THAT Addendum Report PSD-141-07 and PSD-141-07 be received; 2. THAT this Addendum Report, Report PSD-141-07 and Attachments 5, 6, 7, 8 and 9 to Report PSD-141-07 be adopted as the Municipality of Clarington's comments on Step 7 - Durham/York Residual Waste Environmental Assessment Study - Site Selection Process; 3. THAT the Regions of Durham and York be requested to respond to and address, early in 2008, the issues identified by the peer review consultants that are necessary for the submission of the EA documentation to the Ministry of the Environment; 4. THAT the Regions of Durham and York commit to including in the Request for Proposals and Certificate of Approval, Maximum Achievable Control Technology (MACT) for the emission standards and monitoring that the EFW facility will meet; 5. THAT the Regions of Durham and York be requested to delay the final selection of a preferred site for the Energy from Waste facility until such time as the submissions in response to the Request for Proposals have been reviewed, a preferred technology and vendor has been selected, and the sensitivity analysis in relationship to the site selection and the specific Human Health and Ecological Risk Assessment has been carried out; 6. AND FURTHER THAT the final site selection be delayed until the business case for the Energy from Waste facility has been adopted by the Regional Councils, incorporating the appropriate costs for the Host Community Agreement as reflected in Council Resolution #GPA 632-07 and C-592-07 (Attachment 13 to PSD-141-07); ADDENDUM TO REPORT NO.: PSD-141-07 PAGE 2 7. THAT a copy of Report PSD-141-07 and this Addendum, plus Council's decision be forwarded to the Durham-York Joint Waste Management Group, the Region of York, the Region of Durham, the Ministry of Environment, and the other area municipalities in Durham Region; and 8. BOWMANVlllE, ONTARIO l1C 3A6 T (905)623-3379 F (905)623-0830 REPORT NO.: PSD-141-07 PAGE 3 1.0 PURPOSE OF THIS ADDENDUM REPORT 1.1 At the December 3'd 2007 General Purpose and Administration Meeting, the following resolution was passed: THAT Report PSD-141-07 be referred back to staff until the Council meeting scheduled for December 10, 2007, to take into consideration comments received today. 1.2 Attachment 1 is our record of the questions asked by Council members of the peer review consultants at the December 3rd meeting with the responses given by the consultants and staff comments (if applicable). Staff have grouped the questions by topic. 1.3 In addition, we have provided some summary comments below on the key issues raised by Council. 2.0 PURPOSE OF PEER REVIEW AND THE EA PROCESS 2.1 Peer review is the process by which professional work is reviewed by the author's peers (i.e. other experts in the same field). The peer review process is intended to improve the quality of the author's work and ensure that it meets the standards and expectations of their discipline. Peer review is an accepted and common practice. The Municipality has retained consultants on a number of occasions to undertake peer reviews of various studies - for example, the OPG Dry Used Fuel Storage Facility, the deepening of St. Mary's Quarry, the Port Granby Project. 2.2 In this case, the peer review is of an Environmental Assessment, which is a decision-making process used to promote good environmental planning. If the analysis or the process that was followed does not appear to be adequate or complete, the Peer Review consultants can recommend changes to adequately address the identified deficiencies. Peer Reviews for Environmental Assessment processes regularly contain recommendations to improve the EA process and reduce the potential impact on environment and health. 2.4 In the approved Terms of Reference the following steps were set out: Step 5 - As a rule-of-thumb, a "long-list" site evaluation will be carried out if there are more than three (3) sites remaining after the application of siting constraints and consideration of available siting opportunities. The purpose of this level of evaluation is to eliminate less preferred sites from the list of sites under consideration using broad-based technical, economic and social criteria. The proposed "long-list" evaluation criteria are included in Appendix "F" - Table F-2. Their application would result in the identification of a "short-list" of alternative sites. ADDENDUM TO REPORT NO.: PSD-141-07 PAGE 4 Step 6 - Prospective vendors of the technology(ies) comprising the preferred disposal system, will be requested to submit their qualifications and may be invited to submit their own alternative site(s) for consideration. Prospective vendor site(s), if submitted, must clear minimum compliance requirements, such as being located in Ontario, to be included on the short list of sites. Public and agency consultation will be undertaken when the short list of alternative sites has been finalized. Step 7 - A Request for Proposals (RFP) will be issued to prospective technology(ies) vendors with the intent of identifying a Preferred Vendor. This will be done concurrently with the evaluation of the short list of sites. The short list of alternative sites from Step 6 will be evaluated using the same net effects analysis methodology described in Section 6.1 (Steps 4, 5, 6, and 7) resulting in the identification of a DurhamlYork siting preference. The comparative evaluation criteria will be applied on the basis of sufficiently detailed data and analyses. These criteria are included in Appendix "F" - Table F-3. Public and agency consultation will be undertaken when a Preferred Vendor and site have been identified. 