WHEREAS the Council of the Corporation of the Town of Newcastle enacts as follows:- 1) The Corporation of the Town of Newcastle hereby adopts and enters into Supplementary Agreement No. 3 with Ontario Hydro and the Regional Municipality of Durham, a copy of which is annexed hereto as Schedule "A". 2) The Mayor and the Clerk of the Corporation of the Town of Newcastle are hereby authorized and directed to sign the Supplementary Agreement No. 3 and to place thereon the seal of the Corporation. BET WEE N: ONTARIO HYDRO Hereinafter referred to as the "CORPORATION" OF THE FIRST PART and - THE REGIONAL MUNICIPALITY OF DURHAM Hereinafter referred to as the "REGION" OF THE SECOND PART - and - THE CORPORATION OF THE TOWN OF NEWCASTLE Hereinafter referred to as the "TOWN" OF THE THIRD PART WHEREAS the Corporation and the Town have entered into an agreement (herein- after referred to as the Newcastle Agreement) with respect to the social, econo~icand financial impacts arising out of the construction and operation of the Darlington Generatlng Station (hereinafter referred to as the Station) on the Town, dated March 22, 1977; 2. ~ ~ ~ AND WHEREAS the Corporation, the Region and the Town have entered into an ~ agreement (hereinafter referred to as the Regional Agreement) with respect to the social, economic and financial impacts arising out of the,construction and operation of the Station ~n the Region and the Town, dated August 5, 1977; AND WHEREAS the Newcastle Agreement and the Regional Agreement provide for the entering into of Supplementary Agreements between the Corporation, the Region and the Town; ~ e AND WHEREAS the Corporation has agreed to pay any increase in costs for im- proving and maintaining roads and bridges reasonably required as the result of the increase in traffic from the travel of construction workers and the transportation of materials to and from the Station; AND WHEREAS The Corporation, the Region and the Town have agreed to partici- pate in a process of monitoring the impacts of the construction of the Station; AND WHEREAS The Corporation, the Region and the Town are desirous of entering into a Supplementary Agreement dealing with the monitoring of the impacts on the roads and bridges as referred to above. NOW, THEREFORE, WITNESSETH that in consideration of the covenants hereinafter contained and for other good and valuable consideration, the Corporation, the Region and the Town hereby agree as follows: . - "' ~~- / 3. '. 1. The Corporation, the Region and the Town agree that the monitoring of the impacts on roads and bri9ges shall be entitled the Transportation Impact Monitoring Program and shall involve the monitoring of changes ~ in the use and condition of certain r'oads, road junctions, bridges, . \ culverts and any appurtenances therto, lying within the Region of Durham (hereinafter referred to as the transportation facilities). 2. The Corporation, the Region and the Town agree that the Transportation Impact Monitoring Program will include: a) the measurement of the existing traffic flows on the transportation facilities, and the identification of the users, structural conditions and capacities of the transportation facilities, in order to establish the "existing situation"; . b) the assembly and analysis of additional information relating to traffic flows, users, structural conditions and capacities to be carried out at regular intervals, in order to establish changes in the "ex- isting situation". 3. The Corporation, the Region and the Town agree that the work related to Paragraph 2 (a) above will be carried out in two phases, as follows: a) Phase 1, which will commence in October 1977, will establish the existing situation respecting those transportation facilities which will be used for the movement of materials and equipment associated with site preparation operations of the Station. . , ./ .'"'....;;./lC.."""''''...~'-...""''1'''.'''''''"".~...", :: 4. e r f b) Phase 2, which will commence in October 1977, will establish the existing situation respecting those transportation facilities .'. which will be~used'for the movement of employees associated with the site preparation operations and the movement of employees, materials and equipment associated with all other phases of the Station construction program. 