ELAINE FLINTOFF Recommendations: It is respectfully recommended that the General Purpose & Administration Committee recommend to Council the following:- 1. THAT Report No. CS-32-92 be received; and 2. THAT a copy of Report CS-32-92 be forwarded to Mrs. Elaine Flintoff for information. 1.0 BACKGROUND: 1.1 On July 27, 1992 Mrs. Elaine Flintoff came as a delegation to advise Council of her concerns relative to an incident which occurred at the Orono Arena Community Centre. subsequent to Mrs. Flintoff's presentation, the following resolution was passed: "THAT the presentation of Mrs. Flintoff be received; THAT a meeting be organized with the Orono Arena Community Centre Board co-ordinated by Councillor Dreslinski and the Communi ty Services Department in order to deal with the concerns raised by Mrs. Flintoff; THAT staff examine the appropriate By-Law establishing the subject Board in light of Mrs. Flintoff's comments; THAT a report be prepared and presented to the General Purpose and Administration Committee regarding all of the above as soon as possible; and THAT Mrs. Flintoff be advised of all of the above actions." . . /2 901 RECYCLED I;t;\ PAPIER PAPER '<:r1 RECYCLE THIS IS PRINTED ON RECYCLED PAPER REPORT NO. CS-32-92 - 2 - OCTOBER 19, 1992 1.2 This report is the follow-up to the original incident that resulted in Mrs. Flintoff's presentation to Council. 2.0 STATUS OF ORIGINAL INCIDENT: 2.1 The original incident involved Mr. Paul Flintoff being expelled from the Orono Arena Community Centre for misconduct. Mr. Flintoffwas ejected from the facility by the Arena Manager, Mr. Peter Maartense. Mr. Flintoff was later charged with trespassing by the Durham Regional Police. A letter was sent to Mr. Flintoff's parents (dated April 16, 1992) informing them of the incident. 2.2 Upon review of By-law 78-63 it is the op1n1on of the Community Services Department that the Arena Manager had acted within his responsibilities when he ejected Mr. Flintoff from the facility. The Arena Manager does have the authority to take necessary and appropriate action in situations that could be harmful and/or unsafe for the members of the public attending the Orono Arena Community Centre facility. 2.3 Subsequent to Mrs. Flintoff's presentation to Council, Mrs. Flintoff was contacted by the Recreation Superintendent of the Community Services Department. Mrs. Flintoff indicated that the charges against Paul Flintoff had been dropped by the Orono Arena community Centre Board and that Paul would be allowed to attend the facility as of January 1, 1993 and would be able to continue, provided that the rules pertaining to the Arena are complied with. Mrs. Flintoff also indicated that she appreciated the efforts of Council and the Community services Department in assisting her to find an amicable resolve to this situation. 3.0 CONCLUSIONS: 3.1 The original incident has been resolved to the satisfaction of the Orono Arena Community Centre Board and the Flintoff family. . . /3 902 REPORT NO. CS-32-92 - 3 - OCTOBER 19, 1992 3.2 The Community Services Department and Councillor Dreslinski have initiated ongoing meetings with the Orono Arena Community Centre Board to address the other comments/concerns, regarding the structure and responsibilities of the Orono Arena Community Centre Board (per By-law 78-63), raised by Mrs. Flintoff. A report regarding these meetings and any resolves will be brought forward for Council consideration at a later date.
