Mayor Mutton presented a certificate of participation to the Student
Pages', Christine Vajda and Sarah Lack.

Mayor Mutton read the contents of his letter to Chief Kevin McAlpine,
Durham Region Police Services, wherein he expressed his strong
objection to the cancellation of the Clarington Village Constable Program
effective January 6, 2003.

Councillor Trim advised that he attended the Regional Press Conference
pertaining to the "Warmth" Program which is in its fourth year. He and
Councillor Rowe also attended the official opening of the South wing of

Councillor Trim also attended the sod breaking for the expansion of
Bethesda House.
Councillor Rowe advised that this will be Jacquie Mcinnes's last meeting
as reporter for Metroland and suggested that Council send a thank you
letter for her five years spent covering the meetings of the Municipality.

Councillor MacArthur advised that he attended the Christmas open
house for the Clarke Museum which was extremely well attended.

Members of Council advised that the certificate of approval and site
maps are sometimes not received by the municipality and suggested that
improved communication and signage be reviewed. It was suggested
that a schedule of biosolids spreading program be forwarded to the
municipality and that a member of municipal Clarington staff be allowed
to sit on a Regional Biosolids Management Program Committee.
Mayor Mutton presented the Certified Municipal Manager III
Designation Certificate Pin to Marie Knight Stanley, Deputy Clerk,
awarded by the Ontario Municipal Management Institute and
congratulated her on this achievement.
Lou Ann Birkett and Steve Grigg - Presentation regarding the
Corporate Health and Safety Annual Report ADM-09-02. Lou Ann
Birkett highlighted the accomplishments of the Health and Safety
Committee during the year 2001/2002 and stated that regular attendance
of Department Heads on a rotating basis has been extremely successful
and mutually beneficial. This process will be continued in the years
2002/2003. She introduced the new co-chairs of the Health and Safety
Committee, Gord Weir and Rob Groen.

Frank Feldman, Kiradaar (Ont.) Inc., 7 Director Court, Unit 104,
Woodbridge, L4L 455 - Report PSD-129-02 appeared on behalf of
Kiradaar (Ont.) Inc., circulated a proposed residential draft plan and
expressed three major concerns:
1) the east and west side of his clients' property will be land locked
with no road frontage
2) the lotting set out in the report requires 15 metre frontages
instead of the current 12 metre minimum which adheres to the
current zoning.
3) the neighbourhood plan envisages a swap of land with the
neighbours and no discussions have taken place on how the
neighbour will react.
In his estimation the current configuration conforms to the Municipality's
Zoning by-law.

Belleville, K8N 3P8 - re: Report PSD-129-02 advised prior to the
meeting that they would not be in attendance.

Bryce Jordan, G M Sernas and Associates, 110 Scotia Court,
Unit 41, Whitby, L 1 N 8Y7 - re: Report PSD-129-02 appeared on behalf
of Foster Creek Developments and stated that his client understands and
wants to work with staff to meet the Municipality's requirements. The
major concern is with the location of the school and this is why he
request approval of the official plan. His concern is the requirement of a
7.5 metre requirement for a side yard which, in his view, is a little
excessive.
John Wells, Courtice Area Ratepayers Association, 15 Firwood
Avenue, Courtice, L 1 E 1 P6 regarding the development of the South
Courtice Industrial/Employment area circulated a document entitled
"Report to the Municipality of Clarington on the Courtice Area
Ratepayers Association presentation to the Durham Region Works
Committee of November 20,2003 pertaining to the development of the
South Courtice Industrial Area. He advised that the Courtice Area
Ratepayers Association (CARA) asked the Works committee to consider,
with the construction of the Courtice Sewage Plant, installing fibre optic
cables at the same time as the sewer pipes are installed. He noted that
this fibre could produce revenue for the Durham Region by leasing its
use to the telephone companies, like Bell, AT&T and Rogers. With the
location of Bell Canada and the Ontario Power Generation Fibre
back bone known, and the linking of the fibre in the Courtice industrial
area to it, it could provide broad band communications to the Iter site.
Also, by pulling fibre from Highway 2 at Simcoe Street in Oshawa
through the sewer up to the University of Ontario Institute of Technology
(OIT) it could then link OIT to Iter.

Dave Rickard, 80 Given Road, R.R. #8, Newcastle, L 1 B 1 L9
Report PSD-129-02 - appeared on behalf of the residents, circulated
a copy of his presentation and noted the following concerns:
1) There is not enough distance between the property lines and the
proposed residences;
2) There should be a common privacy fence installed to the maximum
allowable height along the rear of all properties; and
3) He and the neighbours object to the higher density designation of the
homes on King Avenue.

Pursuant to the Planning Act, the Council of the Municipality of
Clarington, through its General Purpose and Administration Committee,
is holding a Public Meeting for the following applications:

(a) St. Anthony of Padua Parish
Applicant: Dickinson & Hicks Architects Inc.

The Planning Services Department sent public notice for the rezoning, by
first class mail on or before November 1, 2002 to all property owners
within 120 metres of the subject property in accordance with the latest
municipal assessment record. A public notice was also posted on the
property in question. The notice procedure followed is in compliance
with the Ontario Regulations made under the Planning Act.

and effect of the application is to rezone the subject lot at 1862 Bloor
Street to permit the construction of a 1798 m2 place of worship and a

