HomeMy WebLinkAbout97-246 t t 1 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NO. 97-246 being a by-law to authorize an exemption from the requirements of the Purchasing By-law 94- 129, regarding the amendment to the Collection Agreement (Contract CL94-36) between The Corporation of the Municipality of Clarington and Canadian Waste Services Inc . (formerly Laidlaw Waste Systems Ltd. ) to extend contract (CL94-36) for two (2) years WHEREAS the Council of The Corporation of the Municipality of Clarington at its meeting of October 27, 1997, approved Report WD- 67-97 and the Addendum to it NOW THEREFORE THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. Notwithstanding Purchasing By-law 94-129, an extension of the term of Contract CL94-36 between The Corporation of the Municipality of Clarington and Canadian Waste Services Inc. (formerly Laidlaw Waste Systems Ltd. ) for an additional two years (to terminate December 31, 2001) , is hereby approved. 2 . The Mayor and Clerk are hereby authorized to execute, on behalf of The Corporation of the Municipality of Clarington, an amendment to the Collection Agreement with Canadian Waste Services Inc . (formerly Laidlaw Waste Systems Ltd. ) (Contract CL94-36) , in order to give effect to Report WD-60-97 . BY-LAW read a first and second time this 3rd day of November, 1997 . BY-LAW read a third and final time this 3rd day of November, 1997 . ayor lerk THIS FIRST AMENDING AGREEMENT made as of the 27th day of October, 1997. BETWEEN: CANADIAN WASTE SERVICES INC. (hereinafter called "Canadian Waste") OF THE FIRST PART - and- THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON (hereinafter called the "Municipality") OF THE SECOND PART WHEREAS: A. The Municipality and Laidlaw Waste Systems Ltd.("Laidlaw")entered into Contract CL 94- 36 dated October 14, 1994 for the collection, hauling and unloading of garbage between January 1995 and December 31,1 999. B. Canadian Waste is the successor of Laidlaw in respect of the Contractor's rights and duties under the Collection Agreement. C. At its meeting on October 27, 1997, the Council of the Municipality approved the recommendations contained in Addendum to Report WD-67-97 including the recommendation that the term of the Collection Agreement be extended for two (2)years to terminate on December 31, 2001. D. This First Amending Agreement is authorized by By-law No. 97-246 which was passed by the Council of the Municipality on October 27, 1997, NOW THEREFORE WITNESSETH THAT in consideration of the premises and the covenants hereinafter expressed, and the sum of two ($2.00) dollars of lawful money of Canada,now paid by First Amending Agreement -2- each Party to the others (the receipt whereof by each Party is hereby acknowledged), the Parties hereto covenant and agree to and with each other as follows: 1. The term of the Collection Agreement being Contract CL 94-36 between the Municipality and Laidlaw dated October 14, 1994 is extended to terminate on December 31, 2001 rather than on December 31, 1999. 2. All other provisions of the Collection Agreement are hereby confirmed and continue in full force and effect. IN WITNESS WHEREOF the Parties hereto have hereunto set their hands and seals the day and year first above written and the Parties hereto have hereunto affixed their corporate seals by the hands of their proper officers duly authorized in that behalf.
