THE CORPORATION OF THE
TOWN OF NEWCASTLE
BY-LAW NO. 78-31
being a by-law to authorize the execution
of the annexed agreement by the Mayor and
Clerk of the Corporation of the Town of
Newcastle.
WHEREAS the Corporation of the Town of Newcastle entered into
a subdivision agreement dated March 1st, 1973;
AND WHEREAS the Owner was required to provide temporary access
through Lots 9 and 31 on the Plan which was the subject matter of the
agreement;
AND WHEREAS the parties no longer consider it necessary for the
Owner to construct the aforesaid temporary access road;
AND WHEREAS the Owner has agreed to construct a permanent
walkway on Block 8 on Plan 705.
NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED as a By-law
of the Corporation of the Town of Newcastle as follows:
1.
THAT the Corporation of the Town of Newcastle enter into an agreement
with Mutt Enterprises Limited and York River Heights Limited, carrying
on business under the style and firm name of BOWMANVILLE HEIGHTS, in
accordance with the terms of the agreement annexed hereto and dated
January 23rd, 1978.
2. THAT the Mayor and Clerk of the Corporation of the Town of Newcastle
are hereby authorized to sign the agreement and affix the Corporate
Seal of the Town.
BY-LAW read a first, second and third time and finally passed this
24th day of April, 1978.

1978.

MUTT ENTERPRISES LIMITED, a company incorpor-
ated under the laws of the Province of Ontario,
having its head office in the City of Toronto,
in the Municipality of Metropolitan Toronto,
and YORK RIVER HEIGHTS LIMITED, a company
incorporated under the laws of the Province of
Ontario, having its head office in the City of
Toronto, in the Municipality of Metropolitan
Toronto, carrying on business under the style
and firm name of BOWMANVILLE HEIGHTS,
hereinafter called the "Owner"
OF THE ONE PART
-and-
THE CORPORATION OF THE TOWN OF NEWCASTLE
hereinafter called the "Town"
-and-
THE PUBLIC UTILITIES COMMISSION OF BOWMANVILLE
OF THE OTHER PART
WHEREAS the parties entered into a subdivision
agreement dated the 1st day of March, 1973;
AND WHEREAS the Owner was required pursuant to
the aforesaid agreement to provide a temporary access through
Lots 9 and 31 on the Plan leading westerly from Waver ley Road
to Rhonda Boulevard;
AND WHEREAS the parties hereto no longer
consider it necessary for the Owner to construct the aforesaid
temporary access;
AND WHEREAS the Owner has agreed to construct
a permanerit walkway on Block 8 Plan 705 in lieu of the aforesaid
temporary access;
AND WHEREAS the parties hereto consider it
desirable to enter into this agreement to give effect to the
aforesaid understanding.

NOW WITNESSETH that in consideration of the
mutual covenants contained herein, the parties hereto covenant
and agree one with the other as follows:
1.
The agreement made between the parties hereto
dated the 1st day of March, 1973, be and the same is hereby
amended by deleting the provisions of paragraph 43 hereofl
and the Owner be and the same is hereby relieved from con-
structing the temporary access through Lots 9 and 31 Plan
705 and the Owner shall be at liberty to apply for building
permits for each of the aforesaid lots at such time as the
Owner has complied with the provisions of paragraph 2
hereof.
2.
The Owner shall instal a permanent walkway
together with a chain link fence across Block 8 Plan 705
in accordance with the specifications set out in Schedules
"A" and "B" hereto annexed.
3. Upon satisfactory completion of the install-
ation of the aforesaid walkway and chain link fence the
Director of Public Works shall issue to the Owner a certif-
icate of preliminary approval of the installation and the Owner
shall guarantee the workmanship and materials, and shall make
good all defects due to faulty workmanship and materials during
the period of one year from the issuance of such certificate,
provided that the Town may at its option make arrangements
for the emergency repair of any defect and inform the Owner
of such action, provid~d that the cost of such emergency
work shall be borne by the Owner.
4.
The Owner shall pay to the Town the sum of
$10,000.00 at the time of the execution of this agreement.
5.
Save as amended herein all other terms of the
agreement dated the 1st day of March, 1973, shall remain in
full force and effect and time shall remain of the essence.

6.
The Owner hereby agrees to reimburse the Town
for all legal fees incurred by the Town in the preparation
of this amending agreement.
IN WITNESS WHEREOF the parties have hereunto
affixed their corporate seals attested by the hands of their
proper officers in that behalf duly authorized.
