DISCLOSURE OF PECUNIARY INTEREST
+` Councillor Schell indicated that he would be disclosing a pecuniary
interest with respect to Report FND-004-03.
.. Councillor Robinson indicated that he would be disclosing a pecuniary
interest with respect to the Presentation of the Port Granby Project.
Mayor Mutton announced that the United States are giving full support to
+r. ITER and will be contributing $5 Billion. A meeting on February 18 and
February 19, 2003 will be held in Russia. Representation at these
meetings is crucial. Chairman Anderson and Mayor Mutton will be in
attendance.

Councillor Robinson stated a pecuniary interest with respect to the
Presentation of Bernard Gerestein regarding the Port Granby Project and
vacated his chair; Councillor Robinson lives in the subject area.

Gerestein, Manager of Communications and Community Relations who do
circulated a copy of his power point presentation on the Port Granby
Project.

Mr. Gerestein touched on the following topics:

- Defining the existing environment
- Alternative Means
- Communications/Consultation
-Activities to Date
- Conditions for Success; and
- Upcoming Activities
Mr. Gerestein and Glenn Case answered questions from the Committee.
(b) John Presta, Regional Municipality of Durham, 105 Consumers
Drive,Works Department,Whitby, L1 N 6A3 gave a powerpoint
presentation on the Wellhead Protection Area Studies. Wellhead
Protection includes the Township of Brock, Scugog, Uxbridge and
Municipality of Clarington and is in place to ensure water quality.
Mr. Presta pointed out 5 simple steps:
1. Form a team „r
2. Determine areas
3. Identify sources of contaminants
4. Manage area
5. Plan for the future '�
Included in Mr. Presta's presentation were:
• Background Hydrogeological Studies
• Typical Cross Section
• Orono Cross Section
• Orono Land use Inventory

• Management techniques for Wellness Protection Area
Mr. Presta completed his presentation by answering questions from the
Committee.

The applicant had appeared before Committee in July 2002 and the application was

months.
Similarly, A2003/002 was for an industrial development. Also in this case, the applicant

1.3 Staff has reviewed the Committee's decisions and is satisfied that the applications that
received approval are in conformity with the Official Plan policies, consistent with the
intent of the Zoning By-law and are minor in nature and desirable. Council's
concurrence with the Committee of Adjustment decisions is required in order to afford dd
Staff's official status before the Ontario Municipal Board in the event of an appeal of any
decision of the Committee of Adjustment.

2.0 ONTARIO MUNICIPAL BOARD HEARING —A2002/062 (G. BRIDGER)
.. 2.1 Mr. Gary Bridger appealed the decision of Committee of Adjustment to deny application
A2002/062 on September 26, 2002. The owner of 2 Merryfield Court, Bowmanville, was
seeking a variance to reduce the exterior side yard setback requirement from 6 metres
to 0.6 metres, to permit the construction of a detached garage. Committee of
Adjustment found the application not to be minor in nature and that it was not in keeping
with the neighbourhood.
2.2 Susan Ashton, Planner, gave evidence in support of the Committee's decision that the
low intent of the Zoning By-law was to maintain a sense of openness in the streetscape with
6 metre setbacks on both front and exterior side yards. Photographic evidence and sun
shadow calculations were presented to illustrate that the detached garage was not
desirable for the neighbourhood.
2.3 The Board member gave a verbal decision at the OMB Hearing, January 29, 2003,
dismissing the appeal as the application for the minor variance did not meet the intent of
the Zoning By-law, was not minor in nature and was not desirable for the
OIL neighbourhood. A memorandum of the oral decision was prepared and is attached.

JANUARY 29, 2003 AND ORDER OF THE BOARD
At the conclusion of the hearing on January 29, 2003, the Board dismissed the
appeal. The following are the Board's written reasons.
Mr. Bridger's residence is located at 2 Merryfield Court in Bomanville. His lot is
at the comer of Merryfield Court and Orchard Park Drive. The property has a frontage
of 18 metres and depth of 32 metres. The lot was developed as part of a residential
plan of subdivision in 1995. The existing residence is two-storeys with an attached two-
car garage. In 1998, Mr. Bridger added a shed in the rear yard. He now wishes to
construct a separate garage on the lot to store his extendi-cab truck. The proposed
garage is 4.5 metres by 9.1 metres to be located in the exterior side yard. Mr. Bridger
indicates that the existing garage is not large enough to store the truck inside and be
able to move around the vehicle with the doors opened.
In August 2002, Mr. Bridger applied for variances to yard setbacks to recognize
«., the existing shed and to permit the proposed second garage. The Committee of
Adjustment approved the variances related to the shed but refused the variances for a
reduction in the exterior side yard setback from 6.0 metres to 0.6 metres to facilitate the

garage. Mr. Bridger appealed the Committee's refusal to the Board causing this
hearing.
The Board heard evidence from Mr. Bridger in support of his application for
variances to permit the garage. Ms Ashton is a planner with the Municipality of
Clarington. It is her opinion that based on the required analysis pursuant to the
Planning Act, the variances should not be authorized.
Mr. Bridger examined all other corner lots in the subdivision. He found one home '
on one corner lot had been granted a variance for a reduced exterior side yard from 6
metres to 3.91 metres. He felt that the reduction in setback for his garage, which is a
smaller structure, would be less of an impact. Ms Ashton's photo evidence (Exhibit 5)
satisfies the Board that this variance maintains the intent of the By-law. He also
presented an example of a garage in an exterior/rear yard in the Town of Ajax as
support for his application in Bomanville. This latter example is not helpful to the Board
as it cannot be readily compared with the planning policies and standards established
by the Municipality of Clarington for the subject neighbourhood.
The subject and surrounding lands are designated Urban Residential. The
development of the lands for low density residential uses and an accessory building is 40 1
consistent with this designation. The lands are zoned R1. The existing development of
the lot for residential purposes, including the existing shed, is also consistent with the
intent of the By-Law.
Section 12.2 of the By-law requires front yard and exterior side yards to be a

minimum of 6 metres. Ms Ashton indicates that these standards result in a
development pattern with consistent setbacks from public streets and results in larger
houses being permitted on small lots while maintaining a feeling of openness. Exhibit 5
contains photographs of many other developed comer lots in the immediate vicinity,
which clearly demonstrate this concept. It is Ms Ashton's opinion that the location of
garage in the northeast comer of the lot in the exterior side yard would have a "huge"
presence on Orchard Drive. The proposed size and location of the garage are not
consistent with the maintenance of openness. She also indicates that there are no other
(lots in this subdivision developed in the manner proposed by Mr. Bridger.