2.0 BACKGROUND
2.1 On November 29, 2002, the Planning Services Department received the last of
the revision documents required to circulate the revised proposed plan of
subdivision and related zoning by-law amendment application. The subdivision
application proposes to create 39 lots for single family detached dwellings, a
stormwater management block, a block reserved by the owner and local roads.
2.2 The area subject to the proposal is located in southeastern Newtonville, on the
proposed easterly extension of Jones Avenue and south of Payne Crescent. The
more formal location description is Part Lot 7, Concession 1, former Township of
Clarke.
3.0 LAND CHARACTERISTICS AND SURROUNDING USES
3.1 The site is currently vacant. The majority of the site is within the Lake Iroquois
Beach/Shoreline. A little over half the site (Block 41) is proposed to be reserved
by the owner as a nitrate dilution area for the 39 dwellings. The southeast corner
of the property contains a significant valleyland within which a tableland woodlot
covers most of the nitrate dilution area. The 39 proposed dwellings are proposed
on the northerly portion of the site.
3.2 The surrounding land uses are as follows:

PUBLIC NOTICE AND SUBMISSIONS
Public notice was given by mail to each landowner within 120 metres of the
subject property. Public notice signs were installed at the east end of the open
portion of Jones Avenue and on the south side of Payne's Crescent adjacent to
the unopened road allowance between Lots 6 and 7, Concession 1, former
Township of Clarke. A coloured subdivision plan was on each sign.
4.2 As a result of the public notification process, to date, the Planning Services

OFFICIAL PLAN CONFORMITY
The Durham Regional Official Plan designates the property Hamlet. In Policy
13.3.5, new municipal water service to a Hamlet is intended for only the hamlet
area delineated in the Area Municipal Official Plan. Municipal water service was
extended to Newtonville in 1989. The application subject to complying with the
relevant portions of Policy 13.3.9 would comply with the Regional Plan. Regional
staff will be providing comments on these matters.
5.2 Within the Clarington Official Plan, the southern portion of the property is

designated Environmental Protection, with the remainder being in the Hamlet
designation. A significant valleyland runs along the southern edge of the

property and a tableland woodlot is located on the north side of the valleylands.

8.1 This proposed subdivision is abutted on the west by draft approved plan of
subdivision 18T -87083. This plan was approved in 1992 and it has 28 single
detached units and a park that is bordered by the school, Newtonville Road,
Jones Avenue, and Street "A". This park, when built, will provide recreational
opportunities for the residents of both subdivisions.

to permit the permanent internment of human bodies cremated at this facility.

crematorium use in 2001 do not permit the permanent internment of human

OFFICIAL PLAN POLICIES
The Clarington Official Plan designates the property as "Green Space". The
establishment of a new cemetery requires an amendment to the Official Plan.
Section 32.5.4 in the Clarington Official Plan permits Council to pass a by-law to
recognize legal non-conforming uses or variations to similar uses, provided that
the following conditions are satisfied.

. It is not feasible to relocate the existing use.
. The use does not aggravate the situation created by the existence of the
use.
. The size in relation to the existing use is appropriate.
. The use is not a health hazard or a nuisance.
. The neighbouring uses are protected where necessary.
. The use does not adversely affect traffic, access or parking in the vicinity.

5.2 The application to permit a cemetery/columbarium conforms to the Official Plan
_ since it would qualify as a variation to an existing use under the conditions
identified in Section 23.5.4 in the following manner.

. The crematorium was approved to be located in proximity to the
Bowmanville Cemetery. As part of the arrangements with OIC, the
Municipality will have access to the Municipality's crematorium building for
office and storage of equipment related to the cemetery operation. The
crematorium building also contains a chapel. Since the proposed
columbarium is similar in nature to the existing and approved uses, it is an
appropriate location for this use.

building, the existing situation is not aggravated.

9.2 In light of the current application, public notice was circulated to all affected
properties. The public notice identified the requested zoning change to permit
the development of a columbarium. Following the circulation of the public notice
it was brought to Staffs attention that the Cemeteries Branch requires
confirmation that the Municipality's Zoning by-law includes the term "Cemetery"
as a permitted use. The current definition of cemetery in The Cemeteries Act,
means..... .." lands set aside to be used for the interment of human remains and
includes a mausoleum, columbarium and other structure.... ..".
9.3 In light of the Cemeteries Branch request and the definition contained within the
Cemetery Act, Staff has no objections to amending the rezoning application to
include a Cemetery as a permitted use within the current Agricultural Exception
(A-64) Zone.
9.4 The Ontario Planning Act stipulates where a change is made in a proposed by-
law after the holding of the public meeting, Council must be satisfied that an
-
additional public meeting is not required. In light of the comments contained
within this report, it is Staffs opinion a further public meeting is not warranted.
-
The recommendations contained within this report have been drafted to reflect
this position.
-
9.5 Notwithstanding the addition of a cemetery to the list of permitted uses, the agent

for the Ontario Independent Crematoriums Limited has indicated that his clients
do not propose to establish a Cemetery in the sense of setting land aside for the

burial of human remains. The purpose of permitting a "cemetery" is to satisfy the
requirements of the Cemeteries Branch for registration of the crematorium.

Site plan approval was issued for the crematorium. If the applicant wishes in the
future to establish a cemetery as defined in the Cemeteries Act, appropriate
applications. including an amendment to site plan approval would have to be
submitted for approval.

9.6 Staff have no objections to approval of the application as it is compatible with the
surrounding area, has no negative health or other physical impacts on
surrounding uses and can be accommodated within the existing building.

10. CONCLUSIONS
10.1 Given that no substantive issues have been raised to date, no objections have
been received from any departments or agencies, and provided that no resident
concerns are raised at the Public Meeting, it is respectfully requested that the
proposed rezoning application be APPROVED and the by-law passed as
contained in Attachment 2.

WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-Law 84-63, as amended, of the Corporation of the former Town of
Newcastle in accordance with application ZBA 2002-036 to permit the development of a
cemetery in the form of a columbarium;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:

Section 6.4.64 b) "Agricultural Exception (A-64) Zone" is hereby amended by
inserting the following new permitted use:
"ii) Cemetery"
2. This By-Law shall come into effect on the date of the passing hereof, subject to the
provisions of Section 34 of the Planning Act, R.S.O. 1990.

