JJ . 004 Report #: Subject: CEDARBROOKE SUBDIVISION, PHASE 1B (PART OF) PLAN 10M-824, COURTICE 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW', FINAL WORKS INCLUDING ROADS, STREET LIGHTS AND n'T'll"F.R RF.T.lI.'T'F.n WnRKl'l Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-5-98 be received; 2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, street lights and other related Works, constructed within Phase 1B of Plan 10M-824; and 3. THAT Council approve the by-law attached to Report WD-5-98, assuming certain streets within Plan 10M-824 as Public Highways. REPORT 1.0 ATTACHMENTS No.1: No.2: Key Map Road Dedication By-law for Phase 1B of Plan 10M-824 2.0 BACKGROUND 2.1 The Corporation of the Municipality of Clarington entered into a Subdivision Agreement, registered March 8, 1989, with Kiddicorp Investments Limited to develop lands by plan of subdivision, located in Courtice and described as Plan 10M-824 "EOVCC<D~.""R "~PER 'ttJ:I RECYCLE n<"'",PRINfEDON'lECYCUDPAPl:R 1101 REPORT NO.: WD-5-98 PAGE 2 (Attachment NO.1). The agreement required the d~veloper to construct all roadworks, including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works'. 2.2 The subdivision agreement provides for the separation of the Works into two (2) stages: (a) Storm Sewer Svstem; and (b) Roa~s and Above Groun~ Services 2.3 Council previously approved Report WD-88-91, which authorized the issuance of a 'Certificate of Acceptance' for the Storm Sewer System for Plan 10M-824 (Phases 1A and 1B). Council also previously approved Report WD-7-93, which authorized the issuance of a 'Certificate of Acceptance' for the Roads and Al;!ove Ground Services for only Phase 1A of Plan 10M-824. 2.4 The Roads and Above Ground ~e~ices for Phase 1B were issued a 'Certificate of Completion' dated November 25, 1994. The Works were placed on a two year maintenance perioQ. which expired on November 25, 1996. The Works have been reinspected and all deficiencies have now been rectified to the satisfaction of the Director. 2.5 It is now appropriate to issue a 'Certificate of Acceptance' for the Roads and Above Ground Services for Phase lB. The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 2.6 Further to the issuance of a 'Certificate of Acceptance', a by-law is required to permit the Municipality to assume 1102 . THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 98- Being a By-Law to assume certain streets within the Municipality of Clarington as public highways in the Municipality of Clarington. NOW THEREFORE, the Council of The Corporation of the Municipality of Clarington enacts as follow: 1. THAT the land described as Block 306, Plan 10M-824, in the Municipality of Clarington, Regional Municipality of Durham, is hereby laid out and established as public highway. 2. THAT the streets described in Schedule "A" attached hereto and forming part of this By-Law in Registered Plan lOM-824, all being in the Municipality of Clarington, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Municipality of Clarington as public highways, and assumed by the said Corporation for public use.
