policies of the Regional Official Plan. Comments from the Regional Planning Department have not been received at this time, thus conformity of the proposed development has not been confirmed. - - - 5.2 The Clarington Official Plan designates the subject lands "Green Space". The existing residential use and the proposed home occupation use conform with the policies of the Clarington Official Plan. - - - 6.0 ZONING BY -LAW CONFORMITY 6.1 The subject lands are zoned "Agricultural (A)", which permits a single detached dwelling and a home occupation use operating entirely from inside the dwelling. A home occupation operated from an accessory building would not be permitted, thus the need for the rezoning application. - - - 7.0 PUBLIC NOTICE AND SUBMISSION 7.1 Public notice was given by mail to each landowner within 120 metres of the subject site and a public meeting notice sign was installed on the lands. - 7.2 As of the writing of this report, one inquiry has been received regarding this application. _ The caller requested to be notified of all subsequent meetings and reports. - 8.0 AGENCY COMMENTS 8.1 The Clarington Building Division has indicated that a building permit will be required if _ there is any construction in this building in order to change it into an office or home occupation use. - 8.2 Clarington Emergency Services have no fire safety concerns with this application. - - 603 - REPORT NO.: PsD-104-02 PAGE 4 8.3 Comments remain outstanding from the Regional Planning Department, Regional Health Department, Central Lake Ontario Conservation, Clarington Engineering Services and Hydro One Networks Inc. 9.0 COMMENTS 9.1 The owner had previously applied for a minor variance (A2002/007), upon discovering at the closing of his purchase, that the existing detached garage had been attached to an existing barn without a building permit and that the renovations converting the barn to a detached garage were not in compliance with the Zoning By-law. The owner stated to Committee of Adjustment that it was his intent in purchasing this property to use the large accessory building for the purposes of operating his business. As the Committee of Adjustment cannot use its power to zone or to permit uses that are not permitted in the zone the applicant withdrew his minor variance application and submitted an application for rezoning and site plan. 9.2 The applicant has also concurrently submitted an application for site plan approval, indicating number and location of parking spaces, landscaping, signage and entrance location. 10.0 CONCLUSIONS 10.1 As the purpose of this report is to satisfy the requirements for the Public Meeting under the Planning Act, and taking into consideration all of the comments received, it is respectfully requested that this report be referred back to Staff for further processing and the preparation of a subsequent report. S. Health & Safety Consultants Inc. existing Certificate of Approval, for 373 Lake Road. The amendment proposes to allow processing and storage of asbestos to occur on-site. The applicant has a current certificate of approval for PCB processing and transfer at the subject property. The information submitted for the amending application seeks approval to receive asbestos at the site; inspect the waste and remove any heavy steel that can be recycled; and store the asbestos on-site, prior to transferring it to an approved waste disposal site. The applicant has requested approval to receive up to a maximum of 25 tonnes of waste daily and have a maximum storage capacity of 50 tonnes any given day. The applicant has verbally stated that he expects to have considerably less storage on-site at anyone time. All asbestos waste will be held in 6 mil yellow bags containing warning labels approved by the Ministry of Labour. The base are sealed and stored in approved steel containers. The applicant has states that the bags will only be handled by hand, therefore minimizing the risk of tears. All storage will be within the existing containers located on-site and not visible form the street. 1.2 On October 16, 2002, the Ministry of the Environment advised that the applicant amended his application to permit a maximum storage capacity of 75 tonnes. 1.3 The property is currently being used for dismantling of light ballasts, transformers and switch gear containing PCB's. Transforms containing oil are not permitted on site based on the existing MOE certificate. The existing certificate was issued in July 1998, to T. S. Health & Safety Consultants Inc. 2.0 OFFICIAL PLAN AND ZONING CONFORMITY 2.1 The subject property is designated "Light Industrial Area". The range of permitted uses includes manufacturing, assembling, processing, and warehousing. The M2 zone permits the widest variety of uses including 'an assembly, manufacturing, fabricating or processing plant within a wholly enclosed building or structure'. The processing and temporary storage of materials appears to be permitted. - ... 