COURTICE, PLAN 40M-1744,
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW',
FINAL WORKS INCLUDING ROADS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-8-98 be received;
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the Final Works, which include
final stage roads and other related works, constructed within
Plan 40M-1744; and
3. THAT Council approve the by-law attached to Report WD-8-98,
assuming the streets within Plan 40M-1744 as Public Highways.

2.0 BACKGROUND
2.1 The Corporation of the Municipality of Clarington entered into
a Subdivision Agreement, registered December 14, 1993, with
Kingsberry Properties to develop lands by plan of subdivision,

No.1). The agreement required .the develpper tocdl.lstr\ict all
roadworks, including hot-mix paving, curb and gutter,
sidewalks, bdulevard sodding and street trees, a storm
drainage syst;em and street li9hts, hereinafter referred to as/
the 'works'.
2.2 The' subdivision agreement provides for the separa.tioo-of the<, >
Works into four (4) stages:
(a) Initial works;
(b) qtreet Liaqtina System;
(c) Final works; and
(d) Sto;rmwater Managelll@nt Svstem
2.3 The I~itial works and StreE!y Liqhtina works were issued
'Certificat;es of Completion' and subsequent 'Cert;iticat.es<of
Accept-ance' by the Directorpf Public Works, as per. the.
maintenance requirement.s set out in the Subdivision-Agr~ement.;

with this phase of the project.
2. 5 The Final Works were issued a 'Certificate of CQlllpiletiotl'
dated Oecember 10, 1995.. This initiated a one (1 yea:!:"
maintenance period which expired on December 10, 19~~. Tne
Works have been reinspected and all def;i.ciencieshave now been
rectified to the satisfaction of the Director.
2.6 It is now appropriate to issue a 'Certificate of~cceptance!
for the . Final Works. The - subdivision a~ement '.-'I;equ;ires
Council approval prior to the issuance of any .'~cepta~e
Certificate' for Final Works.

2.7 Further to the issuance 0:(: a 'Certificate of Acceptance', a
by~law is required to permit the Municipality to assume
certain streets within Plan 40M-1744 as public highway
(Attachment No.2) .

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 98-
Being a By-Law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follow:
1. THAT the land described as Block 143, Plan 10M-820, in the
Municipality of Clarington, Regional Municipality of Durham,
is hereby laid out and established as public highway and is
accepted by the Corporation of the Municipality of Clarington
as public highway, and assumed by the said Corporation for
public use.
2.
THAT the lands described as Blocks 24, 27 and
40M-1744, in the Municipality of Clarington,
Municipality of Durham, are hereby laid
established as public highway.

3. THAT the streets and Blocks in Registered Plan 40M-1744,
described in Schedule itA II attached hereto and forming
part of this By-Law, all being in the Municipality of
Clarington, in the Regional Municipality of Durham, are
hereby accepted by the Corporation of the Municipality of
Clarington as public highways, and assumed by the said
Corporation for public use.
BY-LAW read a first and second time this 19th day of January, 1998.
BY-LAW read a third time and finally passed this 19th day of
January, 1998.
