Subject:
Recommendations:
It is respectfully recommended that the General Purpose &
Administration Committee recommend to Council the following:-
1. THAT Report No. CS-35-92 be received;
2. THAT Report TR-89-92 (Tender NW92-4 Bowmanville Recreation
Complex - Landscaping Tender Phase I) be approved forthwith
as amended through Report CS-35-92.
1.0 BACKGROUND:
1.1 At the October 13, 1992 meeting of Council, Report TR-89-92
(Bowmanville Recreation Complex Landscaping Tender Phase I)
was referred to Community services staff for a detailed review
and subsequent report.
1.2 The intention of the referral was for staff to review the
tender documents and identify areas within the tender where
items could be deleted from Phase I and deferred to a
subsequent Phase with minimal impact on the original intent
of the project.
1.3 Staff has completed its review of the proj ect and have
identified specific details which could be deferred to a
future development phase. Attachment #1 is provided as a
detailed breakdown of the tender, identifying a potential of
$54,547.30 which could be deferred from the original project
cost of $201,687.44. ../2

1.4 The review process included a review of all bidders for this
tender. Results of this exercise maintain that Rutherford
Contracting Limited, Gormley, ontario is still the lowest
bidder considering revisions made as a result of the deferred
items.
2.0 PROJECT DETAILS:
2.1 As the municipality grows, it is noted that the intersection
of Highway #2 and Regional Road 57 will be integral to
Bowmanville's Main Central Area. It is important for the
Municipality to accept a shared responsibility and to set an
example for the future development of this area.
2.2 The Master Plan of the Complex, as it relates to this
intersection (Attachment #2) accomplishes this objective, in
addition to expanding the use of the Multi Purpose Room at the
Bowmanville Recreation Complex.
2.3 Attachment #3 is provided to detail specifics of the actual
tender in question for the information of Council.
3.0 RECOMMENDATIONS:
3.1 Staff through this report is requesting that Council approve
Report TR-89-92 (Tender NW92-4 Bowmanville Recreation Complex
Landscaping Tender Phase I) as amended by Attachment #1 to
Report CS-35-92.

RECOMMENDATIONS:
It is respectfully recommended that the General purpose and
Administration Committee recommend to Council the following:
1. THAT Report TR-89-92 be received~
2. THAT Rutherford Contracting Ltd., Gormley, Ontario,
with a bid in the amount of $157,887.44, being the lowest
responsible bidder meeting all terms, conditions and
specifications of Tender NW92-4, be awarded the contract for
the Bowmanville Recreation Complex - Landscape Works, Phase
I, as required by the Department of Community Services~ and
3. THAT the total required funds in an approximate amount of
$201,687.44 ($157,887.44 contract + $43,800.00 other
associated cost), be drawn from Account #1110-00156-0000,
as approved and carried over from the 1991 Capital Budget.
BACKGROUND AND COMMENT:
Subsequent to Council Resolution #GPA-688-91 (copy attached marked
Schedule "A"), the tender specifications for the Bowmanville
Recreation Complex - Landscape Works, Phase I were revised and
re-issued. In an effort to reduce the overall project cost, the
following items were deleted from the re-tendered project:

site furnishings
sodding
supply of topsoil
reduction of amount of
main pedestrian walk
landscaping
fill to be moved

Bids were received and tabulated as follows:

Upon review of the bid submission from Ron Robinson Limited, it was
apparent that there was a pricing discrepancy for item #1.2 (removal
and disposal of excess material). Their price had provided for
removal of fill beyond the limit of construction which is not in
accordance with the tender specifications.
In order that all bids may be compared equally, the bid from Ron
Robinson Limited has been credited for $11,812.80. The final bid
results as reconciled will now read as follows:

drawn from Account #1110-00156-0000 and are within the $240,000.00, as
approved and carried over from the 1991 Capital Budget.
In view of the economic slowdown and the limited funds available, it
is staff's recommendation that further phasing of this project be
delayed for another year. This contract will complete this phase and
all unexpended funds may be returned to the Lot Levy account.

The Treasurer has reviewed the funding requirements and concurs with
the recommendation. Queries with respect to department needs,
specifications, etc., should be referred to the Director of Community
Services.
After further review and analysis of the bids by purchasing, Cosburn
Giberson Landscape Architects and Community Services, it was mutually
agreed that the low bidder, Rutherford Contracting Ltd., Gormley,
Ontario, be recommended for the contract for the Bowmanville
Recreation Complex - Landscape Works, Phase I.
Although the subject firm have not previously performed for the Town
of Newcastle, they do come highly recommended as outlined in the
attached letter from Cosburn Giberson Landscape Architects, marked
Schedule "B".

The total required funds in an approximate amount of $271,550.30
($238,173.30 contract + $33,375.00 design and construction
administration) will be drawn from the Community Services Capital
Budget, Account #7603-00001-0516, as reflected on page 172 of the
1991 Capital Budget.
The Treasurer has reviewed the funding requirements and concurs
with the recommendation. Queries with respect to department

Further to our recent discussions, we are writing to confirm our recollllllendations for the
selection of a contractor to carry out the above noted contract works.
As you are aware, A.Timar Contracting Ltd. offered the lowest bid ($2;92,359.89) of the
three acceptable bids submitted. We hav~ worked successfully with TImar on a number of
occasions In the past and this experience, along with the list of references provided, gives us
confidence in recommending them to perform Ule work of this' contract.
We are aware of the construction budget limitations for this phase of the p~oject and we
realize that the present contract price is in excess of this figure. In light of this fact we sug-
gest that the folIowing modifications be made to the contract to bring it within the limits of
the budget available. '

Our firm has first-hand knowledge of all three bidders, as each firm has constructed park
facilities designed by our office. The low bidder Rutherford Contracting bas completed 30
projects for OUT firm over the past 10 years and has maintained an excellen~: record.
T~e. tender itself appears to be a very competitive bid and reflects the curr<::nt market
pncmg.
In conclusion, COSburn/Giberson would recommend the Town award this project to
Rutherford Contracting in the amount of $]57,887.44.

Tenders received for the above project have been balanced and reviewed by our firm. It is
found that a pricing discrepancy for item 1.2 exists. The item called for removal and dis-
posal of excess material off site. The exact scope of work was evidentl~ :rnisunders10od by
the firm of ~on Robinson Limited. Their price provides for removal of fill beyond the limlt
of constructlOn.
\ It is therefore reconunended the Ron Robinson bid be credited $11,040.00 plus G.S.T. with
respect to item 1.2. We believe this credit will equalize all bidders. The final bid results a!'i
reconciled will now read as follows;
Rutherford Contracting $157,887.44
Ron Robinson Contracting $183,092.36
Vie Priestly Contracting $188,822.21
