Res. # YJA-SH--9:z By-Law # Date: JULY 20, 1992 CS-29-92 File #: Report #: Subject: VISUAL ARTS CENTRE - ART IN THE PARK Recommendations: It is respectfully recommended that the General Purpose & Administration Committee recommend to Council the following:- 1. That Report No. CS-29-92 be received; 2. That the Visual Arts Centre be permitted to construct sculptures in the designated area at Soper Creek Park. 1.0 BACKGROUND: 1.1 Resolution C-99-92 of the meeting of February 10, 1992 stated that a report be prepared for submission to the General Purpose & Administration Committee following a meeting with Mr. Tony Cooper and the possibility of constructing sculptures at the Soper Creek Park. 2.0 RECOMMENDATION: 2.1 After meetings with the Visual Arts Centre and Mr. Cooper, it was agreed that the following terms be included as conditions to the request. 2.1.1 The area to be used will be to the south east side of the Visual Arts Centre building for the purpose of displaying art. 2.1.2 The Visual Arts Centre will be responsible to permit the designated area. .. /2 c; ; 1 1 J ' ~"w'" I:t\ """ PAPER '<:!:1 RECYCLE lHIS IS rRINTfD ON RI:::CVClED PArER REPORT NO. CS-29-92 - 2 - JULY 20, 1992 2.1.3 2.1. 4 2.1.5 2.1. 6 2.1. 7 The Visual Arts Centre will monitor and prepare a list of criteria to the Town for review. Any excavation, foundation specifications, must be approved by the Community services Department. Any permits required (Town of Newcastle, CLOCA) must be obtained by the Visual Arts Centre in conjunction with the Community Services Department. Maintenance of the designated area is to be the responsibility of the Visual Arts Centre. Should the area that has been designated for art display no longer be required, the lands will be returned to their original condition. 3.0 PROVINCIAL FUNDING: 3.1 The ontario Arts Council announced on June 17, 1992 the recipients of the new Venture Fund Grants. The jury selected 23 proposals from among 207 applications for grants worth a total of $205,750. Anthony J. Cooper of Orono is one of the recipients. 4.0 CONCLUSION: 4.1 As the Visual Arts Centre have satisfied the conditions for the proposed project as stated in the Director of Community Services Letter of March 10, 1992, (Attachment #1) it is agreed, that this project to display art work can proceed. Box 52 Bowrnanville, ontario L1C 3K8 Dear Margaret: RE: REQUEST TO DISPLAY ART WORKS AT THE SOPER CREEK PARK Subsequent to our meeting of February 27, 1992 regarding the above, please be advised that the Community Services Department will recommend to Council the concept of displaying artworks subject to the following: 1. A specific area must be defined adjacent the Visual Arts Centre for the purpose of displaying art. 2. The Visual Arts Centre will be responsible to permit the designated area. 3. A list of criteria for use of the designated area must be established by the Visual Arts Centre and submitted to the Town for review. 4. Third party liability coverage be provided in the Town's favour in the amount of $2,000,000.00 (subject to the satisfaction of the Treasurer). 5. Any excavation,. (ie) foundation specifications must be approved by the Community Services Department. 6. Any required permits (ie) C.L.O.C.A. must be obtained by the Visual Arts Centre in conjunction with the Community Services Department. 7. Should the designated area (to be determined) no longer be required the lands must be returned to their original condition. Mr. Fred Horvath will be the Department's contact person once the process has begun. Also, please find attached a copy of the Parks By-Law as requested. Further, it would be appropriate to meet once again to resolve points 1, 3, 4 and 6 prior to my reporting to Council. Please contact my office to make the necessary arrangements.