Application A2001/063 was previously tabled at the December 2001 meeting for up to
one year to allow the applicant time to resolve site plan issues. Although the applicant
has not yet submitted a site plan application, they have been working to resolve site plan
issues such as parking and driveway access and now feel they will be ready early in
2003 to apply for site plan approval. The application was tabled by Committee for up to
three (3) months.

Application A2002/068 was previously tabled to the December 5, 2002 agenda as the
measurements originally submitted on the application were incorrect. A site inspection
verified a deck and steps in the rear yard also required a minor variance. Staff and the
applicant verified the location of the property line and a new public notice was mailed, a
new sign posted and a new public hearing scheduled for December 5, 2002.

Application A2002/069 was amended at the Committee of Adjustment meeting
November 21,2002 to include a shed in the rear yard of the property that did not meet
the interior side yard setback requirements. The amended application was approved.

Staff has reviewed the Committee's decisions and is satisfied that the applications that
received approval are in conformity with the Official Plan policies, consistent with the
intent of the Zoning By-law and are minor in nature and desirable. Council's
concurrence with the Committee of Adjustment decisions is required in order to afford
staffs official status before the Ontario Municipal Board in the event of an appeal of any
decision of the Committee of Adjustment.

2.0 BACKGROUND
2.1 On December 5, 2002, Staff received a request from 1317870 Ontario Limited
(Mark Foley) for the removal of the "Holding (H)" provision from four residential
properties on Trulls Road in Courtice. Attachment 1 shows the location of the
lots currently zoned "Holding-Urban Residential Type One ((H) R1)".
2.2 The four lots were created from two existing residential lots through the
severance process by applications LD 300/2000, LD 301/2000 and LD 302/2000.
3.0 STAFF COMMENTS
3.1 The subject property is presently zoned "Holding-Urban Residential Type One
((H)R1)". The provisions of the Zoning By-law allow for the removal of the
"Holding (H)" symbol, by By-law, upon Council being satisfied that the uses to be
permitted will be adequately serviced, have appropriate access, and will be used
for the purposes intended by the By-law.
3.2 It is noted that pursuant to Section 36 of the Planning Act, a by-law amendment
to remove the "Holding (H)" symbol is not subject to the normal appeal period
afforded to a standard rezoning application, and accordingly, shall be deemed
final and binding should Council grant approval of same.

1.3 Official Plan Amendment:
To remove the Community Park designation from the northeast corner of
Liberty Street and Concession Road 3 and replace it with an Urban
Residential designation with a Medium Density symbol. The application
also proposes to expand the Northglen Neighbourhood Planning Unit
across Liberty Street to include these lands in the urban development limit
to the year 2016, to increase the population target for the Northglen
Neighbourhood from 3750 persons to 4200 persons, to amend Table 9-2
to allocate 1075 low density units and 195 medium density units for the
Northglen Neighbourhood and to change all corresponding totals.
1.4 Site Area: 9.064 Hectares (23.7 acres)
2.0 LOCA liON
2.1 The area subject to the application is located at the northeast corner of Liberty Street
and Concession Road 3, Bowmanville (see Attachment 1).
3.0 BACKGROUND
3.1 On October 29, 2001 an application to amend the Clarington Official Plan was
submitted by G.M. Sernas and Associates on behalf of Anglo York Industries. No
supporting documentation was submitted with the application at that time and staff
deemed the application incomplete. It was circulated on December 13, 2001 when the
applicant submitted an Environmental Impact Study prepared in 1993.
An application for a Plan of Subdivision was not submitted, however the applicant
provided a conceptual plan showing the development potential for the lands. It included
60 single detached, 40 semi-detached/links and 47 townhouses, for a total of 147 units.

3.2 On January 21, 2002 a Public Meeting was held under Section 17 of the Planning Act.
Area residents expressed concerns with the loss of future parkland and development of
environmentally protected lands.

3.3 In Staff's review of the application, it was noted that both the Regional and Clarington
Official Plans provide for additional residential lands to be designated only in the context
of a comprehensive review of the local Official Plan. In addition, the designation of
additional lands would need to be based on an analysis, which evaluates and
demonstrates the need for designating additional lands. In addition, a sub-watershed
study would be required as well as an updated EIS and a neighbourhood development
plan. None of the above-noted material has been submitted to support the application.

4.0 COMMENTS
4.1 The lands have been sold to Queensgate Homes Inc. On December 12, 2002 Staff met
with the proponent of Queensgate Homes and their solicitor to discuss the studies
required to evaluate development of these lands and the timing for development.
Opportunities to relocate the Community Park on other portions of the property was also
discussed. The meeting was exploratory in nature and Queensgate Homes do not have
any development concepts in mind at this time. They have agreed to closing this
Official Plan Amendment Application.

committee with an annual update on information regarding site plan applications
that have been submitted for approval.

1.2 The Site Plan Control By-law requires that plans and drawings for any building or
structure be approved by the Municipality prior to issuance of a building permit
except for those exceptions stated in By-law 90-130. By-law 90-130 delegates
the approval authority of site plan applications to both the Director of Planning
Services and the Director of Engineering Services.

1.3 Except for additions or minor expansions, a site plan agreement is generally
required for a proposed development to ensure a comprehensive design review
of the location of all buildings and structures, landscaping, access permits,
parking areas, signage and grading etc., by all regulatory authorities. In addition,
it is through the site plan approval process that the Municipality collects its cash-
in-lieu of parkland dedications, road widenings, performance guarantees, etc.
Each agreement is registered on title and is enforceable against present and
future owners.

2.6 There are 51 files open at year end 2002. Some have been recently received
and are in circulation for comments from other departments and external
agencies. Others have been open for longer periods. These tend to be more
complex applications, often requiring more time for identifying issues and for
resolving concerns. In most cases, applications that have been open for several
months require the submission of additional information or revised drawings.

