THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NO. 81 - 1'7
~
WHEREAS Council has received the resignation of Mr. John W. Dunham
as Director of Public Works of the Town of Newcastle;
AND WHEREAS the Council of The Corporation of the Town of Newcastle
deems it desirable to pass this by-law;
BE IT ENACTED as a by-law of The Corporation of the Town of
Newcastle that:
1. The Town of Newcastle accept the resignation of
John W. Dunham as Director of Public Works of the Town of
Newcastle effective immediately and that By-law 74-5 appointing
him Director of Public Works be and the same is hereby rescinded.
2. In addition to any other benefits that he might
~ otherwise be entitled to by virtue of existing Town policies,
the Town shall:
(a)
pay the cost of recognized relocation services
up to a maximum of $6,500.00 provided such
.'
services are used by John W. Dunham;
(b) continue the salary and benefits of John W.
Dunham for a period of nine (9) months from
October 28th, 1981, or until he shall find
suitable alternate employment, whichever is
the sooner;

pay legal costs of John W. Dunham in an
amount not in excess of $1,000.00;
in full settlement of any claims which he may have against the
Town upon condition that John W. Dunham delivers to the Town a
duly executed release in a form satisfactory to the Town solicitor.

FULL AND FINAL ~IDTUAL RELEASE

IN CONSIDERATION of the payment of TWO ($2.00)
DOLLARS and other good and valuable consideration, the parties
executing this Release, hereby mutually release and forever discharge
one another, their heirs, executors, administrators, successors and
assigns, from any and all actions, causes of actions, claims and
demands for damages, loss, or injury, howsoever arising, which
heretofore may have been or may hereafter be sustained by them in
consequence of the termination of employment of John W. Dunham as
Director of Public Works with the Corporation of the Town of Newcastle.
IT IS UNDERSTOOD fu~D AGREED that the Release hereby
mutually given or the payment or promise of payment, are deemed to
be no admission whatsoever of liability on the part of either of the

parties to this Release.
IN WITNESS WHEREOF, Jack W. Dunham has hereunto set
