HomeMy WebLinkAbout78-9 .- .. -- THE CORPORATION OF THE TOWN OF NEWCASTLE By-Law No. 78-9 Being a by-law to authorize the sale of part of Smart Avenue lying between Highway 401 and the Base Line in the Town of Newcastle (formerly in the Town of Bowmanvi11e) to an abutting owner. WHEREAS By-law 76-65 of The Corporation of the Town of Newcastle stopped up and closed a part of Smart Avenue lying between Highway 401 and the Base Line, in the Town of Newcastle (formerly in the Town of Bowmanvi11e) and authorized its sale to abutting owners; AND WHEREAS Zichy-Thyssen Real Estate Limited is an abutting owner of the property more particularly designated as Part 3 according to Plan 10R-661; AND WHEREAS Zichy-Thyssen Real Estate Limited wish to acquire the aforesaid property at a purchase price in the amount of $10,125.00; NOW THEREFORE BE IT ENAC1ED and it is hereby enacted as a By-law of the Corporation of the Town of Newcastle: 1. The property hereinafter described be conveyed to Zichy-Thyssen Real Estate Limited for a total consideration of $10,125.00. ALL AND SINGULAR that certain parcel or tract of land and premises situate lying and being in the Town of Newcastle, Regional Municipality of Durham, Province of Ontario, and being composed of all that portion of Smart Avenue as shown on the Smart Estate Plan of part of Township Lot Nine (9) in the Broken Front Concession of the Geographic Township of Darlington, formerly in the Town of Bowmanvi11e, County of Durham, more particularly designated as Part Three (3) according to Plan 10R-6~1, deposited in the Land Registry Office for the Registry Division of Newcastle (No. 10) on October 1st, 1976. 2. The Mayor and Clerk are hereby authorized to execute a deed conveying th the aforesaid property to Zichy-Thyssen Real Estate Limited. By-Law read a first By-Law read a third time and ~