3.0 COMMENTS 3.1 After World War II, building construction routinely involved the use of asbestos-based insulation products, which were sprayed on. The asbestos fibres, amalgamated with a liquefied binding agent, were applied directly on site, and sprayed onto walls, support beams and pipes. Asbestos was a very popular material because they protected against fire and afforded good thermal and acoustic insulation. - - - 3.2 There are many different types of asbestos fibre divided into two main categories: _ amphibole and serpentine asbestos. The amphibole fibres used commercially are extremely hazardous. This form of asbestos fibres can be easily inhaled and can ... remain indefinitely in the lung tissue, and may cause cancer. Most countries introduced a ban on amphiboles products, in the 1970's. The most common serpentine fibre today, _ chrysotile, is considerably less hazardous than amphibole varieties. Serpentine asbestos is unlikely to remain suspended in the air. Thus, less of it is likely to be _ inhaled, and it does not stay in the lungs very long. The human immune system can eliminate these fibres fairly quickly. - ... 3.3 Although there are health concerns and provincial regulations for handling, processing and disposing of some varieties of asbestos, it is described as a 'solid non-hazardous waste' on the Ministry of the Environment application form for Certificate of Approval. The applicant has requested approval to receive 20-25 tonnes of waste daily and store 75 tonnes of waste daily. The 75 tonnes would equate to approximately 5 storage containers currently used on site. - - - 3.4 The Clarington Engineering Services Department reviewed the request for amendment to the Certificate of Approval and advised they have no comment on the application. ... 614 ... REPORT NO.: PSD-106-02 PAGE 4 3.5 The applicant entered into a site plan agreement with the Municipality of Clarington in September 1998, for the development of the site for the processing and temporary storage of PCB waste for transfer. The site consists of several trailers and containers. One trailer is used for an office/staff room. Another trailer is used for dismantling ballasts and generators containing PCB's. There are approximately eight containers for storage. The existing site plan agreement contains a clause requiring a building permit for a permanent building to be applied for within three (3) years of the agreement date. A permanent building has not been applied for or build, therefore, the site plan agreement is not in good standing. In addition, the trainers/containers which have been placed on site are not reflective of the location shown on the approved site plan drawings. Two or three of the trailers/containers do not appear to comply with the required side yard setback of 5 metres. 3.6 On September 11, 2002, two staff members, together with Councillor Pingle and the applicant met on-site to discuss the application for Certificate of Approval, as well as the existing site plan agreement. At that time Mr. Samson advised he was in discussion with a local designer to plan a permanent building to be constructed for the property on Lake Road. Since the existing use is not in compliance with municipal approvals and his current site plan agreement, the applicant agreed to submit an amending application to extend the time frame of the trailers/containers for an additional year. This amending application was received on September 17, 2002, and is currently being processed. 3.7 Mr. Samson believes that his company should be able to start a building on the site within 6 months. Staff are prepared to process a site plan application expeditiously when received. In the revision to the site plan agreement, the timing provision for a permanent building will be amended to 12 months for the issuance of a building permit and 18 months to occupy the new building. Mr. Samson has agreed with the time frame proposed. 615 ... . .. ... .. ... ... ... .. - .. .. .. .. .. .. .. .., .. - - - ... - - .. ... ... - - - - ... - - - - - REPORT NO.: PSD-106-02 PAGE 5 3.8 The addition of asbestos waste as another product to be handled on site further enlarges the operation with no easily enforceable commitment to construct a building on site. The use of containers and trailers is a poor precedent for the development of industrial areas in the Municipality. However, this condition has existed on the site for over four years and the applicant appears to be proceeding in good faith. Staff recommend that the Ministry's Certificate of Approval be limited to a maximum storage of 35 tonnes at this time, until permanent facility is constructed on site. A permanent facility would ensure better security and provide for the continuous processing of the waste without moving between several structures and/or containers. It would also help to ensure that this site does not become a detriment to the development of nearby industrial lands. 