THAT Report EGD-059-07 be received; 2. THAT Council authorize the expenditure of funds contained within our Capital Budget for sidewalk works that were constructed in conjunction with the Durham Highway #2 road widening, taking place on behalf of the Region through Valiant Property management; 3. THAT Purchasing By-law 2006-127, paragraph 15.07 be waived for this project; 4. THAT the funds required in the amount of $82,000.00 be drawn from the Capital account #110-32-331-83278-7410 with funding from the approved Engineering 2007 Capital budget of $62,000.00 and the unexpended funds remaining from the 2006 Highway 2 sidewalk project in the amount of $20,000.00 to complete the project. Director of Corporate Services ASC/BMB/dv~b November 28, 2007 REPORT NO.: EGD-59-07 PAGE 3 1.0 BACKGROUND To facilitate the construction of Boston Pizza in Bowmanville's west main central area, works are required to widen Regional Road Hwy #2 and urbanize the boulevard. Valiant Property Management, on behalf of the Region of Durham, are completing these works. Urban design components provided to the developer indicate that the front entrance of Boston Pizza is essentially at the north limit of the road allowance, with the main entrance of this eatery fronting Hwy #2. Sidewalk in the road allowance was required for access to the building. The Municipality was approached by the developer to include the sidewalk construction on Hwy #2 with the widening and urbanization of the Regional Road. The Capital Budget for 2007 included the installation of sidewalk on the north side of Hwy #2 from Green Road to Clarington Boulevard. The overall area Streetscape Implementation Plan for the area was subsequently approved by Council in April 2007, but contained wider sidewalks in comparison to the budgeted amount. The installation of sidewalk on the south side of Hwy #2 from Green Road to Clarington Boulevard was completed in the 2006 Capital budget and unexpended development charges funds of $20,000.00 remained. As further background to the proposed construction, the Municipality is planning to include further streetscape components for the area in the 2008 Capital Budget. 2.0 REVIEW AND COMMENT D.G. Biddle & Associates Limited are the Engineering Consultants for the owner of the development on Hwy #2. Since D.G. Biddle & Associates Limited have been actively involved in this area and already have a database of engineering knowledge on the site and road grading, existing drainage proposals, servicing works, road design, and utility locations, it was desirable to carry out the design for the construction of the sidewalk REPORT NO.: EGO-G59-G7 PAGE 4 through their consulting firm. This arrangement eliminated any confusion and delays during the design and construction process. It was also desirable that the sidewalk be tendered in conjunction with the Regional road widening work in order to take full advantage of pricing based on volume. The tender process was open to multiple bidders and acceptance of the unit prices were subject to the approval by the Director of Engineering Service. This assured that the best interests of the Municipality were considered. The Engineering Department has discussed the process with the Purchasing Division who concurred with the approach and the waiving of the Purchasing By-law 2006-127 in order to take advantage of this proposal. The sidewalk construction approved in the 2007 Capital Budget in the amount of $62,000 was for sidewalk that is 1.5 metres wide. These works were to have been entirely funded by Development Charges. After the approval of the 2007 budget however, Council subsequently approved a streetscape implementation plan that provided for a 3 metre wide sidewalk. Under normal circumstances the costs associated with a 3 metre wide sidewalk, as opposed to a 1.5 metre sidewalk would have been approximately $120,000.00. However, by taking advantage of the developers need to get these works done before winter conditions set in, we were able to have the works constructed at a cost of $82,000.00, excluding GST but including engineering fees. The savings of approximately $38,000.00 were made possible because we were able to take advantage of unusually competitive unit prices. The 2006 project has been completed and had unspent funds of approximately $20,000.00, which are Development Charge funds can be utilized to cover the additional funds associated with the phase 2, Highway #2 sidewalk works. REPORT NO.: EGD-059-07 PAGE 5 CONCLUSION It is my recommendation that the funds required in the amount of $82,000.00 to finance the cost of the Highway #2 streetscape implementation plan, be drawn from the Capital account #11 0-32-331-83278-7410. As stated earlier, $62,000.00 was already covered as part of the 2007 Capital Budget. The additional $20,000.00 can be covered using the unexpended funds remaining from the 2006 Highway 2 sidewalk project. The Director of Finance has reviewed the funding requirements and concurs with the recommendation. Attachments: Attachment #1 - Key Map Interested parties to be advised of Council's decision: D.G.
