LAY OUT AND ESTABLISH PART OF LOT 17, CONCESSION 1, GEOGRAPHIC TOWNSHIP OF DARLINGTON DESIGNATED AS PARTS 1 AND 3 ON PLAN 40R-18009 AS A PUBLIC HIGHWAY UNDER THE MUNICIPAL ACT Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-26-98 be received; 2. THAT Council approve the by-law attached to this report to layout and establish Part of Lot 17, Concession 1, Geographic Township of Darlington designated as Parts 1 and 3 on Plan 40R -18009 as a Public Highway which will be an extension of Bonathon Crescent as a public highway; and 3. THAT a copy of this report be sent to Green-Martin Holdings Limited. REPORT 1.0 ATTACHMENTS No.1: Key Map No.2: By-law to layout and establish as public highway. 2.0 BACKGROUND 2.1 The Municipality of Clarington entered into a subdivision agreement with Green- Martin Holdings Limited, registered on December 3, 1997, respecting the lands in Bowmanville to which draft Plans of Subdivision 18T-88047 and l8T-90008 apply. RECYClEDt:'\ PAPIER v PAPER '<:!:1 RECYCLE TH~ IS PRINTED ON RECYCLED PAPER 1 1 0 1 REPORT NO.: WD-26-98 PAGE 2 Subsequently, final plans of subdivision were registered on title as Plans 40M-1904 and 40M-1907. 2.2 The Agreement restricts the development of Blocks 34 to 40, inclusive, on Plan 40M-1907, "until such time as the street abutting said blocks is extended and completed to full urban standards to the satisfaction of the Director of Public Works". Bonathon Crescent is the street referred to. In front ofthe affected blocks, Plan 40M-1907 lays out Bonathon Crescent to only a 10 metre (33 foot) width. Prior to developing the affected lots, it was necessary for the Municipality to have title to Bonathon Crescent to a full width of 20 metres (66 feet) in front of the affected blocks and for the roadway to be constructed to urban standards for a local road. 2.3 Green-Martin Holdings Limited has arranged for the transfer to the Municipality of the lands necessary for the extension of Bonathon Crescent to full width in front of the affected blocks, free and clear of encumbrances, and has completed that portion ofBonathon Crescent in front ofthe affected blocks to full urban standards. 2.4 Green-Martin Holdings Limited has applied for building permits in respect of Blocks 34 to 40, inclusive, on Plan 40M-1907. Building permits cannot be issued until the lands comprising the intended street in front of these blocks has been formally laid out and established as a public highway by Council. 2.5 The extension of Bonathon Crescent will remain under a maintenance guarantee until such time as the Director of Public Works issues a Certificate of Acceptance for such works in accordance with the terms of the Subdivision Agreement. 1 1 02 REPORT NO.: WD-26-98 PAGE 3 Respectfully submitted, Reviewed by, ~~ Stephen A. WD-_-98 ATTACHMENT NO. 1 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 98- Being a By-law to layout and establish certain lands and premises within the Municipality of Clarington as public highway. NOW THEREFORE, the Council of The Corporation of the Municipality ofClarington enacts that the lands and premises set out in the attached Schedule "A" are hereby laid out and established as public highways forming part of Bonathon Crescent. BY-LAW read a first and second time this 27th day of April 1998. BY-LAW read a third time and finally passed this 27th day of April 1998.
