THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NO. 2007 - 208
Being a By-law to amend By-law
2006-227, a by-law to licence, regulate
and prohibit certain animals or classes
thereof within the limits of the
Municipality of Clarington, or defined
areas therein.
WHEREAS Section 103 of the Municipal Act confers the power
upon a municipality to pass a by-law to provide for the seizure and
impounding of animals being at large or trespassing and the sale of
impounded animals under certain conditions;
AND WHEREAS Section 391 of the Municipal Act authorizes the
municipality to pass by-laws imposing fees or charges on any class
of Persons for services or activities provided or done by or on
behalf of it;
AND WHEREAS Section 396 of the Municipal Act provides that a
by-law passed under Section 391 may provide for fees and charges
that vary on any basis the municipality considers appropriate and
specifies in the by-law, and for different classes of Persons and
deal with each class in a different way;
AND WHEREAS the Municipality of Clarington recognizes that
often animals deemed suitable for adoption remain in the Shelter
for extended periods of time awaiting adoption;
AND WHEREAS it is not desirable to house an animal in a caged
environment for an extended period of time;
NOW THEREFORE the Council of The Corporation of the
Municipality of Clarington hereby enacts as follows:
1. THAT By-law 2006-277 be amended to add the following
section:
"9.6 Notwithstanding Section 9.3, where an animal that this
suitable for adoption has been kept in the Shelter for an extended
period of time, or when otherwise deemed appropriate, the
Municipal Clerk or the Deputy Clerk may reduce the adoption fees
as set forth in Schedule A for the purpose of promoting adoption of
an animaL"
By-Law read a first time this 29th day of October 2007.
By-Law read a second time this 29th day of October 2007.
By-Law read a third time and finally passed this 29th day of October
2007.