The Municipality also conducted a sun/shade analysis of the proposed garage
construction for the period between October and April. The Municipality analysis
concluded that at certain times the rear yard of the property to the immediate north
would be 43 % in shade. Ms Ashton concludes that this would result in a significant
impact on the residential rear yard to the north. She also distinguishes the shade
created by the proposed structure as being more solid and a greater impact than the
filtered shade trees or fencing provide and which could be located in the Bridger rear
TAM yard.
Mr. Bridger's preferred to construct the garage with a second access off of
�► Orchard Park Drive. The Municipality would not grant the second entrance to the lot.
Should the garage be permitted, in addition to the existing driveway, the driveway
access to the new garage would extend from the existing driveway on Menyfield Court
and extend across the front yard and down the east side yard. While this pattern of
development would not be in conflict with any other standard for landscaped open area
or site line triangle concerns, the Board finds it is not consistent with the planned
development for lots in this subdivision and on that basis is not desirable.
On the basis of the evidence and submissions, the Board finds that the proposed
garage is not desirable from the perspective of impact of shadowing on the rear yard to
the north; it would not be in keeping with the overall pattern of built form in this new
neighbourhood; the garage is taller and larger than other accessory sheds, which are
generally screened; and there are no other garages in side yards in the prescribed
neighbourhood requiring access across the front yard. The appeal is dismissed and the
variances related to the garage are not authorized.

February 2000. It contains a total of 354 single detached and semi-detached
dwelling units and coastal villas. The second plan of subdivision, 18T-96013
(Phase 2) was draft approved in December 1997. It includes a total of 338 single
detached and semi-detached units. Both plans are currently under development.

2.2 On January 29, 2001 Kelvin Whalen submitted a rezoning application on behalf
of 1138337 Ontario Inc. (The Kaitlin Group) to permit townhouse units in Block
204 on draft approved plan of subdivision 18T-91004.

'A' be increased from 40 to 42 units.
3.0 SITE CHARACTERISTICS AND SURROUNDING USES
3.1 The site is currently vacant. The topsoil has been disturbed as a result of the
installation of services.

4.0 OFFICAL PLAN POLICIES
4.1 The Durham Region Official Plan designates the lands "Living Area". Lands
designated as Living Area shall be for housing purposes, limited office and retail
uses. The proposal appears to conform to the provisions of the Regional Official
Plan.
.. 4.2 The Clarington Official Plan designates the subject lands in part "Local Central
Area" and "Urban Residential" with a Medium Density symbol. Local Central
.. Areas shall serve as focal points of activity for residential communities and shall
develop as mixed use areas containing commercial, residential, recreational,
-- community, cultural and institutional uses. In addition, Local Central Areas are
gathering places for the community and shall incorporate public squares where
`- possible.

Medium density residential uses shall be developed at 31-60 units per net
hectare. The predominant housing form shall be townhouses, triplex/quadraplex
and low-rise apartments to a maximum of four storeys.
The proposed uses are permitted and consistent with the Clarington Official Plan.
5.0 ZONING BY-LAW CONFORMITY
5.1 The lands subject to the application are currently zoned "Holding-Urban
Residential Exception ((H) R4-18)" which permits apartments and "Holding -
Urban Residential Exception ((H) R4-19)" which permits apartments and a variety
of general commercial uses.
5.2 Townhouses are not currently permitted in these zones therefore it is necessary
to rezone these lands.
6.0 PUBLIC NOTICE AND SUBMISSIONS
6.1 Public notice was given by mail to each landowner within 120 metres of the
subject site and a public meeting notice sign was installed on the subject lands.
6.2 The Public Meeting was held on March 26, 2001. Eleven area residents spoke in
objection to the proposed rezoning. The concerns of area residents are
summarized below.
• Residents were unaware that the existing zoning on the subject lands
permitted apartments. They felt that Kaitlin's sales staff did not fully •
disclose the company's future development plans. Many of them were told
that only single and semi detached dwellings would be built as well as the
coastal villas. The sales and marketing material only indicated "Future
Development" on the subject site and did not provide further detail. They
were concerned about the impact of property values as a result of
apartments and townhouses.
• One resident expressed concerns regarding increased traffic.

• One resident expressed concern that he will lose his view of Lake Ontario.

Some residents were generally dissatisfied with the developer and the
quality of their homes.
6.3 Two written submissions were also received. On March 20th, 2001 Mr. Rick Law
submitted a letter and petition with the signatures of 81 area residents in
objection to the rezoning. The petitioners had purchased their homes based on
VW the knowledge that only single detached dwellings and coastal villas would be
built in the Port of Newcastle. They object to any deviations from single detached
homes.
Christopher and Karina Doyle of Waterview Lane submitted a letter, stating they
had visited the sales office on four occasions prior to purchasing their home.
They were never informed of the proposed townhouses or apartments. Had they
known that townhouses or apartments would be built they would not have
purchased a home in the Port of Newcastle.
7.0 AGENCY COMMENTS
7.1 The Clarington Fire Department did not note any safety concerns.
7.2 The Region of Durham Planning Department initially indicated that the proposal
would necessitate an amendment to draft approval for Plan of Subdivision. In a
subsequent conversation, the Region acknowledged that as the development
does not necessitate a change in the street patterns and is a reduction in the
number of units permitted on Block 204 (18T-91004) from 60 to 42 units, an
amendment to Draft Approval was not required.
Regional Works indicated that sanitary sewer and water supply are available to
the subject site. All requirements of the Region, financial and otherwise will be
covered through a site plan approval process.