4. The Corporation, the Region and the Town agree that the transportation facilities to be dealt with in Phase 1 and Phase 2 are as listed in Schedules IAI and IB1 respectively. These schedules may be amended at any time and from time to time by agreement of the parties as defined in Paragraph 11. e 5. The Corporation, the Region and the To~'n agree that the work related to Paragraphs 2 (a) and 2 (b) for Phases 1 and 2 shall be as follows: a) Traffic flows will be established by carrying out traffic counts at specific locations on roads shown on Schedules lA' and IB'. b} Truck and automobile users will be established by reference to standard tables which indicate the respective proportion of truck and automobile movements for non-urban areas supplemented by traffic counts to be carried out at specific locations on roads shown on Schedules 'AI and 18 I. ~ .... '. . , ~ e ;), '. c) The surface conditions of roads and bridges will be established by reference to the most recent condition surveys and roads needs studies in the possession of the Region and the Town supplemented by additional .>. condition surveys by agreement of the parties as defined in Paragraph 11. In addition, motion picture inspection techniques will be carried out for specific route segments detailed on Schedules lA' and 'B'. d) Below grade conditig~ of roads will be established by means of a review of actual construction drawings, and may involve the use of the deflection measurement method of analysis for specific route segments detailed on Schedules 'A' and 'B'. e) The structural conditions of bridges and culverts on the roads detailed in Schedules 'AI and 'B', will be ascertained by means of condition surveys and reviews of technical construction drawings. f) Capacities shall be established by means of road and intersection capacity analysis which shall consider surface widths, rights-of- way, road junctions and traffic control devices. 6. The Corporation, the Region and the Town agree that the work outlined in Paragraph 5 applies to both Phases 1 and 2 but that the degree of emphasis to be attached to the use of any specific technique for each " of Phases and 2 shall be by agreement of the parties as defined in Paragraph 11. ~--- .1 6. -, . The Corporation, the Region and the Town agree that the Region and the Town shall assemble the information as outlined in Paragraph 5 respecting those transportation fac{1ities within each of their jurisdictions and that the assembly of this information shall be carried out in a co-ordin- ated fashion. 8. The Corporation, the Region and the Town agree that all information collected shall be maintained and be made available to any of them in the office of the Director of Publ ic Works of the TOvln and the Commissioner of Works of the Region. e 9. The Corporation, the Region and the Town agree that following the completion of the establishment of the existing situation, all data will be reviewed and a statement of the existing situation will be prepared by the Town or by the Region responsible for the operation and maintenance of the roads under their respective jurisdictions, as set out in Schedules 'A' and '8'. Any transportation facilities requiring remedial action due to actual or anticipated Ontario Hydro activities relating to the construction and/or operation of the Station will be identified. Separate Supplementary Agreements and/or memoranda of understanding will be entered into between the Corporation, and the Region and/or the Town respecting the nature of any remedial work to be carried out and to the cost of such work. . The Corporation, the Region and the Town agree that the information gathered as a result of the Transportation Impact Monitoring Program shall serve ", ~.. \ as the basis for dealing with any claims for compensation for costs of improving and maintaining of the transportation facilities outlined in Schedules IAI and IB'. ..... 11. The Corporation, the Region and the Town agree that the words IIby agree- ment of the parties" as they appear in this Supplementary Agreement shall mean "with the written consent of the Project Manager, Darlington Generating Station; the Commissioner of Works of the Region; and the Director of Public Works of the Townll. ~ 12. The Corporation, the Region and the Town agree that any capital expenditures related to the purchase of equipment required to implement the Transportation Impact Monitoring Program shall be made by agreement of the parties as defined in Paragraph 11. 13. The Region and the Town agree that a budget. allocation for operating expenditures related to the Transportation Impact Monitoring Program will be prepared annually for each calendar year. It is further agreed that this budget shall represent an upset limit which will not be exceeded without prior approval of both parties. . WHEREAS the Council of the Corporation of the Town of Newcastle enacts as follows:- 1) The Corporation of the Town of Newcastle hereby adopts and enters into Supplementary Agreement No. 3 with Ontario Hydro and the Regional Municipality of Durham, a copy of which is annexed hereto as Schedule "A". 2) The Mayor and the Clerk of the Corporation of the Town of Newcastle are hereby authorized and directed to sign the Supplementary Agreement No. 3 and to place thereon the seal of the Corporation.