2,7 In 2002, four site plan applications were appealed to the Ontario Municipal Board
(OMB). All of these applications are located along Highway 2 or King Street, with
two in Courtice and two in Bowmanville. One is for an office use within the area
of the proposed Courtice Highway 2 Corridor Secondary Plan. The other three
are for drive-through restaurants, where the applicants and Municipality are in
disagreement over traffic impacts and appropriate measures to address traffic

There are six open applications for telecommunications towers. Recent policy
approved by Council for New Telecommunications Antenna and Towers calls for .-

Two applications have stalled because of Regional requirements for road
widenings. One of these applications is on Highway, east of Bowmanville, where
the road widening would require the demolition of an existing dwelling on the
property. The other is on Taunton Road and the conveyance of property would
reduce the parking available for a restaurant use.

Site plan files awaiting information are monitored regularly by the assigned
planner and a letter is sent informing the applicant of the status of the file. Staff
continue to make a concerted effort to clear the number of older files by resolving
issues or by closing files due to inactivity.

1.0 BACKGROUND
1.1 The purpose of this report is to provide Committee with a status report on
apartment-in-house applications that have been submitted for approval and
registration. Information reports are provided on an annual basis.

1.2 Provincial legislation provided in the Municipal Act gives municipalities the ability
to require registration of dwellings having an apartment-in-house.

In 1997, Council passed a by-law amending Zoning By-law 84-63 to permit
apartments-in-houses. By-law 97-76 permitted apartments in single detached
and semi-detached dwellings in "Urban Residential Type One (R1) Zones",
"Urban Residential Type Two (R2) Zones" and "Urban Residential Type Three
(R3) Zones", including exception zones, except Orono, provided that the
apartment can meet the requirements of the Ontario Fire Code or the Ontario
Building Code. Owners also must meet the Zoning By-law requirements,
including the provision of a parking space for the apartment unit.

Another by-law (By-law 97-77) required mandatory registration of all apartments-
in-houses to ensure that these requirements could be met. A non-refundable
application fee of $50 is paid upon submission of an application for registration,
and a non-refundable fee of $50 is paid upon issuance of the Certificate of
Registration for the apartment-in-house.

1.3 Owners of existing apartments in zones that did not permit apartments-in-houses
were given an amnesty period from the date of passing of By-law 97-77 (April 28,
1997) until June 30, 1998. A new homeowner of a dwelling with an existing
apartment-in-house (existing means in existence prior to April 28, 1997) has up
to one year from the time of possession to apply for registration, regardless of
zoning. Any owner who is building a new apartment-in-house or who cannot
prove one has been legally in existence prior to April 28, 1997 is required to meet

Initially, as a result of this amnesty and the public notice given, there were
numerous applications. In recent years, applications have fallen off to

2.0 APARTMENT-IN-HOUSE ACTIVITY
2.1 Attachment 1 details apartment-in-house activity since 1997. Since 1997, 125
applications for apartments have been received. Eighty-six (or 69%) have been
registered to date. An additional 6 units have received approval. Staff are
awaiting submission of the $50 registration fee prior to issuing the Certificate of
Registration. Fourteen have been closed or withdrawn. A total of 19 applications
have issues that remain outstanding.

2.4 Municipal Staff continue to work on applications with issues outstanding. The
majority of these applications are awaiting completion of upgrades required

It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:

1. THAT Report PSD-010-03 be received;

THAT as the Local Architectural Conservation Advisory Committee has no objection to
the replacement of the original six-over-six sash windows in the east and west elevations
with reproduction six-over-six sash windows, the application from Carolyn Wilson for
alteration of 182 Church Street, Bowmanville, be APPROVED, in accordance with
Section 33 (4) of the Ontario Heritage Act, R.S.O. 1990; and

3.
THAT Carolyn Wilson, the Local Architectural Conservation Advisory Committee, and
the Ontario Heritage Foundation be advised of Council's decision.

1.0 BACKGROUND
1.1 On November 15, 2002, the Planning Services Department received a request
from Carolyn Wilson, the owner of 182 Church Street, Bowmanville (Attachment
1) for permission to remove all original six-over-six sash windows from the
designated heritage building (Attachment 2). This property was designated in
1997 under By-law 97 -16 (Attachment 3).
1.2 The request was forwarded on to the Local Architectural Conservation Advisory
Committee (LACAC) for consideration at their November 19th meeting. Upon
review of the application the LACAC passed the following motion:

"That the Chair or LACAC liaison will contact the home owners, thank
them for their letter and discuss heritage renovations that might solve their
concern. If they still want to remove the windows, LACAC will arrange to ..
have the designation by-law changed about the six-over-six sash
windows."
1.3 At the request of the Chair, the LACAC Liaison contacted the owner to discuss
the possibility of restoring the existing windows instead of replacing them. The
owner subsequently agreed to retain the original windows and second story door
in the front fa<;ade and replace the windows in the east and west elevations only.
Ms. Wilson revised her alteration proposal in a letter dated November 25th, 2002
(Attachment 4). The revision was forwarded to Council and the LACAC.
2.0 COMMENTS
2.1 Section 33 (1) of the Ontario Heritage Act states that no owner of a property
designated under Par IV of the Act shall alter the property or permit the alteration
of the property where the alteration is likely to affect the reason for the
designation unless the owner applies to Council and receives consent in writing.
On December 9th Ms. Wilson's application for alteration was reviewed by Council.
Council referred the correspondence to the Director of Planning Services and the
LACAC.

