THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 78-73
A By-law to amend Restrictred Area By-law Number 2111 of the former
Township of Darlington, as amended.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend Restricted Area By-law Number 2111, as amended, of the
former Township of Darlington.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS
as follows:
1.
Section 4(t) of By-law 2111, as amended, is hereby further amended
by adding to subsection tal the following:
II In addition , the use of a mobil e home on a lot for .
Resi dentia 1 purposes may be permi tted by Council on a
temporary basis,for a period not to exceed six months,
while a permitted single family dwelling is under construction,
provided that said mobile home shall be removed from the said
lot immediately after the expiration of this six month period
or the occupation of the new single family dwelling, whichever
occurs first. II

Section 5 of By-law 2111, as amended, is hereby further amended
by addi ng to Subsection (C) the fo 11 owi ng sentence:
"However, the continued use of an existing dwellfng on a lot for
Residentia.l purpos-es may lie permttted 5y- Counci:l on a
temporary basis while a second single family dwelling is under
construction, provided that the existing dwelling may only
be used for this purpose for a period of six months commencing
from the date construction is begun on the second dwelling, and
provided further that the existing dwelling shall be demolished
immediately upon the expiration of this six month period or
the occupation of the new dwell i ng, whi chever occurs fi rst. II

3. Section 11 of By-law 2111, as amended, is hereby further amended by
adding to Subsection (c) the following sentence:
IINotwithstanding any provision of this section to the contrary,
the continued use of an existing dwelling on a lot for residential
purposes may be permitted by Counci'l on a temporary bas i s whi 1 e a
second single family dwelling is under construction, provided that the
existing dwelling may only be used for this purpose for a period of
six months commencing from the date construction is begun on the
second dwelling, and provided further that the existing dwelling
shall be demolished immediately upon the expiration of this six
month period or the occupation of the new dwell i ng, whichever occurs
first.1I
4. This By-law shall come into effect on the date hereof, subject to
receiving the approval of the Ontario Municipal Board.