2.5 The decision was made by the Regions to modify the process so that selection of the vendor and the site selection did not occur concurrently. The Terms of Reference includes some flexibility for the proponent to modify the process. As such, the specific order and timing that was set out in the TOR has been changed. Many of the unanswered questions will be addressed once the thermal treatment technology and vendor are known. The Peer Review Consultants and Staff are recommending that since the timing of the steps as set out in the TOR has been changed, that the Clarington 01 and the East Gwillimbury sites be carried forward until the technology and vendor are determined. Our consultants advise that there is nothing in the EA process that prohibits a further refinement to the short list and to carry two sites until a final selection is made. 3.0 QUALIFICATIONS OF THE PEER REVIEW TEAM 3.1 The Municipal Peer Review and other Consultants were engaged as a result of PSD-070-07. That report resulted from the Council Resolution #C-112-07 which Council adopted on April 16, 2007 and was as follows (in part): "That Staff be directed to examine comprehensively all the documentation prepared to date, the adequacy of the public consultation process and to report on alternatives available to the Municipality; That Staff investigate the implications of a proposed waste-to-energy facility on the Energy Business Park including the ability to attract prestige uses including offices and research facilities; ADDENDUM TO REPORT NO.: PSD-141-07 PAGE 5 That the Regions of York and Durham commit to design a waste-to-energy facility that will not impact the health of present and future residents; That Region of Durham provide staff of the Municipality of Clarington, a reasonable opportunity to review and comment on Report 2007-J-14; That the Region of Durham agree to pay the reasonable expenses of the Municipality of Clarington incurred with respect to all necessary studies and legal advice required in order for the Municipality to determine its position on the proposals." 3.2 Attachments 3A, 3B and 3C to Report PSD-070-07 included the company profiles and resumes of our main contact at each firm for Steven Rowe, SENES Consultant Limited and AMEC E&C Services Ltd. The company profiles for SENES and AMEC where taken from their website and included the information on the EFW and Landfill work both firms had been involved in previously. The Company Profile of SENES highlighted their work with Plasco plasma-arc pilot project in Ottawa. It is noted that the Municipality currently retains TSH, and that AMEC is a sub- consultant to the firm which undertook the Port Granby Peer Review. 4.0 POTENTIAL CONFLICT OF INTEREST 4.1 As stated in PSD-070-07 (Section 3.5) when Staff contacted the peer review consultants, we not only questioned the consultants on their qualifications but also on whether they had any conflicts of interest with regard to this project. All the firms retained had confirmed with Clarington that they did not have conflicts of interest. Some of the firms had carried out work previously for Clarington, OPG, Region of Durham, St. Mary's, etc. SENES The Region posted the RFQ for the EFW facility on their website. Any firm or agency that downloaded the document from the website was added to the list of bidders. As such, the Municipality of Clarington, SENES, the Ministry of Environment and many others appear on the List of Registered Firms on the Bid List. A copy of the 138 contacts on the bidders list is available on the Regions website or from the Clarington Planning Services Department. AMEC There are nine actual bidders which were listed in Section 4.0 of PSD-141-07. The Veolia Environmental Services Waste to Energy Inc. team includes as sub- consultants Black and MacDonald and AMEC. The Region (through their legal staff and fairness monitor) have notified this bidder that AMEC is already under contract with Clarington and have asked the bidder to provide an alternate Engineering consultant. AMEC has no conflict of interest for undertaking the Municipality's work. It is also noted that AMEC has been part of the Municipality's peer review team on Port Granby. ADDENDUM TO REPORT NO.: PSD-141-07 PAGE 6 STEVEN ROWE Steven Rowe has previously been retained by the Region of Durham on EAlPlanning Act integration issues relating to a proposed expansion of the Greenwood community in Pickering (2006), but has no contract with the Region at the present time. 5.0 FINANCIAL ANALYSIS/BUSINESS CASE 5.1 As part of the Council Resolution #C-112-07, Staff were charged with examining comprehensively all the documentation as part of the due diligence on this project. In previous reports PSD-070-07 and PSD-097-07, the financial impacts relating to the impacts on Clarington and any Host Community Agreement discussions have been included as part of the report. 