7.3 On October 18, 2001, the Clarington Engineering Services Department required
the submission of a stormwater management report to support the development
east of Shipway Avenue. Since Block C has been deleted from the proposal, the .r
report is no longer required.
Individual driveways on Lakebreeze Drive are not supported. The developer has
confirmed that the driveways to individual units are internal and will be privately
owned and maintained.
Engineering initially required the submission of a traffic study. Upon further
review, Engineering Services noted that the development is within a Draft 40
Approved Plan of Subdivision and is a reduction in the number of units. As such,
the necessity of a Traffic Study is not required.
On November 7, 2002 the Engineering Services Department noted that concerns
of October 18, 2001 have been addressed sufficiently to deal with the rezoning
application however, additional details such as snow storage, sidewalk and fence Ali
locations will be reviewed through the site plan approval`process.

7.4 The Ganaraska Region Conservation Authority noted that Block C is the only
area under consideration for rezoning that would require permits under the Fill,
Construction and Alteration to Waterway Regulations. Since Block C has been
deleted from the rezoning application, a permit is not required.
Initially, the Authority noted a number of Conditions of Draft Approval for the Plan
of Subdivision had not been cleared for this portion of the plan. A storm water
management plan or sedimentation/erosion control plan had not been submitted.
On November 26, 2002 staff at Ganaraska Region Conservation Authority,
confirmed that all concerns and conditions of the Authority with respect to storm
water management or sedimentation/erosion control plan have now been fulfilled.

plan to review the grades at Lakebreeze Drive and blocks south to Lake Ontario.
r- The Authority has been consulted on this issue through the Port of Newcastle
Waterfront Plan and have indicated that the grading can be dealt with through
Ew approval of the waterfront plan.
"' 8.0 STAFF COMMENTS
8.1 The applicant proposes two townhouse blocks totalling 54 units, in the area
Im bounded by Lakebreeze to the south, Shipway Avenue in the north-east and east
of the homes on Waterview Lane. Rezoning of Block C has been withdrawn at
the applicant's request.
8.2 The proposed townhouses are located within part of Block 204 on Draft
Approved Plan 18T-91004 in the Port of Newcastle. Block 204 contains a number
of smaller blocks for multiple residential and commercial uses. A total of 310
residential units are contemplated for Block 204. A maximum of 190 units are
permitted in Blocks A, B and the future development block shown on Attachment
1.This reflects a medium density of 31-60 units per net residential hectare.
Block A allows for 60 multiple units, and is currently zoned for apartments. The
rezoning application proposes 42 townhouse units, a reduction of 18 units. Block
B, as well as the future development block, would permit 130 units and is also
aw zoned for apartments, however, only those lands that front onto Lakebreeze
Drive are proposed for 12 townhouse units. Three low-rise apartments,
consistent with the existing zoning, are proposed for the future development
block, which can develop to a maximum of 136 units. An application for site plan
approval has not been filed for the apartments to date (See Attachment 2).
Removing the apartments in Blocks A and B and permitting townhouses reduces
the number of units, however, still conforms to Medium Density housing category
in the Official Plan.

8.3 In Block A, forty two (42), one storey plus a loft, townhouse units are proposed. A
6 metre wide private laneway will provide access from Shipway Avenue to
Lakebreeze Drive. Two parking spaces per unit are proposed with an additional
12 visitor parking spaces being provided (.25 spaces per unit). Road
maintenance and waste collection will be provided privately. The applicant will be
required to apply for site plan approval and draft Plan of Condominium approval
for this Block.
8.4 In Block B, twelve (12) two storey street townhouse units are proposed,
consisting of two six (6) unit blocks separated by a private walkway. The
townhouses front onto Lakebreeze Drive with a 2 metre front yard setback.
Parking for each unit is in the rear yard. Access will be provided by a 6 metre

private laneway. The developer has requested that the by-law reflect two
possible alternatives for parking. The first option, would accommodate two

parking spaces in a detached garage. The second option would accommodate
one parking space in an attached garage, the second parking space in front of

the garage. The by-law reflects setbacks for either option. Detailed drawings for
either scenario will be submitted when an application for site plan approval is
submitted.
8.5 Many of the area resident concerns were focused on being misinformed by
Kaitlin's sales staff about the future development plans for the Port of Newcastle.
The zoning to permit apartments in Block 204 in 18T-91004 was granted in
October 1997, prior to the occupation of many of the homes in the Port of
Newcastle area. The introduction of townhouses reduces the number of units
originally approved. It also provides alternative housing to single detached, semi
detached homes or apartment units. The proposed townhouses conform with the
density provisions of the Official Plan.
8.6 In June 2002, Council adopted policies which requires developer's to submit
sales and marketing material to staff for approval so that the perspective home

buyers are properly informed of the future land uses and approved zoning in the
neighbourhood. The sales information for Port of Newcastle has been changed
to reflect the current and future lands uses as approved.
9.0 RECOMMENDATIONS
9.1 Based on the comments in this report, it is respectfully recommended that the
rezoning application be APPROVED.