4.0 CONCLUSION 4.1 It is recommended that the Council advise the Ministry of the Environment that the Municipality of Clarington has no objection to the proposed amendment to the Certificate of Approval, to allow an asbestos processing and storage on the subject property, subject to rectifying existing zoning infraction and limiting the approval to a maximum storage of 35 tonnes per day. At such time as a permanent building for the waste handling business is completed, staff would have no objection to increasing the on-site storage capacity. Residents on the north side had vision and access impeded when motorists attempted to park two vehicles between driveways thereby encroaching upon the driveway apron. . Fire hydrant access on the north side was blocked west of House Number 32 as motorists encroached within 3 metres. . Children walking across Quinn Drive between the vehicles parked on the north side and the soccer field on the south side. , . Emergency Services response could be hindered by the parking congestion. 1.4 Corrective Recommendations Staff determined that the best corrective measure to improve safety concerns and reduce parking complaints was to prohibit parking on the north side of Quinn Drive. 702 ... ... .. ... .. Waverlev Road Waverley Road is a 10 metre wide collector roadway with a yellow centre line but presently permits parking on both sides. There did not appear to be a shift in parking from the north side of Quinn Drive to the west side of Waverley Road after the installation of 'No Parking' signs on Quinn Drive. Dear Mrs. Kempers: - RE: SAFETY ISSUES ON QUINN DRIVE, BOWMANVILLE - This letter is in response to your letter of July 2, 2002 and should also summarize the verbal discussions you have had with myself and other staff members over the past few months. - The municipality's Parking Enforcement staff had received numerous complaints concerning vehicles parking on both sides of Quinn Drive. This parking congestion prevented the safe movement of passenger and emergency vehicles and also hindered access to driveways. This parking congestion was created by use of the Optimist Park by soccer and baseball groups. Many soccer parents found it easier to park on both sides of Quinn Drive near the soccer pitch rather than walking from the parking lot at the school on Waverley Road. To address this safety issue, Engineering Services determined that parking should be limited to one side of Quinn Drive. The Director of Engineering Services is authorized to place such signs in accordance with the municipal Traffic By-law 91-58. The installation of the signs was considered a temporary measure to address the immediate safety concern as well as to determine if additional no parking restrictions may also be required on Waverley Road should the parking problems . . shift from one street to the next. Westbound motorists stopped at the stop sign have good visibility to the south but must creep out beyond the large evergreen tree into the intersection to see northerly a distance of 125 metres. Truck drivers or those operating a snow plow have difficulty seeing under the tree canopy and have very limited sight distance. Motorists travelling eastbound have a vision of 125 metres to the north but only 85 metres to the south due to obstruction from a farm fence and hydro pole on the southwest quadrant. Northbound traffic, which presently has the right of way, must veer left through the intersection to follow the road alignment and avoid a large evergreen tree situated on private property. Southbound traffic, which presently has the right-of-way must veer left to avoid a wooden utility pole. Due to the curve within the intersection, northbound or southbound motorists, during dark or adverse weather conditions, may perceive the stopped vehicles as being within the travel lane and cause additional confusion. 2.2 Corrective Action -Options Reconstruction: Future development as it moves north would see this intersection reconstructed with an improved alignment and proper sight lines, however, those road works are still many years away. The adjacent property owners are not currently interested in seeing trees removed or their lands altered to correct the intersection deficiencies and would prefer to see an all way stop introduced to improve safety. 714 ... ... .. - .. .. ... Director Emergency & Fire Services Chief Administrative Officer MGC:sr 901 REPORT NO.: ESD-Q19-Q2 PAGE 2 BACKGROUND AND COMMENT As Council is aware, many of our full time firefighters respond in their off duty hours as volunteer firefighters. Recently, the International Association of Firefighters and more particularly Local 3139 of the Clarington Professional Firefighters Association is pressuring its' members to adhere to the Association's constitution. The constitution states that as a member of the union, firefighters may not be a volunteer firefighter elsewhere. This issue has recently come to the forefront in the media, where a full time firefighter with the Town of Whitby is facing having his union card pulled, due to the fact that he responds in a volunteer capacity with the City of Kawartha Lakes, a violation of the constitution. A tribunal is hearing his case and a decision should be forthcoming within the next 30 days. This firefighter has two sources of appeal and it is understood this may take several years before it is sorted out. To-date, all but three of Clarington's full time firefighters, who respond on a volunteer basis, have submitted resignations with the majority being effective December 31, 2002. This reduces our volunteer numbers considerably. Along with a couple of other resignations we are placed in the position that we need