THE CORPORATION OF THE 'IDWN OF NEWCASTLE
By-Law No. 78-96
A by-law to authorize the entering into all Agreanent
with Louis Aldrovandi, Lino Aldrovandi and Guido Bruni
The Council of the Corporation of the Town of Newcastle
hereby enacts as follows:
'IHAT the :Mayor and Clerk are hereby authorized to execute
on behalf of the Corporation of the Town of Newcastle, and
seal with the Corporate Seal an Agreanent between
Louis Aldrovandi, Lino Aldrovandi and Guido Bruni
and the said Corporation dated 29th day of September 1978,
which is annexed hereto on Schedule "A".
READ a first, second and third tTIne and finally passed this
10th Day of October 1978.

Hereinafter called "The Municipalityff
OF THE FIRST PART,

LOUIS ALDROVANDI, LINO ALDROVANDI,
AND GUIDO BRUNI,
Hereinafter called "The Partiesff
OF THE SECOND PART.
WHEREAS the parties of the second part are the registered
owners of Part of Lot 24, in the Broken Front Concession of the
Township of Darlington, now in the Town of Newcastle;

AND WHEREAS the parties of the second part have applied
for a building permit on the subject property being part of Lot
24 in the Broken Front Concession of the former Township of Darlington,
now in the Town of Newcastle to permit the construction of an
industrial building to be occupied and used by Aldrovandi Equipment
Limited carrying on business as Mainline Construction Equipment,
for the carrying on of its business.
AND WHEREAS that portion of Solina Road lying being the
Base Line and Highway 401, is in need of repair;
AND WHEREAS the Municipality and the parties of the second
part have agreed to share the cost of improvement equally and such
costs are estimated at $32,000.00.
NOW THEREFORE this agreement witnesseth that:
1. Louis A1drovandi, Lino A1drovandi and Guido Bruni shall pay

to the Town of Newcastle the sum of $16,000.00 upon the execution
of this agreement.

2. The Municipality shall, as soon as it is practical after
the execution of this agreement, improve that portion of Solina Road
lying between the north limit of Highway 401 and the south limit of
Base Line Road to permit the passage of vehicular traffic.
3. In the event that any of the lands lying to the north of
the Canadian Pacific Railway Company lands and to the east but
abutting the aforemen~ioned portion of Solina Road are developed,
the Municipality agrees to pay to the parties of the second part,
upon the issuance of a building permit to such developer, a sum
equal to that proportion of the sum of $12,800.00 that the frontage
of the lands to be developed bears to the distance of 946.44 feet.
Provided, however, that if the aforementioned lands are developed
by more than one owner, the sums to be paid by the Municipality to
the parties of the second part shall only be paid upon the issuanc-
of such subsequent or further building permits a~d the amount to be
paid by the Municipality to the parties of the second part shall
not exceed in the aggregate the sum of $12,800.00 and at no time
shall any funds payable by the Municipality to the parties of the
second part bear interest.
4. In the event that a local improvement assessment is made
for the improvement of the aforementioned portion of Solina Road,
the parties of the second part shall be deemed by this agreeement
and by the payment of $16,000.00 to the Municipality, to have

commuted and prepaid all local improvement charges pertaining
to the said improvement of Solina Road.
IN WITNESS WHEREOF the Municipality of the First Part has
hereto hereunto affixed its corporate seal under the hands of its
duly authorized officers.