2.2 The Act states that Council is to notify the owner that the application has been
received. Notification dated December 11th was forwarded to Ms. Wilson.
Council is to consult with the LACAC and make a decision within 90 days of
notifying the owner. If Council consents to the application upon certain terms
and conditions, or refuses the application, the owner may apply to Council for a
hearing before the conservation Review Board.
2.3 The LACAC and Planning Services staff are both sympathetic to the additional
expenses incurred by property owners in restoring and maintaining a heritage
structure. It is to this effect that the LACAC approved the motion to support the
removal of the original windows if the owner perceived this as the only viable
option.
2.4 Ms. Wilson's original proposal to remove all original windows would have
necessitated a heritage by-law amendment as the six-over-six sash windows are
listed as one of the designated exterior architectural features. It will no longer be
necessary to amend by-law 97-16 as the original six-over-six sash windows will
remain in the front fac;ade. Replacement of the east and west windows in this
building will not have a serious detrimental affect on the reasons for designation.
Although the east and west elevations can be seen from the street, it is the front
fac;ade which is the most significant.
3.0 CONCLUSION
3.1 Staff recommend that the application for alteration from Ms. Wilson, dated
-
November 25, 2002, to replace the six-over-six sash windows in the east and
west elevation with six-over-six reproduction windows, be approved.

In an effort to reduce energy costs we would like to upgrade the windows in our
"new" home. We plan to remove the brown aluminum storm windows and replace the
original Six over Six windows with new ivory vinyl Six over Six double hung windows.
The inside window casings and trim would not be affected or damaged in any way. We
hope to replace the east and west upstairs windows this year and continue with the main
floor winqows in the near future. We believe this change will greatly improve the
overall "look" of our home and by removing the brown aluminum storms will restore the
windows to a.mor~ natural 1860's look.

WHEREAS the Ontario Heritage Act, R.S.O. 1990, C.0.18 authorizes the council of the
municipality to enact by-laws to designate properties to be of historic or architectural
value or interest for the purposes of the Act; and

caused to be served upon the owner of the property known for municipal purposes
as 182 Church Street, former Town of Bowmanville and upon the Ontario Heritage

newspaper having general circulation in the area of the designation on December 4,

Ontario Heritage Act are contained in Schedule "A" attached to and forming part of

This letter is further to my letter of November 15th, 2002 advising
LACAC of our desire to replace the windows in our home at 182 Church
Street, Bowmanville.

We plan on living in this lovely old home for the next 10 to 20 years.
In order to do this our monthly energy expenditures will have to be greatly
reduced and maintenance will have to be streamlined. We have gone over the
pros and cons of replacement windows many times and feel they are
necessary for reducing our monthly costs.

Repairing the existing windows and having wooden storms and
separate wooden screens made would entail:

- Cost, possibly less up front but over time would prove to be
more costly
- Yearly putty and painting would be necessary
- Hiring someone twice a year to put them on and take them off
because of the height of the upper windows and the size of the
main floor windows. Safe storage in this case wouldHbe a,. f',L..', U,)

- Even if we don't seasonally remove them they wQuldstill have. ..

We will gladly work with someone to restore, repair and make a period
style storm "DOOR" for the upper front South facing window/door. And, if
necessary, also leave the 2 main floor front windows (South facing) as they
are and at some time in the future have them restored with period style
wooden storms.
Our main concern as winter approaches is the upper East and West
facing windows. They are in bad repair and very fragile, possibly due to the
constant condensation between the original windows and the aluminum
storms. We can't seem to get the temperature upstairs above 62 degrees F.
The replacement windows we would like to use are reproduction 6 over 6 and
I would have them made in IVORY so they won't stand out like white ones
would. Also, I would go with only bottom half screens which is more in line
with older windows.

1.0 BACKGROUND
1.1 On December 9, 2002, Council considered Staff Report PSD-128-02. The report
forwarded Terms of Reference for a Clarington Highway 407 Community Advisory
Committee (CAe), and also recommended that the Minister of Transportation be
requested to provide funding to enable Clarington to retain a consultant.
1.2 Ms. Linda Gasser addressed Council in respect of the report. She recommended a
number of changes to the Terms of Reference for the CAC, and also requested that
Council engage a consultant to review the Needs Planning Studies and the draft Terms
of Reference. She also requested Council to identify a source of funds for the
consultant immediately.
1.3 Council resolved to direct the Clerk to advertise for the positions on the CAC, and to
request the Minister to provide funding for a consultant and add a third member from
Clarington to the Ministry's CAC. Council also resolved to refer the recommendations
related to the Terms of Reference for the CAC back to staff for a further report to
address the issues raised by Ms. Gasser.
2.0 MTO'S COMMUNITY ADVISORY COMMITTEE
2.1 Doug Allingham, of Totten Sims Hubicki, advised staff that the Ministry of Transportation
is open to having additional Clarington residents on the Ministry's Community Advisory
Committee. They requested a member that could provide an environmental perspective
on the project. The Director of Planning Services provided 6 possible candidates for the
Ministry to consider. In addition, the Ministry has requested that a member of the
Clarington Agricultural Advisory Committee sit on their Community Advisory Committee.

3.0 CLARINGTON COMMUNITY ADVISORY COMMITTEE

Ms. Gasser made five recommendations with respect to the Terms of Reference for the
Community Advisory Committee. These are addressed individually below.

a)
Ms. Gasser suggested that the CAC membership be increased to 15 community
members plus Council and staff liaison members.
-
This recommendation, if approved, would increase the total size of the CAC to 18
members. A committee this size would be difficult to administer and would
increase the demand on Staff resources. The Agricultural Advisory Committee
has a total of 13 members,. while both the Municipal Heritage Committee
(formerly LACAC) and the Port Granby Project CAC have a total of 10 members
each.

Recommendation: Staff suggest that the CAC membership remain at a total of
approximately 13 members, including staff and Council representatives. This
will provide for sufficiently broad-based representation from the community and
the maintenance of a large core group. However, Council could review the
Committee size again and make any additions when applications are received
and specific appointments are made.