to hire approximately 29 volunteer firefighters to return our complement to the required level. Unfortunately, the replacement of the full time firefighters, who respond on a volunteer basis, was not a threat when the 2002 budget was prepared, and funds were not allocated to provide the protective clothing, wages to train and training materials for this large number of new recruits. Staff is also requesting that the tender requirements in the Purchasing By-law No. 94- 1291 be waived. Starfield/Lyons Safetywear Mfg. Co. has provided the bunker gear to most departments in the area in the past and we would like to maintain the same standard. As staff did not foresee that it would be necessary to hire this large number of volunteer firefighters, when preparing the 2002 Current Budget, the volunteer salary accounts will be overdrawn as a result of the increased training required to enable the new recruits to respond. I I I I I I I I I I I I I I I I I I I REPORT NO.: ESD-G1-G2 PAGE 2 BACKGROUND AND COMMENT At the Council meeting of September 30, 2002 a correspondence for direction from the Canadian Red Cross, D-4 was referred to the Director of Emergency Services for investigation and report. Staff has met with Mr. Steve Elliott, Emergency Management Ontario, and Community Officer for Central Ontario and discussed this program, among other issues related to emergency planning. Funding for this program was discussed as well as the question raised by Councillor Rowe regarding the use ofO.V.E.R.T. Staff also spoke to Ivan Ciucuira of the Durham Emergency Measures Office who agreed, in theory, that the use ofO.V.E.R.T was the logical route to take. However, he also needed clarification from Mr. Steve Elliott, if this plan was feasible. Staff feels that the creation of eight Municipal CERV groups, in light ofO.V.E.R.T.'s existence, would be a duplication of efforts not to mention a waste of resources and finances. The program required, if it is initiated in each Municipality, 20 volunteers to be outfitted and trained. Emergency management would train the local Emergency Co-ordinator who in turn would provide eight 2 12 hour training sessions to the volunteers, plus equip them with vests and hard hats. The funding mentioned in the program, one million dollars, would be shared province wide and the program may offset the costs "up to" 100 percent for the first year and "up to" 50 percent thereafter. The Municipalities would be required to apply for the funding each year as well as absorb all un-funded costs. It should be noted that there is no guarantee as to what portion, if any, the Municipalities would receive. In my discussions with Mr. Elliott he stated that CERV is not a mandatory program and Emergency Management Ontario would not dictate how or even if a Municipality were to participate. However, should a Municipality decide to participate in the CERV program the use of an organization like O.V.E.R.T would be a satisfactory solution. Mr. Elliott also advised that there are approximately ten communities participating in a pilot project including one regional municipality, thought to be HamiltonlWentworth. These Municipalities will be observed over the winter and in the spring the program will be revisited and modified, if required, based on the results. Staff feels that the use ofO.V.E.R.T. by the Municipalities in the Region would be a timely solution to the various needs identified in the program with the assistance of the local Canadian Red Cross volunteers. I I I I I I I I I I I I I I I I I I I REPORT NO.: ESD-020-02 PAGE 3 Staff also feels that the time has come for a joint emergency response committee made up of DEMO staff and the Community Emergency Management Co-ordinators. This group should meet on a regular basis and help look at the co-ordination of emergency response and resources in the Region. Each local Municipality will, under Bill 148, be required to have their own plan, co-ordinator and training programs. However, it is likely any major emergency will involve more than one local municipality and having such a committee would be invaluable. It would also enable the co-ordination of the CERV program region wide using the resources ofO.V.E.R.T. and the Canadian Red Cross. Ivan Ciuciura of DEMO agrees that a meeting should be called of the local Emergency Co- ordinators and he will endeavour to arrange this meeting within the next month. Staff believes this is a good first step, but direction from the various Councils may be necessary to ensure this initiative is followed up on. Enforcement of this area has consumed a considerable amount of staff time. Last spring staff spoke to the property owner Valiant Property Management about hiring a private security firm to perform enforcement duties on the site. Valiant has now retained Securitas Canada Limited to enforce the Traffic By-law on site. The proposed officers are Misty Jay T. Thompson and Colleen Victoria Anderson. In order for the officers to perform their duties they must be appointed by Municipal By-law. Once appointed the officers will be required to attend at the Municipal Law Enforcement Division in order to receive instruction on municipal ticketing procedures. REPORT