1.0 BACKGROUND
1.1 On Tuesday, February 5, 2003, an Ontario Municipal Board Hearing was held in
the Council Chambers with respect to an appeal by Janet and John Rice of a site
plan application for lands composed of 209 and 215 King Street East,
Bowmanville. The subject lands are located at the south west corner of King '
Street East and St. George Street, and are developed with a Kentucky Fried
Chicken outlet and a Pizza Hut outlet. The application for site plan approval
proposed to introduce a drive-through window and associated queue lane to the
existing Kentucky Fried Chicken establishment, as well as other site
modifications, to accommodated the proposed development.
1.2 From the outset of the application, staff identified access to the site, and turning
movements on King Street, to and from the site as issues. The Municipality
originally requested closure of the most easterly access,.in front of the Pizza Hut,
as a condition of approval. This was unacceptable to the applicants. As a .,
compromise, staff negotiated to leave the entrance open as a restricted right-in
design, subject to traffic monitoring and the ability of the Municipality to modify or
close the entrance in the future should traffic monitoring identify issues.
1.3 Both Engineering and Planning Services staff believed a resolution to the issue,
based on the traffic monitoring requirement, had been achieved. However, when
the applicant returned the executed site plan agreements, the monitoring clause,
providing the Director of Engineering the ability to modify or close the entrance, ••
was deleted from the agreement. When the applicant's solicitor was advised that
without such condition, the Municipality would not execute the agreement, the VAW
condition of site plan approval was appealed to the Ontario Municipal Board.
Subsequently, the Directors of Engineering and Planning Services withdrew their
recommendation of approval, and the entire site plan was appealed by the
applicants. The applicants also filed an appeal to the passage of the Interim
Control By-law for the King Street East Corridor.

2.0 OMB HEARING
2.1 The Municipality's solicitor prepared a motion to adjourn the hearing due to the
aw Interim Control By-law passed by the Municipality with respect to the King Street
East Corridor. The motion was supported by an affidavit from the Director of
W" Planning Services and Manager of Community Planning and Design detailing the
history of the file and verbal agreement to the traffic monitoring clause, the need
"" for a comprehensive study of land use, traffic and urban design issues for the
King Street East corridor and the need to hear all appeals on the Interim Control
"" By-law together. The last day for appeals to the Interim Control By-law is March
7th, 2003. The solicitor argued that the Municipality needs to protect the public
interest by undertaking the study authorized by Council. Accordingly, he
submitted that further development of the site was not appropriate while the
Interim Control By-law was in effect and prior to the Municipality undertaking their
study. Furthermore, the appeal to the Interim Control By-law should be heard
together with any other appeal of the By-law to ensure all common issues are
dealt with in a similar manner. The solicitor advised the Board that the
Municipality had no objection to consolidating this appeal with appeals to the
Interim Control By-law. Accordingly, he concluded the appeal by John and Janet
.r Rice should be adjourned until all appeals on the Interim Control By-law were
heard.
2.2 In response, the solicitor for the applicant argued that the Municipality passed the
.. Interim Control By-law only to frustrate his client. Moreover, both the Pizza Hut
outlet and the Kentucky Fried Chicken outlet are both operating today, therefore,
two approval of the site plan for the drive-through, would not increase the usability of
the site. In addition, the applicant's solicitor argued that site plan approval was
am
not necessary for the proposed drive-through window and associate revisions to
on-site traffic configuration.

3.0 DECISION •
3.1 In an oral decision, the Board allowed the adjournment, noting that to approve
the site plan would approve a use the Interim Control By-law does not permit.
However, the Board set April 10, 2003 for a pre-hearing of all the appeals to the
Municipality's Interim Control By-law. In addition, April 29, 30 and May 1, 2003
were set as hearing dates for appeals to the Municipality's Interim Control By-
law, as well as the adjourned a pp eal to site plan a pproval by John and Janet
Rice.

1.0 BACKGROUND
1.1 On February 10, 2003, Gerry Hasiuk appeared at Council to discuss a number of
development issues relating to his interest in developing property for transport .r
depot at the northeast corner of Hancock Road and Baseline Road in South
Courtice (see Attachment 1). Council referred the matter to staff for a report. r
1.2 Mr. Hasiuk currently operates a transport depot from the southeast comer of wr
Courtice Road and Baseline Road in South Courtice. Although the zoning of the
property permits the use at this location, this property represents the entrance to ••
the Courtice urban area. Since approval was not obtained prior to
commencement of the use on the property, Mr. Hasiuk is required to obtain site ••
plan approval at this location. Staff prepared a letter on April 23, 2002 outlining
conditions of site plan approval, which included road widenings on both road
frontages, landscaping, storm water management, an environmental impact
study to address development impacts on an adjacent creek, and transfer of �+
creek related valleylands to the Municipality. Since Mr. Hasiuk did not wish to
proceed with approvals at Courtice Road and Baseline Road, he is seeking '
approvals on the subject lands.
2.0 STAFF COMMENTS
2.1 The subject property is designated "Light Industrial" in the Clarington Official
Plan, which does not permit a transport depot; however, since the present
"General Industrial (M2) Zone" permits a cartage or transport depot and yard, the
site plan approval may be granted on the lands as long as the current zoning
remains in force.
2.2 Staff have met with Mr. Hasiuk and his agent on several occasions to discuss
site development issues. Mr. Hasiuk has requested that an entrance permit be
issued to permit the transport depot on the subject lands. An entrance permit
cannot be issued for the property without the applicant obtaining site plan
wr
approval. Site plan approval will deal with, among other matters, the location and

scale of the operation, entrance location, landscaping, road widening, and
parkland dedication.
2.3 The main issue relates to the location of an entrance to service the property. The
technically preferred Highway 407/401 Courtice Connecting Link route traverses
the eastern half of the property (see Attachment 1). Neither its exact alignment
nor detailed engineering have been completed for this alignment to date.
Therefore, comments on site development from the Ministry of Transportation are
very important in determining the entrance location. The second issue relates to
a future grade separation between Baseline Road and the St. Lawrence and
aw Hudson Rail line (see Attachment 1). A road design may have to be prepared to
determine whether and where an entrance can be accommodated between the
fm Highway 407/401 Courtice Connecting Link and the future grade separation.
�. 3.0 STAFF COMMENTS
3.1 Correspondence dated January 30, 2003 between Staff and Mr. Hasiuk outlined
aw these development issues and site plan approval requirements. On February 10,
2003, Mr. Hasiuk appeared before Council to voice his concerns on the following

• requirement for a road widening on Baseline Road; and
• 2% cash-in-lieu of parkland dedication.

