PHASES 1A AND 2A, PART OF PLANS 40M-1686 AND 40M-1734,
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW',
FINAL WORKS INCLUDING ROADS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-17-98 be received;
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the Final Works, which include
final stage roads and other related Works, constructed within
Plans 40M-1686 and 40M-1734; and
3. THAT Council approve the by-laws attached to Report WD-17-98,
assuming certain streets within Plans 40M-1686 and 40M-1734 as
Public Highways.

2.0 BACKGROUND
2.1 The former Corporation of the Town of Newcastle, now the
Corporation of the Municipality of Clarington, entered into a
Subdivision Agreement, registered October 10, 1991, with
Martin Road Holdings Limited and West Bowmanville Developments
Ltd. to develop lands by plan of subdivision, located in
Bowmanville and described as Plans 40M-1686 and 40M-1734

(Attachment No.1). The agreement required the deVeloper to
construct all roadworks, including hot-mix paving, curb and
gutter, sidewalks, boulevard sodding and street trees, a storm
drainage system and street lights, hereinafter referred to as
the 'Works'.
2.2 As permitted under the subdivision agreement, Plan 40M-1686
was divided into Phases 1A and 1B while Plan 4()M-1734 was
divided into Phases 2A, 2B and 2C.
2.3 The Final Works for Phases 1A and 2A were issued' Certificates
of Completion' dated October 5, 1995. This initiated a two
(2) year maintenance period which expired on OctOber 5, 1997.
The Works have been reinspected and all deficiencieliirhave now
been rectified to the satisfaction of the Director of Public
works.
2.4 It is now appropriate to issue a 'Certificate of Acceptance'
for the Final Works for Phases 1A and 2A. The subdiVision
agreement requires Council approval prior to the issuance of
any 'Acceptance Certificate' for Final Works.
2.5 Further to the issuance of a 'Certificate of Acceptance', a
by-law is required to permit the Municipality to assume the
appropriate streets within Plans 40M-1686 and 40M-1734 as
Public Highway (Attachments No.2 and 3).

BY-LAW NUMBER 98-
Being a By-Law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follow:
1. THAT the lands described as Blocks 117 and 118, Plan
40M-1686, in the Municipality of Clarington, Regional
Municipality of Durham, is hereby laid out and
established as public highway.
2. THAT the streets in Registered Plan 40M-1686, described
in Schedule "All attached hereto and forming part of this
By-Law, all being in the Municipality of Clarington, in
the Regional Municipality of Durham, are hereby accepted
by the Corporation of the Municipality of Clarington as
public highways, and assumed by the said Corporation for
public use.
BY-LAW read a first and second time this 9th day of March 1998.
BY-LAW read a third time and finally passed this 9th day of March
1998.

Being a By-Law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follow~
1. THAT the lands described as Blocks 63, 68, 71, 72, 73, 74
and 76, Plan 40M-1734, in the Municipality of Clarington,
Regional Municipality of Durham, are hereby laid out and
established as public highway.
2. THAT the streets and Blocks in Registered Plan 40M-1734,
described in Schedule "A" attached hereto and forming
part of this By-Law, all being in the Municipality of
ClaringtonJ in the Regional Municipality of Durham, are
hereby accepted by the Corporation of the Municipality of
Clarington as public highways, and assumed by the said
Corporation for public use.