NO.: CLD-46-02 PAGE 2 of2 BACKGROUND AND COMMENT On September 9, 2002, Committee considered Report CLD-37 -02, which highlighted the requirements of the Ontarians with Disabilities Act, 2001. Part of the requirements of this legislation is for municipalities to establish an accessibility advisory committee to advise the council about the prepar-ation, implementation and effectiveness of its accessibility plan. It was reported at that time that a Regional working group was being formed to review the requirements of the Act. The group has met on two occasions since September. Because of the size of the Region and the different issues experienced by each municipality, it has been decided that each municipality should implement their own accessibility committees. The working group will continue to meet for the purpose of sharing information. The Association of Municipal Managers, Clerks and Treasurers of Ontario is hosting a workshop on October 23 to assist municipalities with implementation of the Act. In order to provide information respecting the committee to our residents, Scugog and Clarington have agreed to jointly host public meetings with the Region. The meetings have been scheduled as follows: Tuesday, October 29, 7:00 p.m. - Port Perry Saturday, November 2, 10:00 a.m. - Courtice Complex The information provided at each of these meetings will be identical, so our residents will be able to attend whichever meeting best suits their schedule. Chief Administrative Officer REPORT NO.: COD-51-02 PAGE 2 BACKGROUND AND COMMENT Tender specifications were provided by Totten Sims Hubicki Associates for the Storm Sewer construction Old Scugog Road, Hampton and Storm Sewer Repairs various locations as required by the Engineering Department. Tenders were advertised in local papers, as well as the Daily Commercial News. Subsequently, tenders were received and tabulated as per Schedule "B" attached. All works included in the tender are maintenance related and were not specifically identified in the 2002 Capital Budget. As the total tender amount, associated design and administration costs are significantly higher than what has been budgeted for these maintenance works it is recommended that item #12, Nash Road, Courtice be deleted from the contract and be deferred to the 2003 Storm Sewer Maintenance Budget. With the removal of item #12, the total trade amount is revised to $54,204.60 (inclusive of G.S.T.) The total funds required, including a final design and tendering, contract administration, contingency and G.S.T., is as detailed in the letter from Totten Sims Hubicki Associates, marked Schedule "B" is estimated at $63,000.00 ($54,204.60 less G.S.T. rebate, plus design, administration and contingencies). It is recommended that funds in the amount of $38,000.00 be drawn by relocating existing funds committed for 1999 Winter Sand, 1999 Culvert Improvements and 2001 Sand and Salt from account #2900-17-X. The remaining required funds in the amount of $25,000.00 ($62,408.50 tender less item 12, plus design, contingencies, and net G.S.T. less $38,000.00 from account #2900-17-X) be drawn from account #7207-431-X. The low bidder has previously performed satisfactory work for the Municipality of Clarington. The Director of Finance has reviewed the funding requirements and concurs with the recommendation. THAT Report FND-016-02 be received; 2. That the Corporation of the Municipality of Clarington accept the agreement of the subscription policy to insure the liability assumed by this resolution as follows: The Corporation of the Municipality of Clarington hereby .1 Assumes the liability for bodily injury to or death of any person or damage to or destruction of property of others, imposed by law upon: a) Members of Council, Commissioners, Trustees, Board Members, Statutory Officers, Officers, Employees or Volunteer Workers of the Corporation of the Municipality of Clarington for liability which arises out of the use or operation by such person of a licensed motor vehicle; or b) The owner of any licensed motor vehicle, for liability which arises out of the use or operation of such licensed motor vehicle by Members of Council, Commissioners, Trustees, Board Members, Statutory Officers, Officers, Employees or Voluntary Workers of the Corporation of the Municipality of Clarington; 1301 REPORT NO.: FND-016-02 PAGE 2 .2 Declares that such assumption of liability be subject to the following limitations, exclusions and conditions: a) This assumption of liability applies only to the use or operation of a licensed motor vehicle in Canada or the United States of America by Members of Council, Commissioners, Trustees, Board Members, Statutory Officers, Officers, Employees or Volunteer Workers of the Corporation of the Municipality of Clarington including travel to and from work and attendance at meetings; , b) This assumption of liability applies only in excess of existing insurance carried by the owner of the licensed motor vehicle which was being used or operated by Members of Council, Commissioners, Trustees, Board Members, Statutory Officers, Officers, Employees or Volunteer Workers at the time of the accident and does not apply unless the. licensed