HomeMy WebLinkAbout97-17 t� THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW #97-17 being a by-law to designate the property known for municipal purposes as 4478 Highway 35/115, Part Lot 29, Concession 4, former Township of Clarke, now in the Municipality of Clarington as a property of historic or architectural value or interest under the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18 WHEREAS the Ontario Heritage Act, R.S.O. 1990, C.0.18 authorizes the council of the municipality to enact by-laws to designate properties to be of historic or architectural value or interest for the purposes of the Act; and WHEREAS the Council of The Corporation of the Municipality of Clarington has caused to be served upon the owner of the property known for municipal purposes as 4478 Highway 35/115, Orono and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such Notice of Intention to be published in the Orono Times, a newspaper having general circulation in the area of the designation on December 4, 1996; and WHEREAS the reasons for the designation of the aforesaid property under the Ontario Heritage Act are contained in Schedule "A" attached to and forming part of this by-law; and WHEREAS the Local Architectural Conservation Advisory Committee of the Municipality of Clarington has recommended that the property known for municipal purposes as 4478 Highway 35/115, Orono be designated as a property of historic or architectural value or interest under the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation was served upon the Clerk within the period prescribed by the Ontario Heritage Act; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. The property known for municipal purposes as 4478 Highway 35/115, Orono which is more particularly described in Schedule "B" which is attached to and forms part of this by-law, is hereby designated as a property which has historic or architectural value or interest under Section 29 of the Ontario Heritage Act, R.S.O. 1990, C.0.18. 2. The Solicitor for the Municipality of Clarington is hereby authorized to cause a copy of this by-law to be registered against the title to the property described in Schedule "B" hereto. 3. The Clerk is hereby authorized to cause a copy of this by-law to be served upon the owner of the property described in Schedule "B" hereto and on the Ontario Heritage Foundation. The Clerk also is authorized to cause notice of the passing of this by-law to be published in the Orono Times, a newspaper having general circulation in the area of the designation. By-law read a first and second time this 27th day of January 1997. By-law read a third time and finally passed this 27th day of January 1997. MAYOR CLERK SCHEDULE "A" TO BY-LAW #97-17 This Italianate house was built in 1880 for G.M. Long. Long ran a general store in Orono, was a leader of the Methodist choir and served on the Orono Town Council. Its Italianate composition is evident through its low-pitched hipped roof, wide overhanging eaves, buff-brick hood mouldings and heavily carved wooden brackets. It is recommended for designation under the Ontario Heritage Act for the following architectural features: Exterior • the original brick facade • the buff-brick hood-moulding and window trim • the heavily carved eave brackets • the paired window brackets • the original front verandah Interior • the wooden baseboards, wainscotting, door and window trim • the pine floors • the living room plaster cornicing and medallion • the staircase with its newel post, railing and decorative scrolls • the double front door with its arched windows and transom SCHEDULE "B" TO BY-LAW#97-17 In the Municipality of Clarington, in the Regional Municipality of Durham (formerly the Township of Clarke, in the County of Durham) in the Province of Ontario and being composed of part of Lot 29, Concession 4, in the said Municipality of Clarington and more particularly described as follows: COMMENCING at a point in the southern limit of the north half of the said Lot 29, distant 235 feet measured westerly along the said southern limit from its intersection with the western limit of the King's Highway as shown on Department of Highways, Ontario Plan P-2390-13 registered in the Registry Office for the Registry Division of Newcastle as No. 16260; THENCE north 17 degrees 49 minutes 30 seconds west 186 feet; THENCE easterly and parallel to the aforesaid southern limit of the north half of Lot 29 a distance of 235 feet more or less to the aforesaid western limit of the King's Highway; THENCE south 17 degrees 49 minutes 30 seconds east 186 feet, more or less to the aforesaid southern limit of the north half of the said Lot 29; THENCE westerly along the said southern limit, 235 feet more or less to the point of commencement. BEARINGS herein are referred to the western limit of King's Highway shown as north 17 degrees 49 minutes 30 seconds west on the aforesaid Department of Highways, Ontario, Plan registered as No. 16260.
