PROPOSAL TO CLOSE AND CONVEY PORTIONS OF ROAD
ALLOWANCES SITUATED IN PART LOTS 32 & 33, CONCESSION 2,
FORMER TOWNSHIP OF DARLINGTON
Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report EGD-012-08 be received;
2. THAT the road allowances situated in Lot 32, Concession 2, Former Township of
Darlington, further identified as Parts 1 and 2 on Plan 40R-25183 and Part 1 on
Plan 40R-25082 be closed and declared surplus and that the road allowance be
conveyed to Prestonvale Road Land Corporation;
3. THAT the applicants pay the appraised land value of $24,000.00 as well as all
legal and other financial costs associated with the transaction;
4. THAT Council pass the necessary by-laws to implement the recommendations of
this report; and
5. THAT Prestonvale Road Land Corporation be advised of Council's decision.

1.0 BACKGROUND
1.1 Prestonvale Road Land Corporation is the owner of property identified situated
immediately adjacent to various portions of road allowance that the Director of
Engineering Services has determined are no longer necessary for public use and
that is also not in the best interest of the Municipality to continue to maintain as
road allowances. Prestonvale Road Land Corporation have advised the
Municipality that they wish to acquire ownership of the various portions of road
allowance in order to complete their next phase of development.
1.2 On Monday February 26, 2007, Council approved the recommendations of
Report EGD-012-07. The Report recommended that portions of some road
allowances be conveyed into private ownership. Confirmation of property
ownership has revealed that Part 1 on Plan 40R-23704 and Parts 10 & 11 on
Plan 40R-23561 have already been conveyed to the original land owner in 1896.
The municipal solicitor has advised that a road closure by-law is not necessary in
this case.
1.3 In accordance with the recommendations of Report EGD-012-07, Parts 1 and 2
on Plan 40R-25183 and Part 1 on Plan 40R-25082 will be conveyed to
Prestonvale Road Land Corporation for the appraised value of $24,000.00. The
applicant is agreeable to this price as well as costs for appraisal, advertising,
surveying and legal fees.
2.0 CONCLUSION
2.1 It is recommended that subject to any input received at the Public Meeting,
Council authorize the closure of the subject road allowance, declare the lands
surplus, and convey the subject lands into private ownership for the appraised
value of $24,000.00.