Earth Berm

Although the Zoning By-law permits the proposed use, the property is designated
r
"Light Industrial" in the Clarington Official Plan, which does not permit the
proposed use. The policy direction for light industrial uses is that they be
NO contained within a building of high architectural standard, with limited and
screened outdoor storage. The uses should also be compatible with adjacent
ow uses. Based on this policy direction, Staff had requested a 3.0 metre high earth
berm be established to screen the transport depot from view on Baseline Road.

It was presumed that topsoil would be removed from the site and gravel laid r
down to construct the depot area. The topsoil could be pushed to the southern
limit to form the berm. In light of the concerns raised, Staff would be prepared to
accept a reduction in berm height to 1.5 metres provided that a solid row of
coniferous trees are planted on the berm as screening.
Road Widenin_g
The Clarington Official Plan designates this section of Baseline Road as a Type
"C" arterial, requiring a minimum right-of-way width of 26 metres. Where road
widenings are required, they are normally acquired free and clear of any
encumbrances through site plan approval. In this case, the widening could be .�
greater if additional lands are required to accommodate the Highway 407/401
Courtice Connecting Link and the future grade separation. Staff recommend that
any road widenings required to accommodate future transportation needs be
acquired at this time.
Parkland Dedication
The Municipality's Parkland and Open Space Dedication By-law 95-104 has

been adopted in accordance with the Planning Act. Said By-law requires that, as
a condition of site plan approval for commercial and industrial development, an
amount not exceeding 2% of the developed lands shall be conveyed to the
Municipality. The Municipality may also waive the conveyance of land in favour
of a cash-in-lieu of parkland contribution where a land conveyance does not fulfil
the Municipality's parkland objectives.
The By-law defines "development" as the placement of one or more buildings or
structures on the land. The applicant will require either a building or structure to
accommodate maintenance equipment and spare tires on site. Therefore, Staff
feel that the 2% cash-in-lieu of parkland dedication is appropriate for the portion
" of the property being developed.

4.0 RECOMMENDATIONS
4.1 To summarize the discussion in this report, Staff would recommend that the
- following requirements be implemented through site plan approval.
• The required earth berm be reduced from 3.0 metres to 1.5 metres provided
that a solid row of coniferous streets are planted on the berm as screening;
• Any road widenings required to accommodate future transportation needs be
acquired through site plan approval at this time; and
A 2% cash-in-lieu of parkland dedication is appropriate for the developed
portion of the property.

1.0 APPLICATION DETAILS
1.1 Applicant: Gwendolyn Dooley and Glenn McCaul
1.2 Rezoning: Removal of Holding "(H)" symbol from "Holding-Urban Residential Type
One ((H) R1)" to "Urban Residential Type One (R1)".
1.3 Location: Part Lot 33, Concession 2, former Township of Darlington
2.0 BACKGROUND
2.1 On January 30, 2003, Staff received a request from Gwendolyn Dooley and Glenn
McCaul for the removal of the Holding "(H)" provision from a residential property on
Renwick Road in Courtice. Attachment 1 shows the location of the lot currently zoned
"Holding-Urban Residential Type One ((H) R1)".

2.2 The lot was severed from the vacant rear portion of 2604 Prestonvale Road through
application LD 248/2002.
3.0 STAFF COMMENTS
3.1 The subject property is presently zoned "Holding-Urban Residential Type One ((H) R1)".
The provisions of the Zoning By-law allow for the removal of the Holding "(H)" symbol,
by By-law, upon Council being satisfied that the uses to be permitted will be adequately
serviced, have appropriate access, and will be used for the purposes intended by the
By-law.
3.,2 It is noted that pursuant to Section 36 of the Planning Act, a by-law amendment to
remove the Holding "(H)" symbol is not subject to the normal appeal period afforded to a
standard rezoning application, and accordingly, shall be deemed final and binding
should Council grant approval of same.
3.3 The removal of the Holding "(H)" symbol was a condition of approval for the related
consent application. The applicant is nearing completion of the land division process «

having finalized all other requirements of the Municipality of Clarington for the land
division. Subsequently, Staff is recommending the Holding "(H)" symbol be removed at
this time to facilitate development at the site.
4.0 RECOMMENDATIONS
4.1 In considerations of the comments noted above approval of the removal of the Holding
"(H)" symbol as shown on the attached by-law and schedule (Attachment 2) is
recommended.

1.0 LEGISLATION
1.1 Section 207, Subsection 146 of the Municipal Act allows Council to authorize minor
W&
variances to the Sign By-law if, in the opinion of Council, the general intent and purpose
of the by-law is maintained.
2.0 BACKGROUND AND PROPOSED AMENDMENT
2.1 On February 4, 2003, the Planning Services Department received an application for a `
minor variance to the Sign By-law submitted by Ken Bruce of Atlantic Signs on behalf of
the Bulk Barn. The minor variance is a request to increase the permitted size of an
identification sign from 8.4 square metres to 12.0 square metres.
2.2 The subject property is located at 2379 Highway 2, the Clarington Centre shopping
plaza. Furthermore it is described as being within Part Lot 16, Concession 1 in the
former Town of Bowmanville (see Attachment 1). An LCBO outlet is located
immediately to the west and A Buck Or Two to the east. The signs for each adjacent
store comply with the Municipality's Sign By-law.
22 The Sign By-law currently permits one wall, window or canopy sign for each business
within a multiple business site. The maximum size is 3.75 square metres, or 10% of the
wall or window area, whichever is greater. In this case, the sign area measures 12.0
square metres. The display surface measures 18.1 square metres. Based on the wall
area for the Bulk Barn, the maximum permitted sign area would be 8.4 square metres
and the maximum permitted display surface would be 12.6 square metres. The applicant rr
is requesting a variance to permit a sign with a wall coverage percentage of 14%. The
sign at 12 square metres is approximately 43% larger than the 8.4 square metres J4
permitted by the by-law.