motor vehicle which was being used or operated by such person at the time of the accident is insured for not less that the minimum Third Party Liability Limit required by The Insurance Act for the Province of Ontario; c) This assumption of liability is subject to the agreements, conditions, terms and limit of liability insured in the Non-Owned Automobile Policy issued by Subscription Policy and shall terminate whenever such Non- Owned Automobile Policy is terminated; and 3. NT /hjl 1302 J J J J J J J J J J J J J J J J J J J L L L I L t L REPORT NO.: FND-016-02 PAGE 3 Background and Comments 1.0 As Council is aware, as of July 1, 2002, the Municipality's insurance carrier through the Durham Municipal Insurance Pool was changed to the Frank Cowan Company Limited. Under the policy with the Cowan Company, the municipality carries non-owned automobile coverage. The intent of this policy is to provide coverage for a third party for bodily injury or property damage arising from the operation of an automobile not owned by the Municipality but being used to carry out a municipal responsibility. For example, both Members of Council and staff often use their personal vehicle traveling to locations for municipal business. . L 1.1 In the event of an accident, the insurance carried by the operator of the vehicle would respond first to any claim. This is enshrined in legislation in Ontario. 1 Beyond the liability limit carried by that individual, it is intended for the ... municipality's policy to take effect. L L L L L L J L. L l L L L 1.2 It has been brought to the attention of the Insurance Pool that changes in the policy wording require the above resolution to be adopted by Council. This resolution, in effect, reverses an exclusion that exists in the policy. 1.3 Without the resolution being passed, the insurer has the right once they have responded to a claim, to subrogate against the operator of the vehicle. This means that after the claim is settled, the municipality's insurer has the right to go back and sue the operator of the vehicle to recover their costs of the claim (including any settlement amount). The above resolution, in effect, removes the right of the municipal insurer from being able to recover back against the operator of the vehicle. 1.4 This, therefore, provides protection for any persons operating personal vehicles for municipal purposes against cost above and beyond their personal coverage attached to their automobile insurance. The Report set out the Terms of Reference for the Port Granby Project Community Advisory Committee, and addressed such matters as Committee mandate and structure. With respect to this latter point, the Terms of Reference provided for 10 Committee members, including seven citizen members. Representation from the following groups was to be considered in appointing these members: three members representing area residents, and one member each to represent agricultural, educational, business and environmental interests. The Regional Councillor for Wards 3 and 4 and a representative from the Durham Region Health would represent the two remaining voting members, while a Staff person would sit as a non-voting member. Mr. Harvey Thompson addressed Committee and indicated a concern that area residents were not adequately represented on the Committee. He specifically requested that the Terms of Reference be modified to increase the number of Port Granby area residents on the Committee and to provide spaces for people who were members of the 1999 Advisory Committee. Committee resolved to refer Report PSD-101-02 back to Staff. 2.0 COMMENTS The Terms of Reference for the Port Granby Project Community Advisory Committee were developed in consultation with the Government of Canada, as required by the Legal Agreement. In developing the Committee structure, the need to ensure that Port Granby area residents are well represented on the Committee was recognized. In this regard, three of the seven citizen members were specifically designated for area residents. This would represent one-third of the voting members of the Committee. 1502 - .. REPORT NO.: PSD-101-02 PAGE 2 1.0 BACKGROUND 1.1 In June 2001, the Government of Canada and the Municipality of Clarington announced the signing of a legal agreement under which both parties agree to work towards developing a local solution to the secure long term storage and management of the low level radioactive waste currently stored at the Port Granby Waste Management Facility. The undertaking is known as the Port Granby Project (the Project) and the Low Level Radioactive Waste Management Office (LLRWMO) has been designated as the Proponent. 1.2 The planning and implementation of the Project will take place over several years and is expected to proceed in three distinct stages: · the undertaking of the environmental assessment, Council approval of a preferred alternative for the Project, and approval of the preferred alternative by the responsible federal authorities; the construction of the new waste management facility; maintenance and monitoring of the new facility by the federal government. 