5.2 While PSD-141-07 was specifically dealing with comments on Step 7 of the EA process, there are specific financial implications. Economic/Financial is one of the evaluation categories used to evaluate the sites. Under that criteria are Capital Costs and Operation and Maintenance Costs. Under Legal Considerations which is another evaluation category, the nature of property acquisition (i.e. purchase/expropriation vs. Region owned) was considered. 5.3 The EA documents (Annexes G and H, Capital Costs, and Operation and Maintenance Costs and Compatibility with Existing Infrastructure and Design/ Operational Flexibility, respectively) specifically review the financial implications of each site, including the probability of the cost recovery for the EFW from the sale of electricity and district heating system. These figures have a direct bearing on how each site was evaluated and the business case for the EFW facility. The financial implications are an inherent part of the EA documents and the criteria chosen to select a site. 5.4 However, Recommendation #6 as it appeared in PSD-141-07 was unclear and did not indicate the relevance of the business case to Clarington. As such, it has been clarified in this addendum to clearly relate the issues surrounding the site selection step in the EA process to Council's Resolution #GPA 632-07 and C-592-07 (Attachment 13 to PSD-141-07). ADDENDUM TO REPORT NO.: PSD-141-07 PAGE 7 6.0 AIR QUALITY, PUBLIC HEALTH AND SAFETY 6.1 Because there is only generic background air quality data for certain parameters (some of the critical parameters in the HHERA have no current background data or assessment), the treatment technology is unknown and the nature of the emissions controls to be installed is unknown. Hence, the peer review consultant team have concluded that it is difficult at this time to categorically say the facility is best located at the currently recommended site. As such, our consultants have recommended two geographically separate sites be carried forward in the evaluation. Staff recommended a delay in the final selection of the preferred site until the thermal technology is known and more background data is collected. 6.2 The Generic Human Health and Ecological Risk Assessment indicated that a limited number of potential human health and ecological concerns (e.g. dioxins and furans) were identified based on very conservative assumptions. It concluded that an EFW facility could be sited in Durham and York Regions but has recommended that a site specific Human Health and Ecological Risk Assessment (HHERA) be prepared to account for existing baseline chemical concentrations in the environment once the technology is known. 6.3 The Clarington Air-shed is a more compromised air-shed than what exists at the East Gwillimbury site because of the proximity to, St. Mary's Cement and other industries, the 401, etc. The Regions consultant have acknowledged this issue and in their reports provide an estimate of the emissions in the area around each site. For example, · NOx Emissions near Clarington 1 are reported as 6089 tonnes per year, versus 5.1 tonnes per year for East Gwillimbury. This is only industrial emissions and does not include transportation emissions (Le. 401). · For S02, Clarington area 8703 tonnes per year versus less than 1 tonne per year in East Gwillimbury. · Fine Particulate: Clarington 274 tonnes per year versus 41 tonnes per year and again, no consideration of transport emissions. 6.4 A modern, "state-of-the-art" EFW as Council is requesting in their Resolution #GPA 632-07 and C-592-07 (Attachment 13 to PSD-141-07) will be within the standards established for human health and safety. In our September report (PSD-097-07) on the Generic HHERA, our Peer Review Consultants "identified a number of areas where the study could be clarified to be more transparent. However, it was concluded that these changes would not change the overall conclusions of the assessment as the risks are predicted to be very low, and in fact the calculated risks would likely be lower when the appropriate technology and site is selected". They also noted that "the current background assessment only considers major contaminants measured by MOE monitoring stations". At this stage the cumulative impacts on the air-shed have not been quantified until the specific thermal treatment technology and emission control systems are specified and the site specific HHERA is complete. ADDENDUM TO REPORT NO.: PSD-141-07 PAGE 8 7.0 CONCLUSION 7.1 This report is provided for Council's consideration of Report PSD-141-07 in order to provide the Municipality's comments on Step 7 of the DurhamlYork Residual Waste Environmental Assessment Study.