Ms. Gasser suggested that a Conflict of Interest clause be inserted in the Terms
of Reference that would allow members that are potentially affected to participate
in general discussions, but exclude them from voting on specific issues affecting
them

Staff agree with this suggestion and have included appropriate wording in the
Terms of Reference.
Recommendation: That the Terms of Reference be modified to add the
following paragraph under Meetings:
All members of the Committee will be eligible to participate in
discussions related to the project. However, any member
who would be directly affected by a specific issue related to
the project shall refrain from voting on a motion directly
related to that issue. Individual members of the Committee
shall be responsible for determining whether they have a
conflict of interest with respect to any issue.

Ms. Gasser suggested that a clause be inserted in the Terms of Reference to
indicate that any member that misses three consecutive meetings without valid
reasons be replaced.
Staff note that is a standard clause in the Terms of Reference for Council
committees. The matter of absences is already addressed in the Terms of
Reference in the last paragraph under Membership.
Recommendation: That the current absence provision in the Terms of
Reference not be modified.
d)
Ms. Gasser suggested that each organization/group be limited to one member on
the CAC.
Ms. Gasser's concern was focused on the previous Terms of Reference which
provided for the Clarington Board of Trade to appoint two members. Here
position was that no one group should have more than one member. However, if
Council were to directly appoint a BIA member, it would have to choose one of
the three BIA's to appoint a member or have all BIA's and the Courtice Business
Association appoint a member. The latter would result in over representation of
one group. The Board of Trade represents both commercial and industrial
businesses, and each would provide a valuable perspective to the Committee.
Recommendation: That the Board of Trade representation on the CAC be
maintained at two members, and that the Board be requested to appoint one
member who is also a member of a BIA and one industry representative.
e) Ms. Gasser suggested that the Municipality consider hiring an independent
facilitator rather than having the Advisory Committee elect a chair from within.

Staff believe that the process would be greatly enhanced with the use of a
professional facilitator. However, given the costs involved with retaining a
facilitator for the Advisory Committee, Staff cannot support this suggestion.

4.0 TRANSPORTATION CONSULTANT

4.1 Ms. Gasser indicated that Council should engage a transportation consultant
immediately in order to review the Needs and Justification report and the Draft EA
Terms of Reference. There are no funds budgeted for this purpose and Council should
provide direction to staff on this issue, in light of the other priorities for the 2003 budget
year.

TERMS OF REFERENCE
CLARINGTON HIGHWAY 407 COMMUNITY ADVISORY COMMITTEE
Backaround
The Ontario Ministry of Transportation has initiated the Environmental Assessment study
for the Highway 407 East Completion. The highway extension is proposed to start at the
current terminus at Brock Road in Pickering and run eastward to connect with Highway
35/115 in Clarington. The section of Highway 407 through Clarington will be
approximately 25 kms. As well, a 10 km north-south highway to connect Highway 407
with Highway 401 is also proposed in the vicinity of Solina Road.
Due to the scale of the project through Clarington, the Highway 407 extension has the
potential to significantly affect the entire community. In order to facilitate public input on
the project, Clarington Council is establishing a Community Advisory Committee for the
Highway 407 East Extension.

Mandate

Scope of Activities
The Community Advisory Committee, in fulfilling its mandate, is to provide advice to
Council and communicate information back to their respective stakeholder groups, where
appropriate. The Committee will review information associated with the proposed
highway and provide strategic advice to Council on these matters.
While individual members of the CAC may represent various interest groups, the opinions
and positions taken by the members and the CAC are not binding, in whole or in part, on
either Clarington Council or the groups they represent.

Membership
The Community Advisory is a volunteer Committee consisting of approximately 10
citizen members. Council shall seek to appoint members representing a variety of
interests from across the Municipality, including, but not limited to:
· residents within the study area
· agriculture
· industry and business
· social/cultural environment
· natural environment.
Members may represent a specific committee or group. In particular, the following
groups will be invited to nominate members to sit on the CAC:
· Clarington Board of Trade - one member from a local BIA and one
industry representative
· Clarington Agricultural Advisory Committee - 1 member
· LACAC - 1 member.
One member of Council shall also be appointed to sit on the Committee. Staff
representatives from both the Planning Services Department and the Engineering
Services Department shall sit on the Committee as non-voting members. In addition, the
Committee may recommend to Council that Durham Region staff, Conservation Authority
staff and staff of other municipalities be invited to attend as non-voting members.
Members appointed to sit on the Committee must be willing to commit the time required to
understand and evaluate the information provided, as well as be open-minded to various
opinions and perspectives on the Project.
Openings for membership shall be publicly advertised and all residents of the Municipality
are eligible to apply. Applicants will submit applications to the Municipality of Clarington
Clerk's Department. Members will be formally appointed by Council.
The Council representative shall sit as the interim chair. The Committee will select a
Chair and Vice-Chair from among its membership. The chair shall provide leadership to
the Committee, ensure that the Committee carries out its mandate, and act as the primary
liaison between the Committee and Staff.

If an individual member is unable to attend a meeting, he/she may request permission
from the Chair to send an alternate, at least 24 hours in advance of the meeting. The
Chair shall advise the Clerk of any member who is absent for three consecutive meetings,
and may request that the member be removed from the Committee. The Chair shall also
advise the Clerk of the resignation of any member. Council shall appoint new members
to the Committee to fill any vacancies as required.
Technical Support
Municipal staff will provide clerical, administrative and technical assistance to the
Committee. Staff and consultants, including consultants hired by the Ministry of
Transportation, will share technical information and assist in the interpretation of this
material.
Meetings
Committee meetings shall be held in the Municipal Administrative Centre. The
Committee shall generally meet a minimum of once per month; however, the chair may
schedule additional meetings or cancel meetings after consulting with the other members
of the Committee. The Chair shall set the agenda for each meeting in consultation with
Municipal Staff.
A majority of voting members (6) shall constitute a quorum. Recommendations and
decisions reached by the CAC will be based on consensus, wherever possible. In the
event that a consensus cannot be reached and there are divergent opinions on issues,
formal votes may be called by the Chair, with each member having one vote. Decisions
will be carried by a majority of the members present.
All members of the Committee will be eligible to participate in discussions related
to the project. However, any member who would be d,rectly affected by a specific
issue related to the project shall refrain from voting on a motion directly related to
that issue.. Individual members of the Committee shall be responsible for

