THAT Report CS-18-92 be received; 2. THAT the Amendment to the Parks By-Law 91-20 attached to Report CS-18-92 be forwarded to Council for approval; and 3. THAT the Mayor and Clerk be authorized to sign the amending By-Law. 1.0 BACKGROUND: 1.1 In 1991 Council approved By-Law 91-20 which provided for the use, regulation, protection and government of parks in the Town of Newcastle. 2.0 REVIEW AND COMMENTS: 2.1 Staff have reviewed the Parks By-Law and determined that an amendment is appropriate to better meet the needs of the Community. As the Town grows and develops the By-Law will need to be revised to meet the changing needs from time to time. 2.2 The Town receives a large portion of its services through its active volunteers. It is in the best interest of the Town to promote volunteer ism and thereby better serve the public at little or no direct cost to the Town. Volunteers, in order to be effective, require the ability to raise funds and/or perform their service on Town land. To ensure that volunteers .. /2 901 f1ECYCLfoD t:t\ P~PIEA PAPER '<:I:1 RECYCLE THIS IS PRINT(OON RECYCLED PAPER REPORT CS-18-92 - 2 - MAY 4, 1992 are assisted in attaining their goal, staff recommend an amendment to By-Law 91-20. 2.3 By-Law 91-20 permits work in parks and buildings to be done by Town staff only. At present the By-Law prevents voluntary endeavors such as community tree planting and fund raising by various community groups who return their proceeds back into the community. It is the intention that the By-Law should not be unduly restrictive but rather allow permissiveness with central control. It is staff's intention that the amendment submitted as Attachment "A" will assist and promote volunteerism and their ability to fund raise. 2.4 The recommended amending By-Law (Attachment "A") is provided for Council review and approval. CS-18-92 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 92-_ belna a by-law to amend By-law 91-20,provlding for the use, regulation, protection and government of parks in the Town or Newcastle 'NHEKEAS the Council of The Corporation of the Town of Newcastle deems it advisable to amend By-law 91-20 of The Corporation of the Town of Newcastle, NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE ENACTS AS FOLLOWS: 1. lHAT By..law 91-20 is amended by: (a) adding at the end of Section 2(z) thereof the following: "except in an area permitted by a permit issued by the director;" and (b) renumbering Section 3 thereof as Section 4 and adding a new Section 3 as follows: "3. Notwithstanding the provisions of Section 2 of this by-law, the director may issue a permit to any person or organization to permit a specific park or a specific: portion of a park to be llsed for any of the following activities: (a) (b) (c) (d) the planting of trees, litter picking, or land OJ' facility improvement as may be pedormed by work parties cl)mprised of local conm..unity groups, or members of service clubs or other registration; in the case of the lands on which the Bowmanville Rc~creation Complex is located, the keeping of animals to be used or displayed in conjunction with a circu~ carnival or fair p'ermitted to be conducted within the buildings which comprise the Bowmanville Recreation Complex; the training of dogs and the riding of horses and ponies in a specific park or a specific portion of a park; and the erection of a tent or temporary shelter which is otherwise permitted by law to be used in conjunction with an outdoor Q (1 '\ , '. , .2. event approved by Council which has re.ceived the prior written approval of the Medical Officer of Health of the Regional Municipality of Durham." 2:. THAT this by-law shall come into force and take effect on the date of the passing hereof.
