TOWN OF NEWCASTLE
BY-LAW NO. 78-24
A By-Law to amend restricted zoning by-law 77-17
WHEREAS the Council of the Corporation of the Town of Newcastle passed
By-Law 77-17 on the 21st day of March, 1977, for the purpose of amending by-law
1653, as amended, of the former Township of Clarke.
AND WHEREAS the purpose and intent of by-law 77-17 was to allow for the
construction of lISenior Citizens Row Dwelling Houses" on property being part of
Lot 29, Concession 5, former Township of Clarke, now Town of Newcastle, which
property was set out on Schedule X to By-law 77-17 as lIZoning Change to Rl-l".
AND WHEREAS the acreage and dimension of said property are as reflected on
Schedule X of By-law 77-17;
AND WHEREAS Section 5 of By-law 77-17 sets out sub$ection 3 of By-law 1653
as amended, as requiring under subsection 3(a) a lot frontage of 800 feet for
Senior Citizens Dwelling Houses;
AND WHEREAS the reference to 800 feet on the face of by-law 77-17 was
established by way of inadvertance, as the property set out on Schedule X to
By-law 77-17 did not at the time of the passing of By-law 77-17 and does not
have a frontage of 800 feet.
AND WHEREAS the frontage of said property along Station Street is and was at
the time of passage of By-law 77-17, 487 feet;
AND WHEREAS the following amendment does not in any way affect the dimension,
location, or area of the lands intended to be rezoned by by-law 77-17, but is
intended to correct the erroneous illusion to the 800 feet frontage requirement and

~ give effect to Council for the Corporation of the Town of Newcastle's intention
to rezone those specific lands as set out on Schedule X of By-law 77-17 to permit
the usage of said lands for Senior Citizens Row Dwelling Houses.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS AS FOLLOWS:
1. Section 5 of by-law 77-17 be amended by deleting therefrom under
the reference to subsection 3(a) of appendix 1 to by-law 1653, the
words
a) "lot frontage minimum BOO feet" and adding thereto in place of
the deleted wording
a) "lot frontage (minimum) 487 feet.
2.
This by-law shall become effective on the date hereof, subject

to receiving the approval of the Ontario Municipal Board.
THIS BY-LAW READ A FIRST AND SECOND TIME, this 7th day of April, 1978
BY-LAW READ A THIRD TIME AND FINALLY PASSED this 7th day of April 1978.