Reporting to Council
The Community Advisory group shall report to Council as follows:
. The recording secretary shall submit the minutes of all Committee meetings
to the Municipal Clerk for inclusion in the Council agenda for information;
. All recommendations from the Committee shall be submitted to the Clerk for
inclusion in the Council agenda for direction;
. The Committee Chair will submit reports to Council prior to key decisions
being made by Council on the proposed highway.

Term of the Committee
The term of the Committee shall coincide with the term of Council. The Committee will
- disband upon completion of the Environmental Assessment for the Highway 407 East
Completion or at such other time as Council may determine.

Community Advisory Committee
Given the scale of the 407 project, its long history and the large number of
potential impacts, it is highly likely that anyone attracted to the CAC will have an
opinion on 407. You need people on that collllllittee with opinions and the hope is
that when having access to the facts, members' opinions will become more focused
and refined.

While it is sometimes difficult to distinguish between someone having an
"opinion" and someone having an "agenda", I think that membership from as
broad a cross-section of community interests as possible should be encouraged. A
conflict of interest clause would allow for potentially impacted committee
members to participate in the general discussions around an issue, but refrain from
voting on any particular aspect of the matter involving them.

I believe you should increase the number of members to around fifteen from the
currently proposed ten. This will still be a smaller than the CAC struck to advise
MTO, which will likely have 17 to ] 8 members. If you start with a larger
committee, not only do you capture more diverse community views, you have a
better chance of getting a large enough core group that can be maintained
throughout the life of the committee. Council has to be prepared for some attrition.
It will be difficult to appoint member replacements due to the type of process - i.e.
large volumes of complex technical information need to be absorbed within a short
time due to the time lines of the EA process.

appointed at large, consideration will have to be given as to whether or not it
would make sense to appoint a new person at that stage of the process.
The Terms of Reference suggest that two members of the Clarington Board of
Trade be invited to sit on the CAC. I think that when more than one representative
of any particular organization is appointe<L the dynamics of the committee are
altered because that organization has a greater opportunity to dominate the
discussion and shape the recommendations of the committee. I suggest that no
organization should have more than one representative on the committee.
My suggestion is that one Clarington Board of Trade member be invited and that
one member of one of the BIAs or any other business organization be invited to sit
on the CAC~ This still gives the business community the same amount of
representation in total, but allows for two different business views to be brought to
the committee - e.g. urban and rural business perspectives, small and larger etc.
An independent facilitator, rather than a chair, is worthy of Council consideration
in that unlike a chair that is elected by committee members, who participates in
discussion and votes on issues, a facilitator is independent of the committee and
removed from membership duties. He/she can really concentrate on the process
issues to ensure that the committee fulfils its mandate. lbis is the process used by
the MTO CAC. There is a cost attached to this option but it may well be worth it
in the long run.
Recommendations:
I.
Increase CAC membership to 15 community members plus Council
and staff liaison members
Insert a Conflict of Interest clause
Insert clause that missing three consecutive meetings without valid
reason results in member being replaced.

Transportation Consultant

It is of the utmost importance that as a minimum, a transportation consultant
should review the Needs Planning Report as well as the draft Terms of Reference.
It is at the Needs stage that issues must be identified, queried and addressed, with
issues emanating from the Needs document incorporated into any municipal
position and comments to the draft Terms of Reference.

From what] understand, we may not be getting one neat and tidy Needs Planning
Report. Rather, previous studies will be updated where MTO felt that was
required. ]t may be that a lot of previously released material will need to be
evaluated in addition to the Needs Planning Report and there will be very little
time to do it in. A consultant with transportation expertise can assist staff in
interpreting the huge volumes of information and assist them and Council in
crafting a coherent response reflecting what will likely be a number of municipal
concerns.

Once the Minister of Environment approves the Terms of Reference, the
transportation consultant may be required only occasionally until the final,EA
report is produced. At that stage, prior to the final EA report being submitted for
approval to the Minister of Environmen~ municipal comments should be provided
to identify any concerns with that document and how it expresses what was
identified in the Terms of Reference.

I cannot tlunk of a project that has the potential to impact Clarington more than
Highway 407 does. A5 your planning staff have advised you, waiting for the
annual budget process will be too late to deal with the most important phases of the
EA process, the phases at which a municipal response can have the most impact.
A consultant can help you flag fiscal impacts in addition to other impacts so the
payback in that area alone can be huge and prepare you for future budget
processes.

Notwithstanding that there seems to be no provincial process for intervener
funding, as per my communication with MTO today, it is imperative that Council
take all possible steps to inform themselves of potential impacts to Clarington and
identify options for addressing these.

BACKGROUND AND COMMENT
1. BACKGROUND
1.1 Our report covers the month of November, 2002. It is our intent to provide
Committee with information relevant to this department, in a timely manner.
2. REPORT
2.1 The department responded to 218 calls in November and recorded total fire loss at
$29,200.00. A breakdown of calls responded to follows in the table attached.

As indicated in the table attached, Station 1 volunteer firefighters were activated ten
times for standby, nine calls were as a result of Pumper 1 and Pumper 4 being tied up at
emergency calls, and one for the Santa Claus parade. Station 4 volunteer firefighters were
activated four times for standby, three were as a result of Pumper 1 and Pumper 4 being
tied up at emergency calls, one for the Santa Claus parade..