2.3 Section 5.1.2 of Sign By-law 97-157 states that, at his discretion, the Director of Planning
Services "has the authority to make minor exceptions without amendment to this by-law
in situations of extenuating circumstances. These exceptions shall be only for the size
and height of a sign and shall not exceed 10% of the permissible size or height as
described by this by-law". The sign exceeds the permissible size and must be dealt with
by Council. . +

2.4 The intent of the Sign By-law is to govern signage through type, number and size. This
plaza, as approved through the site plan process, was reviewed to ensure conformity
with urban design guidelines that were prepared for this area. A goal with regard to
•- signage was to maintain consistency throughout the plaza for signage in terms of size,
type and location on the building.
2.5 The portion of the plaza where the Bulk Barn is located does not have a designated sign
�- box. There is an area on the stucco face of the building that is being used by the various
tenants for signs. This stuccoed area has three horizontal panels (See Attachment 2).
�- The Bulk Barn's installed sign extends beyond the middle panel into the top panel.
2.6 Both units on either side of the Bulk Barn have erected smaller signs on this stuccoed
face. Each is contained within the middle panel only. A Buck Or Two occupies the unit
to the east and has a sign box although no signage is located within it at this time. The
LCBO outlet to the west has one 4.7 square metre wall sign, which is smaller than the
by-law allows, and 2 canopy signs. These signs are in conformity with the Sign By-law
requirements (See Attachment 2).
2.7 In 1997, the LCBO requested a Sign By-law amendment to allow the location of 2 signs
on the tower. Locating the signs on the tower and increasing the permitted number from
one to two signs was not approved.
3.0 STAFF COMMENTS
3.1 In July 2002, the applicant contacted staff for the requirements of an identification sign.
The applicant was advised the sign, as proposed, was too large and did not meet the
sign by-law requirements. It could only be permitted by amendment to the Sign By-law.
The applicant was provided the relevant information for the submission of an application
.. for amendment to the Sign By-law. Shortly thereafter, a sign was erected without a
permit.
3.2 The Municipality's By-law Division investigated and requested a sign permit be obtained
for the signage installed. A Bulk Barn representative forwarded a sign permit application

in January 2003. The dimensions of the sign contained in the application exceeded the
permissible size by eight percent (8%).
The applicant was advised that as the sign size was smaller than originally discussed in
July, under the provision of the By-law, the Director of Planning Services has the
authority to make minor exceptions in situations of extenuating circumstances. These
exceptions as noted in paragraph 2.3 of this report shall only be for the size and height of
a sign and shall not exceed 10% of the permissible size or height as contained in the by- ;
law. Application for minor variance was required.
However, upon submitting the minor variance application, the drawings received did not
reflect the dimensions contained in the sign permit application but reflected the size .,
originally proposed in July. As the sign exceeded the ten percent (10%) exemption
allowable, the Director of Planning Services could not approve the variance.
3.3 It is the applicant's opinion that the larger sign is necessary for visibility from Highway 2. ••�
Staff notes that the travelled portion of the road is approximately 200 metres from the
sign location, but sight lines to the sign are unobstructed. The applicant advised that the
original idea had been to paint the stuccoed surface behind the sign in the yellow
associated with the franchise and then to mount the lettering only. Valiant Property �+
Management, the owner of the property, was not willing to permit the wall to be painted.
Staff note that this would not have affected the permitted sign area dimensions, as sign
area is measured by the smallest rectangle that can be drawn around the lettering,
numbering or symbols on the sign. The applicant also argued the sign under
consideration has received the approval of the property owner.
3.4 Staff does not support an increase in size to permit a 12.0 square metre wall sign in this
location for the following reasons:
• The variance requested is not minor and is not desirable for the area.
• The necessity for a larger sign has not been demonstrated.
• The sign is not desirable, consistent, or in keeping with other signs within the same
shopping plaza.

3.5 With respect to the issue of visibility, it is staff opinion the sign size permitted by the Sign
.. By-law is sufficient to properly identify the retail name. This is further demonstrated by
the signs adjacent to the Bulk Barn, as shown in Attachment 2, which comply with the
-- by-law. The applicant has the opportunity to approach the property owner to request the
inclusion of a Bulk Barn sign on the pylon sign located along the Highway 2 frontage.
4.0 CONCLUSIONS
.. 4.1 It is respectfully recommended that the requested Sign By-law minor variance to permit a
12.0 square metre wall sign be denied.

1.3 Rezoning: To rezone the subject lands from "Agricultural (A) Zone" to an
appropriate zone to permit the construction of a 1798 m2 place of
worship and manse.
1.4 Site Area: 2.78 ha
2.0 LOCATION
�. 2.1 The subject lands are located at 1862 Bloor Street (Attachment 1). The property
is contained within Part Lot 26, Concession 2, in the former Township of
Darlington.
3.0 BACKGROUND
3.1 On October 22, 2002, Ivan Dickinson of Dickinson Hicks Architects Inc., on
behalf of St. Anthony of Padua Parish, submitted an application to the
Municipality of Clarington to rezone the subject lot at 1862 Bloor Street to permit
the construction of a 1798 m2 place of worship and a manse.
3.2 The owner's intent is to construct a place of worship, containing the church, two
classrooms, chapel, offices and a related parking area. In future, a manse will
also be constructed.

3.3 A Public Meeting was held December 2, 2002 at which time an abutting property
aw owner raised concerns with development of a place of worship on this property.
Section 7 will discuss resolution of these concerns.

4.0 SITE CHARACTERISTICS AND SURROUNDING USES
4.1 The subject property contains an existing single detached dwelling and a
detached garage which will be removed if the application is approved by Council.
The property has frontage and access to Bloor Street currently. The proposed
place of worship will have access only from Hancock Road.
4.2 Surrounding Uses:
East: Rural residential
North: Rural residential
West: Rural residential
South: Rural residential
5.0 OFFICIAL PLAN POLICIES
5.1 The Durham Region Official Plan designates the subject lands "General
Agricultural Area". The proposed place of worship conforms with the policies of
the Regional Official Plan.
5.2 The Clarington Official Plan designates the subject lands "General Agricultural
Exception" and "Environmental Protection Area". Section 13.3.5 specifically

permits a place of worship at the northeast corner of Hancock Road and Bloor
Street. The proposed place of worship use conforms with the policies of the
Clarington Official Plan.
6.0 ZONING BY-LAW CONFORMITY
6.1 The subject lands are currently zoned "Agricultural (A)", which permits a variety Ono
of uses, including an existing place of worship. A new place of worship would not
be permitted, thus the need for the rezoning application.

