THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NO.: 2008-151
being a by-law to authorize the execution of Minutes of Settlement
between the Municipality of Clarington, and Chigweyaru Agbaru
and Thomas Damon Cauchon of claims arising out of the
expropriation of 50 East Beach Road, Bowmanville
WHEREAS Council has received and approved the report PSD-084-08 of the Director of
Planning Services recommending the settlement of claims made by Chigweyaru Agbaru and
Thomas Damon Cauchon arising out of the expropriation of 50 East Beach Road,
Bowmanville;
NOW THEREFORE the Council of The Corporation of the Municipality of Clarington hereby
enacts as follows:
1. THAT the Mayor and Municipal Clerk, on behalf of the Corporation of the Municipality of
Clarington are hereby authorized to execute Minutes of Settlement in the form
contained in Attachment 1 to Report #PSD-084-08 with Chigweyaru Agbaru and
Thomas Damon Cauchon respecting claims arising out of the expropriation of 50 East
Beach Road, Bowmanville.
2. THAT Council authorizes the payment by the Municipality to Chigweyaru Agbaru and
Thomas Damon Cauchon the sum of $36,750.00 and $25,862.00 for appraisal costs
plus reasonable legal fees as determined by the Director of Planning Services in
consultation with the Municipality's Solicitor.