1.3 The Agreement commits both the Municipality and the Federal Government to ... work cooperatively in order to expedite the completion of the Project, and to consult and communicate regularly throughout the process until final decisions - have been reached by the relevant authorities. In this regard, the Agreement provides the Municipality with the option of establishing a Community Advisory - Committee (CAC), with the organization and mandate of the CAC to be decided by Council in consultation with the Federal Government. The Federal - Government will provide funding to the Municipality to reimburse reasonable expenses related to the CAC. - - - - - 1.4 The purpose of this Report is to approve the Terms of Reference for the Port Granby Project Community Advisory Committee. The Terms of Reference as set out in Attachment No. 1 define the mandate, organization and administration of the CAC. 1505 ~ REPORT NO.: PSD-101-02 PAGE 3 j 2.0 COMMENTS .. 2.1 The Community Advisory Committee will assist the Proponent in helping residents understand the various issues related to the Port Granby Project, and will provide public input to Council on the planning and implementation of the Project. As such, it is important that the Committee membership be broad - based and balanced to ensure that its recommendations to Council reflect a wide range of perspectives from various interests across the Municipality. The groups identified in the Terms of Reference include area residents, as well as agriculture, education, environment, business and health. .. .. .. .. .. It is important to emphasize however, that the CAC will be an advisory committee to Council and not an oversight committee for the Project. The CAC will not make recommendations directly to the Federal Government, but rather will advise and make recommendations to Council on matters related to the Project. .. .. 2.2 The potential human health effect of the Project is as important issue and is expected to be of particular interest to the CAC. In this regard, a member should be appointed that possesses the knowledge necessary to understand and evaluate the public health implications of the Project. Therefore, it is suggested that the health community representative be recognized as a special appointee and not as a citizen member. The Durham Region Health Department possesses the appropriate expertise and has provided leadership in the field of the human health effects of nuclear facilities. Dr. Robert Kyle, the Medical Officer of Health for Durham Region, has agreed to provide a staff person to sit on the Committee, if requested by Council. .. .. IIli ... .. .. 2.3 Staff will provide administrative, clerical and technical support to the Committee, as well as administer the Committee's budget. The consulting team retained by the Municipality to provide technical assistance for the Project will also be available to the CAC to assist in the review and understanding of technical matters. A member of the consulting team will also assist the Chair as a facilitator to manage committee dynamics. III 11III .. 1506 .. ~ - - - - - - - - - - .. ... - - - - - - REPORT NO.: PSD-101-02 PAGE 4 2.4 As is normal practice, the term of the Committee shall coincide with the term of Council. This will require the Committee to be re-appointed by the new Council in January 2004 to sit for a further three years to the end of 2006, at which time it is anticipated that that the environmental assessment and licensing phase of the Project will be at or close to completion. Council may wish to review the need for and the mandate of the Committee at that time. 2.5 The Federal Government has agreed to compensate the Municipality for costs related to the CAC for the 2002 federal fiscal year (ending March 31, 2003), up to a maximum of approximately $50,000.00. Consultants account for the bulk of the estimated costs, with the balance covering administrative costs. Additional funding will be made available on an annual basis to the end of the Committee's mandate. 2.6 Membership on the CAC will be voluntary and, as such, members will not receive an honorarium. This approach is consistent with that of other advisory committees established by Council (eg. Agricultural Advisory Committee, Traffic Advisory Committee), 3.0 CONCLUSION 3.1 The creation of a Community Advisory Committee is important to developing and implementing a successful resolution to the low level 'radioactive waste management problem at the Port Granby site. The CAC will assist residents in understanding the various issues related to the Project, provide a venue for residents to participate in constructive debate and discussion, and assist Council in making decisions regarding the Project. This process to establish a new waste management facility is known as the Port Granby Project (the Project). The Low Level Radioactive Waste Management Office is the Project Proponent (the Proponent). The purpose of the Project is to clean up and provide appropriate local, long term ... management of low level radioactive wastes and marginally contaminated soils currently located in Clarington that are associated with the existing Port Granby Waste - Management Facility. The principai objective of the Project is to manage the wastes in a suitably