HomeMy WebLinkAbout78-70 . . . 1/ t THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NO. 78-70 A By-law to amend Restricted Area By-law Number 2111, as amended, of the former Township of Darlington WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law Number 2111 of the former Township of Darlington. NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS as follows: 1. Section 7, Subsection (d) of By-law 2111, as amended, is hereby further amended by adding thereto the following subsection (5): (5) C2-4 Part of Lot 10, Concession 4 Notwithstanding any provision of this By-law to the contrary, the parcel of land located in Lot 10, Concession 4, and designated C2-4 on Schedule "A" hereto shall be used only for the purpose of a farm implement dealership, including the outside display of farm implements, provided that no building may be erected or used except in accordance with the following provisions: (a) lot frontage (mi nimum) 500 feet (b) lot area (minimum 4 acres (c) lot coverage (maximum) 25% (d) front yard (minimum) 70 feet (e) sideyard (minimum) 25 feet (f) rear yard (minimum) 35 feet (g) building separation (minimum) 10 feet . e . . '! 2 - (h) buil ding hei ght (maximum) 30 feet (i) parking spaces (minimum) 1 for each 50 feet of gross floor area or portion thereof. (j) loading spaces (minimum) 2 (k) Development Agreement - Notwithstanding any provision of the Building By-law or any other By-law of the Town of Newcastle to the contrary, no building permit shall be issued in respect of the subject lands until the owner of said lands has entered into a development agreement as described in Section 35(a) of the Planning Act with the Corporation of the Town of Newcastle. 2. Key Map 19 of Schedule "A" to By-law 1587, as amended, is hereby further amended by changing to C2-4 the zone designation of the lands shown as "zone change to C2-4" on the attached Schedule "X" hereto. 3. This By-law shall come into effect on the date hereof, subject to receiving the approval of the Ontario Municipal Board. BY-LAW READ a first time this 23rcflayof October ' A.D. 1978.