7.0 PUBLIC SUBMISSION
7.1 Mr. John Waters, appeared at the public meeting (December 2, 2002) and
submitted a letter to the Municipality of Clarington detailing his concerns.
Planning Staff responded by letter to which Mr. Waters appears to be satisfied
that his concerns will be addressed through the site plan approval process. His
..
concerns included lighting, noise, possible school, size of manse, protection of
the environment and the location of future entrances.

8.0 AGENCY COMMENTS
8.1 The Clarington Building Division has indicated they have no objection to this
development proposal providing all site plan concerns are addressed through the

site plan approval process.

8.2 Clarington Emergency Services, Regional Police Services, Bell Canada, Ministry of
Transportation and Regional Planning have no concerns with the proposed place of
.p
worship at this location.
8.3 Regional Health Department has no objection to the proposed rezoning as their
concerns are being addressed through the site plan approval process.
8.4 Clarington Engineering Services, Regional Works and Central Lake Ontario have
no objection to the rezoning application and has given the applicant a number of
comments to address to meet prior to site plan approval.
8.5 The Ministry of Transportation (MTO) has no objection to this application.
However, MTO asked that the Clarington Planning Services Department ensure
that the applicant be made aware that the future Highway 407 East Clarington Link
is adjacent to the property. Also, as this highway has not yet received approval
under the Environmental Assessment Act, MTO cannot ensure the final location of
this highway will not affect the property through proximity or expropriation. Planning

Staff have advised the applicant of this concern, and St. Anthony's has determined
to continue with their plans at this site, at this time.
9.0 COMMENTS .�
9.1 The applicant is proposing to construct a 1987 m2 place of worship. The
drawings indicate it will be a single storey building containing the main church,
two smaller chapels, a gift shop, two classrooms, gathering room and associated
church offices. In the future, a manse (rectory) will also be constructed in a
separate building.
9.2 The applicant has also concurrently submitted an application for site plan
approval (SPA2002/047), indicating number and location of parking spaces,
landscaping, signage and entrance location.

9.3 The applicant has provided a detailed storm water management plan, prepared
by Marshall, Macklin and Monaghan, reviewing both storm water quality. Central
Lake Ontario Conservation, Clarington Planning Services and Engineering
.r
Services Departments have reviewed this report and are satisfied that storm
water has been adequately addressed and will be implemented through the site
plan approval process.
9.4 An Environmental Impact Study (EIS) is generally required for development
occurring within 50 metres of top of bank for cold water streams. An on-site
meeting in October with Central Lake Ontario Conservation, Clarington Planning
Services Department, Marshall, Macklin & Monaghan Consultants, a
representative of the church and the agent was conducted to assess visually the
Tooley Creek tributary. The tributary was dry and there is no discernible creek
bed or top-of-bank. The site plan for this property indicates that development will
generally occur on the western portion of the property, a minimum of 41 metres

from established tree line. Municipal and Conservation Authority staff are
aw satisfied that an EIS is not warranted in this instance.
g. 9.2 The Municipality shall require, through the site plan process, the dedication of the
tributary lands. As there is no discernible creek bank (or top of bank) the land

dedication shall include lands from the eastern property limits to 5 metres west of
the drip line of the established tree line. A survey of the proposed land

dedication has been submitted and reviewed to the satisfaction of both Central
Lake Ontario Conservation and Clarington Planning Services.
10.0 CONCLUSIONS
10.1 Based on the comments contained in this report, it is respectfully recommended
that the rezoning application be APPROVED.

1. Section 6.4.71 "SPECIAL EXCEPTION — AGRICULTURAL EXCEPTION (A-71)
ZONE" is hereby amended by adding thereto the following new Special
Exception 6.4.71 as follows:

"6.4.71 AGRICULTURAL EXCEPTION (A-71)ZONE
Notwithstanding Sections 6.1, those lands zoned "A-71" on the
attached Schedule to this By-law, may also be used for a place of
worship and a manse. For the purposes of this subsection a
manse shall mean a dwelling for a clergy person."
2. Schedule "1" to By-law 84-63 as amended, is hereby further amended by
.r changing the zone designation from:
"Agricultural (A) Zone" to "Agricultural Exception (A-71) Zone" as illustrated on
the attached Schedule"A" hereto.
3. Schedule"A"attached hereto shall form part of the By-law.
" 4. This By-law shall come into effect on the date of the passing hereof, subject to the
provisions of Section 34 of the Planning Act.

2.0 BACKGROUND
2.1 Draft Plan of Subdivision 18T-88037 was given final approval April 11, 1990.The
development of the lands has proceeded through a number of phased .�
registrations. The third phase was registered on December 19, 2002 under plan
40M-2133. This plan contains a total of 168 semi-detached dwelling units. The
application under consideration for the removal of Part Lot Control would only
apply to 80 of the 168 units. Within the limits of plan 40M-2133 only Madden
Place has been constructed by the Developer.