constructed, environmentally safe, socially acceptable and appropriately ... controlled facility for at least 500 years. - - - - - - .. - Under the Agreement, the Municipality and the federal government have agreed to work together and to develop and maintain excellent communications and professional working relationships throughout the life of the Port Granby Project in order to attain the highest level of success in the completion of the Project. Both parties also believe that meaningful involvement by residents, businesses and community leaders in the Port Granby Project is important. In order to facilitate effective communications with the public, the Proponent has established a comprehensive communications program and Council is establishing a Community Advisory Committee (CAC), as provided for by the Agreement. Committee Mandate The Community Advisory Committee shall assist the Proponent in communicating with the public about the Port Granby Project, and provide advice to Council on the Project 1509- . 1 that reflects the comments and concerns of Clarington residents. In performing this function, the CAC will be expected to represent the views of both present and future residents of the Municipality. The members of the Committee shall work cooperatively and in partnership with the Municipality and the Federal Government to achieve the purpose and objectives of the Project. Scope of Activities 1 .... The Community Advisory Committee, in fulfilling its mandate, shall review matters related to the Port Granby Project referred to the Committee by Council or the Government of Canada, including the Proponent: The Committee may be requested to: .. a) Assist the Proponent in communicating with the general public on the Project; .. b) Receive and review studies and reports regarding the Project. ... ... The Committee shall report regularly to Council with advice and recommendations on matters being considered by the Committee. .. Membership and Structure The Community Advisory Committee is a volunteer committee. It shall consist of 7 citizen members representing a variety of interests drawn from across the Municipality in order to provide a range of perspectives on the Port Granby Project. Council shall generally seek to appoint members from each of the following groups: . agricultural community (1 member) . area residents (3 members) . education (1 member) . environment (1 member) . industry and local business (1 member). .. .. .. IlIlIIi --' One member of Council and the Durham Region Medical Officer of Health or his designate shall also be appointed to sit on the Committee. One member of Clarington staff shall sit on the Committee as a non-voting member. lIIII .. 1 51 D .. ... . ... .. .. ... - - - ... - - ... - ... - - - - - Given the projected life span of the Port Granby Project and the complex and potentially controversial nature of the issues to be addressed by the Committee, members must be willing to commit the time required to understand and evaluate the information provided, as well as be open-minded about listening to various opinions and perspectives on the Project. Openings for membership shall be publicly advertised and all residents of the Municipality are eligible to apply. Applicants will submit applications to the Municipality of Clarington Clerk's Department. Members will be formally appointed by Council. The Staff representative on the Committee shall sit as the interim chair. Once the Committee is operating in an acceptable manner, the Committee will select a Chair and Vice-Chair from among its membership. The Chair shall provide leadership to the Committee, ensure that the Committee carries out its mandate, and act as the primary liaison between the Committee and Staff, Council and the federal govemment . Citizen members cannot send delegates or alternates to meetings. The Chair shall advise the Clerk of any member who is absent for three consecutive meetings without reason being given at least 24 hours prior to the meeting, and may request that the member be removed from the Committee. The Chair shall also advise the Clerk of the resignation of any member. Council shall appoint new members to the Committee to fill any vacancies as required. Technical Support Municipal Staff will provide clerical, administrative and technical assistance to the Committee, as well as act as liaison between the Committee and the municipal administration. A facilitator will assist the Chair in ensuring that the Committee is successful in achieving its mandate. The Municipality's consultants will be available to the Committee to assist the members in understanding the various technical issues related to the Project. 1 5 1 1 Term of the Committee The terms of the Committee shall coincide with the term of Council. At the end of the first phase of the Project (environmental assessment and licensing), Council may review the need for and the mandate of the Committee. .1 .J .. MeetinQs Committee meetings shall be held in the Municipal Administrative Centre. The Committee shall generally meet a minimum of once per month; however, the Chair may schedule additional meetings or cancel meetings after consulting with the other members of the Committee.
