Meeting: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE Date: MONDAY, JANUARY 19, 1998 Report #: TR - 1 - 98 File #: Subject: TENDER CL97-28, ANIMAL CONTROL SHELTER Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report TR-1-98 be received; 2. THAT Gerr Construction Limited, Bowmanville, Ontario, with a total bid in the amount of $325,789.00 (including net G.S.T.), being the lowest responsible bidder meeting all terms, conditions and specifications of Tender CL97-28, be awarded the contract for the construction of the Animal Control Centre; 3. THAT total funds required in the amount of $349,479.00 ($325,789.00 revised tender amount + $23,690.00 professional fees, including net G.S.T.), be drawn from the following: a) $300,000.00 approved in 1997 budget as follows: $146,000.00 Development Charges Civic Administration Reserve Fund Account #1110-00188-0000; $136,000.00 Municipal Capital Works Reserve Fund Account #1110-00189-0000; and $18,000.00 Animal Control Building Reserve Account #2900- 00012-0001. b) $10,000.00 approved in 1996 Capital Budget for floor sealing in the existing building to be reallocated to new facility from Animal Control Building Reserve Account #2900-00012-0001; and c) Total additional funds required in the amount of $39,479.00 to be drawn from Development Charges Civic Administration Reserve Fund Account #1110-00188-0000 for $24,079.00 and Animal Control Equipment Reserve Fund Account #2900-00012-0000 for $15,400.00. 801 REPORT NO.: TR-1-98 TENDER CL97-28 PAGE 2 4. THAT the attached By-law marked Schedule "A" authorizing the Mayor and Clerk to execute the agreement be approved, FORTHWITH. BACKGROUND AND COMMENT: Tenders were publicly advertised and issued for the renovation of the existing Public Works Depot on Lake Road to accommodate the new Animal Control Shelter, as provided for in the 1997 Capital Budget. Subsequently, bids were received and tabulated as follows: Grenwitch General Contracting Concord, Ontario Gerr Construction Limited Bowmanville, Ontario Newgen Construction Corporation Mississauga, Ontario $413,020.00 $424,700.00 $518,950.00 As all of the tenders were over the total budget allocation, at the agreement of all bidders, a post tender addendum was issued proposing several deletions in order to reduce the total tender amount. If all the reductions were accepted, the bid amounts are as follows: Gerr Construction Limited Bowmanville, Ontario Grenwitch General Contracting Inc. Concord, Ontario Newgen Construction Corporation Mississauga, Ontario NOTE: G.S.T. is extra to all above prices. $289,700.00 $316,000.00 $399,000.00 802 REPORT NO.: TR-1-98 TENDER CL97-28 PAGE 3 The reductions proposed included the elimination of the dog runs and the epoxy paint on the walls, as well as some minor building changes that do not affect the overall operation. After review of the unit prices submitted, it is the opinion of staff, that the elimination of the dog runs and the epoxy paint would not be in the Municipality's best interest and that these items should be included in the tender award. By adding these two items back in to the low bid from Gerr Construction, the total bid amount is revised to $325,789.00 (including net G.S.T.). It is recommended that the total required funds in the amount of $349,479.00 (revised tender amount + professional fees $23,690.00 including net G.S.T.)' for the construction of the Animal Control Shelter be provided as follows: 1997 Budget #1110-00188-0000, Development Charges Civic $146,000.00 Administration Reserve Fund #1110-00189-0000, Municipal Capital Works $136,000.00 Reserve Fund #2900-00012-0001, Animal Control Building $ 18,000.00 Reserve 1996 Capital Budget #2900-00012-0001 $ 10,000.00 Development Charges Administration Reserve Fund, #1110-00188-0000 $ 24,079.00 Animal Control Equipment Reserve Fund, $ 15,400.00 #2900-00012-0000 TOTAL $349,479.00 The Treasurer has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc., should be referred to the Clerk. 803 REPORT NO.: TR-1-98 TENDER CL97-28 PAGE 4 The low bidder has previously provided satisfactory service to the Municipality of Clarington. After further review and analysis of the bids by the Consultant, Thomas Brown Architects (see attached letter marked Schedule "B"), Purchasing, the Clerk, and the Property Manager, it was mutually agreed that Gerr Construction, Bowmanville, Ontario, be recommended for the contract for the construction of the Animal Control Shelter. Property Manager MM*LB*ld 804 SCHEDULE "A" THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 98- Being a By-law to authorize a contract between the Corporation of the Municipality of Clarington and Gerr Construction Limited, Bowmanville, Ontario, for the construction of the Animal Control Shelter. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington, and seal with the Corporation Seal, a Contract between Gerr Construction Limited and said Corporation; and 2. THAT this agreement attached hereto as Schedule "A" form part of this By-law. By-law read a first and second time this day of January, 1998.
