FINAL WORKS INCLUDING ROADS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee recommend to
Council the following:
1. THAT Report WD-27-98 be received;

2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the
Final Works, which include final stage roads and other related Works, constructed within Plans
40M-1754, 40M-1755 and part of 40M-1761; and
3. THAT Council approve the by-laws attached to Report WD-27-98, assuming certain streets within
Plans 40M-1754, 40M-1755 and part of 40M-1761, as Public Highways.

2.0 BACKGROUND
2.1 The Corporation of the Municipality ofClarington entered into a Subdivision Agreement,
registered March 17, 1994, with Kiddicorp Investments Limited to develop lands by plan of
subdivision, located in Courtice and described as Plans 40M-1754, 40M-1755 and 40M-
1761 (Attachment No.1). The agreement required the developer to construct all roadworks,
including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a
storm drainage system and street lights, hereinafter referred to as the ' Works' .
2.2 As permitted under the subdivision agreement, Plan 40M-1761 was divided into Phases 3A
and 3B, with the approval of the Director of Public Works.
2.3 The subdivision agreement separates the Works into four (4) stages:
(a) Initial Works;
(b) Street Lighting System;
(c) Finals Works; and
(d) Stormwater Management System
2.4 The Initial Works and Street Lighting System Works for Phases 1, 2 and 3A were
simultaneously issued 'Certificates of Completion' and subsequent 'Certificates of
Acceptance' by the Director of Public Works, as per the maintenance requirements set
out in the Subdivision Agreement.
2.5 The Final Works for Phases 1, 2 and 3A were simultaneously issued 'Certificates of
Completion', dated July 15, 1996. This initiated a one (1) year maintenance period which
expired on July 15, 1997. The Works have been reinspected and all deficiencies have now
been rectified to the satisfaction of the Director of Public Works.

2.6 It is now appropriate to issue a 'Certificate of Acceptance' for the Final Works for Phases 1,
2 and 3A. The subdivision agreement requires Council approval prior to the issuance of
any 'Acceptance Certificate' for Final Works.
2.7 Further to the issuance of a 'Certificate of Acceptance', by-laws are required to permit the
Municipality to assume the appropriate streets within Plans 40M-1754, 40M-1755 and
40M-1761 as public highway (Attachments No.2, 3 and 4).
2.8 For Council's information, the Stormwater Management System was issued a 'Certificate
of Completion' dated September 23, 1996. This initiated a two (2) year maintenance period
which expires on September 23, 1998. At that time, those Works will be reinspected and,
subject to all deficiencies being rectified to the satisfaction of the Director of Public Works,
a 'Certificate of Acceptance' will be issued.

BY-LAW NUMBER 98-
Being a By-law to assume certain streets within the Municipality
of Clarington as public highways in the Municipality of Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality of Clarington enacts as
follows:
1. THAT the lands described as Blocks 27 and 27, Plan 40M-1754, in the Municipality of
Clarington, Regional Municipality of Durham, are hereby laid out and established as public
highway.
2. THAT the streets and Blocks in Registered Plan 40M-1754, described in Schedule "A" attached
hereto and forming part of this By-law, all being in the Municipality of Clarington, in the
Regional Municipality of Durham, are hereby accepted by the Corporation of the Municipality of
Clarington as public highways, and assumed by the said Corporation for public use.
BY-LAW read a first and second time this 27th day of April 1998.

hereto and forming part of this By-law, all being in the Municipality of Clarington, in the
Regional Municipality of Durham, are hereby accepted by the Corporation of the Municipality of
Clarington as public highways, and assumed by the said Corporation for public use.
3. THAT Part of Lot 30, Concession 2, Geographic Township of Darlington, now in the
Municipality of Clarington, Regional Municipality of Durham, designated as Part 1, Plan 40R-
15055, is hereby laid out and established as public highway, and assumed by the Corporation for
public use.