2.2 On January 27, 2003, Planning Staff received a request from John Perdue of
Legends Consulting for the removal of Part Lot Control in respect of Lots 1 to 31
and Blocks 70, 71 and 72 inclusive on 40M-2133. The removal of Part Lot

Control would permit the sale of each unit, following the construction of the linked
semi-detached dwellings.
3.0 STAFF COMMENTS

31. The removal of Part Lot Control facilities the creation of linked semi-detached
dwellings as contemplated in the draft approved plan of subdivision. The
Planning Act leaves it to the Municipality to determine an appropriate timeframe
during which the by-law shall apply. Staff recommends that the by-law be in
force for a three (3) year period following Council approval, ending February 24,
2006.
3.2 Attachment 3 is a Summary Table provided in accordance with the Region of „
Durham's requirements under the delegation of Part Lot Control. It details lots

4.0 RECOMMENDATIONS

1.0 BACKGROUND
1.1 The construction of the new Bowmanville Library and Municipal Administrative Centre
expansion has necessitated some changes which will better serve the disabled public
and the loading zone area for the new building.
2.0 COMMENTS
2.1 Disabled Parking
To provide improved disabled persons access to the New Bowmanville Library, two (2) -�
disabled parking spaces are being proposed directly in front of the Library main doors on
Church Street. This area has a depressed curb located between the two spaces to
provide easy access. The two disabled parking spaces which had been moved from
Church Street to the west side of Temperance Street during construction on a temporary
basis would now remain on Temperance Street due to public support. If approved, this
will provide a total of four (4) on-street disabled parking spaces near the Municipal
Administrative Centre and Bowmanville Library building.
2.2 Reserved On-street Parking
The Reserved on-street parking space designated for the Mayor of Clarington was
temporarily moved from Church Street to Temperance Street due to construction but
should now be relocated back to Church Street. The parking space on the west side of
Temperance Street, temporarily used by the Mayor, would now return to a metered
parking for use by the general public.
2.3 Loading Zone
The loading zone on Church Street would now be relocated to the west end of the
building for easy access to the new ground level delivery doors. This area also has a
depressed curb to permit easy access of dollies or carts between the delivery vehicles
and the building.

1.0 BACKGROUND •+
The Clarington Transit system began revenue service as of September 2, 2002. The
purpose of this report is to provide Council with an overview of the first four months of �+
operation, from September 2, 2002 to December 31, 2002, to give you a sense of how
the service is performing so far. The Director of Finance concurs with the financial
information provided within the report. From this time forward, Clarington Transit will
provide Council with regular updates as to how the system is performing.
10 INPUT FROM OTHER SOURCES
We have received monthly ridership data from the Oshawa Transit Commission.
10 ANALYSIS
In our report to Council (Report EGD-12-02) of March 4, 2002, we advised that to be
considered successful, a new transit operation should recover approximately 30% of the
operating expenses from ridership fares in the first year of operation. To get a sense of
how our transit system is performing we have analyzed the expenditures for the first four
months of operation, less one time initial start up costs, annual costs that should be pro-
rated by month and capital expenditures included in operating costs, and have
determined the monthly operating costs for the system. Based on these adjusted figures
we have concluded that the system is recovering approximately 34% of its operating

expenses, which is higher than our initial target of 30%, even within the first four months
of operation.

After a review of both the financial and ridership data for the Clarington Transit Service to
�- year end 2002, we are pleased with the progress that the system is making and with the
fact that transit revenues have gone beyond our targeted expectations. We believe,
based on the performance of the system to date, that our revenues and ridership
numbers will continue to steadily increase. In the coming months we will be working
with Oshawa Transit to develop a focused transit marketing plan designed specifically to
increase ridership. As our experience grows and with the support of the community we
believe that Clarington Transit will continue to improve and expand into the service we
envisioned it would be.

BACKGROUND AND COMMENT
For the information of Council, the table attached to Report CLD-08-03 summarizes the
activities and revenues pertaining to Animal Services for the month of January, 2003.
PROVISION OF ANIMAL SERVICES TO COBOURG, PORT HOPE, HAMILTON,
ALNWICK/HALDIMAND
The Clarington Animal Shelter was asked to assist Cobour Port Hoe Hamilton

Alnwick/Haldimand in providing animal services to them during the completion of the
construction of their new animal shelter.
Clarington Animal Shelter accepted their impounded dogs from December 24, 2002 until
January 31, 2003 for their new Shelter of Hope.
A total of 22 dogs were cared for by the Clarington Animal Services staff. Four of the dogs
were adopted to new homes from our shelter, with one refund because of illness. Thirteen
dogs were redeemed by their owners from our shelter and five dogs were returned to the new
Shelter of Hope on January 31 st
We also added the Shelter of Hopes dogs to our listing on our Petfinder website which has
resulted in 2 of the 5 dogs being adopted since their return to the Shelter of Hope.
The total income generated from impound fees and adoption fees from the dogs was $837.00.

BACKGROUND AND COMMENT:
The Municipality's solicitor, Dennis Hefferon, handles the current tax sale procedures, in
addition to all the complex legal issues that the Municipality of Clarington is faced with.
Due to the significant burden that all of the legislative changes have placed upon the
department, we have primarily focused on tax proceedings that were already underway. As
Council is aware, the billing processes itself is significantly cumbersome and dealing with
inquiries from taxpayers has consumed most of our resources over the past several years.
However, it has now become time to take more decisive action on those properties significantly
in arrears.
Since a large part of the tax sale registration process is routine, much of which is clerical in
nature and has multiple deadlines, it is suggested that it would be more efficient, from a timing
perspective and possible volumes involved, to utilize the services of Realtax Inc. (Tax
Registration and Tax Sale Specialists).
In November of 2002, the Tax Department, as part of our collection process, wrote a letter to
approximately 350 taxpayers who are eligible for Tax Sale proceedings. Their taxes are in
arrears three (3) or more years. They were requested to pay the balance in full, or submit
suitable payment arrangements to clear this balance.
This process was a huge success, but there is still a number of taxpayers who did not respond.
The next step s to register a lien on their property. If after one 1 year from registration the

taxes are still not paid, then the Municipality has two options, to sell the property by public
tender or by public auction. Often the actual commencement of the process will trigger action
by the taxpayer.
Realtax Inc. does almost all the work involved with tax registrations and tax sales, the research,
preparation and registration, from start to finish. This will save more than 90% of the time
involved with these procedures, giving us the freedom to work on other tasks.
The Municipality's advantage is that almost in every case, 100% of the cost is recovered. We
can charge back Realtax Inc.'s fees to the property's tax account.
The above recommendations have been discussed with Dennis Hefferon, who is in agreement
that the routine tax sale properties be referred to Realtax Inc.