Recommendations:
It is respectfully recommended to the General Purpose and Administration Committee
the following:
1. THAT Report COD-001-03 be received;
2. THAT Martindale Planning Services, Ajax, Ontario with a total revised bid in the
amount of $34,440.00, (plus G.S.T.) being the most responsive bidder in
accordance with all terms and conditions of RFP2002-15 be awarded the
contract for consulting services of Phase I of the Bowmanville Heritage
Conservation District Study and Plan, as required by the Planning Department;
3. THAT pending Council approval to proceed with Phase II, that the subject firm be
authorized to provide consultation services for Phase II in the amount of
$23,390.00, plus G.S.T.;
4. THAT funds in the amount of $15,000.00 be drawn from account # 7708-X-0247
LACAC consulting;
5. THAT the remaining funds in the amount of $21 ,848.00 ($34,440 total bid, plus
G.S.T., less $15,000.00 LACAC Consulting) be drawn from account # 7702-X-
0247 Planning Consulting; and,
6. THAT the attached By-law, marked Schedule "A" authorizing the Mayor and
Clerk to execute the agreement be approved;

A Request for Proposal was issued with five (5) firms being invited to submit on providing
Consulting Services for the Bowmanville Heritage Conservation District Study.
Subsequently, two (2) proposals were submitted and tabulated as per Schedule "B" attached.
A response was received from a third firm indicating their existing work load was too large to
take on this project.
Following the completion of the Heritage Conservation District Background Study (Phase One)
which shall include the presentation of the District Study at a public meeting, the District
Steering committee in evaluating the feedback and comments from the Public, shall make a
Proposals were evaluated based on the following:
. Previous Heritage Conservation District Background Study Plan, and OMB approval
experience
. Consultants ability and capacity to perform the work
. Time line suitability
. Approach to methodology of Project
. Key personnel
. Ability to communicate
. Overall impression
. Reference interviews
. Proposed fees and hourly rates
. Working knowledge in Clarington and Region of Durham
. Financial status
Based on the above evaluation, the two firms were interviewed by the selection committee.

The selection committee consisted of the following staff:

. Lou Ann Birkett, C.P.P., A.M.C.T., Purchasing Manager
. Bill Humber, Old Bowmanville Neighbourhood Association
Of the two firms selected for an interview, the firm of Martindale Planning Services, Ajax best
meets the criteria established in the Request for Proposal document and consequently scored
the highest in the evaluation process.
Upon review of the Total bid price submitted by Martindale Planning Services it was revealed
that they had included some additional works that were not required. In accordance with the
Request for Proposal, their bid was amended to $34,440.00 to delete the unnecessary work.
Pending Council approval to proceed with Phase II it is further recommended that the subject
firm be authorized to provide consulting services for Phase II in th~ amount of $23,390.00, plus
G.S.T.
After further review and analysis of the submissions, the firm Martindale Planning Services, Ajax
are recommended for this project. Although the subject firm has no direct experience with the
Municipality of Clarington, they have provided satisfactory service to the Town of Whitby and
City of Oshawa. The sub consultants proposed have previously provided satisfactory service to
the Municipality of Clarington.
It is recommended that the funds required be provided from the 2002 Budget as follows:

Being a By-law to authorize a contract between the
Corporation of the Municipality of Clarington and Martindale
Planning Services, Ajax, Ontario, to enter into an agreement
for consulting services for Phase I of the Bowmanville Heritage
Conservation District Study and Plan.
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS
FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the
Corporation of the Municipality of Clarington and seal with the Corporation Seal, a

BACKGROUND
Pursuant to Sections 441, 442 and 443, Chapter M.45 of the Municipal Act R.S.O. 1990,
a list of applications for cancellation, reduction or refund of taxes is presented to
Committee for its review and approval.
Section 442(12) indicates that the Council shall hear and dispose of every application
not later than the 30th day of April in the year following the year in respect of which the
application is made. The last day for making application for the previous year's tax
reduction is the 28th day of February in the following year.
More specifically, under Section 441, the Treasurer shall recommend to Council that
outstanding taxes be stricken from the roll. To strike taxes from the roll it must be by
reason of a decision under Section 442 or 443, or of a decision of a judge of any court
or that the taxes are uncollectible.
An application for a cancellation, reduction or refund may be made for one of the
following reasons:
· Ceased to be liable to be taxed at rate it was;
. real property becomes exempt;
· razed by fire, demolition or otherwise;
· damaged by fire, demolition or otherwise (substantially unusable)
. removal of a mobile unit;
· sickness or extreme poverty;
· gross or manifest clerical error; and
· repairs/renovations preventing normal use of period of 3 months.
The 442 and the 443 process begins when an application is prepared by either the
Regional Assessment Office or the Tax Department. The neighbourhood assessor will
perform an on-site inspection of the property. The assessor will verify the reason for the
application, the period of time, for which the tax relief is claimed, and the amount and
type of assessment that is affected. The application is then sent back to the Tax
Department where the actual tax adjustment is calculated and the taxpayer's account
adjusted.
The total amount of taxes to be written off, for May to December 2002, as shown in this
report total $16,320.86. The total from January to December 15, 2002 is $22,841.53.
This total represents the Municipality's share only. For comparison the values of taxes
written off under Section 442 and 443 at December 31,2001 was $20,996.72 for the
municipal portion only.

Also reflected in the Municipality's write-off account, but not included in this report are
reductions due to Assessment Review Board, Ontario Municipal Board and Court
Decisions. These write-offs, because they are by court decision, are irreversible and
final, and are therefore written off directly to the account and are not required to form
part of this report. This includes minutes of settlement for assessment appeals. This
also includes the Municipality's share of post-cut-off capping adjustments.
This report covers May to December 2002. A final report will be provided at year end
with comparative values from prior years.
