THE CORPORATION OF THE TOWN OF NE~WCASTLE BY-LAW NO. 78-21 ~ being a by-law to permit MOtor Racing within MOsport Park after 1:30 o'clock in the afternoon of the Lord's Day ; WHEREAS the Lord's Day (Ontario) Act, Chapter 259, R.S.O. 1970 with amendments thereto, provides that where a by-law passed under Section 1 of the said Act is in force and subject to its provisions, it is lawful in the municipality or in such part or parts thereof as are specified in the by-law, for any person, after 1:30 in the afternoon of the Lord's Day or during such period or periods of time after 1:30 o'clock 1n the afternoon of the Lord's Day as are specified in the by-law, to provide engage in or be present at any public game or sport that is specified 1n the by-law and which but for this Act would be unlawful under section 6 of The Lord's Day Act (Canada) or to do or engage any person to do any work business or labour 1n connection with any such public game or sport which but for this Act would be unlawful under section 4 of the Lord's Day Act (Canada) 1960-61, c. 50, S.l. (1). NOW THEREFORE The Council of The Corporation of the Town of Newcastle hereby enact~ as follows: (1) That Section I, S.s (1) of the Lord's Day (Ontario) Act, Chapter 2~9, R.S.O. 1970 with amendments thereto, is hereby declared to be in force from the first (1st) day of January, 1978, to the thirty-first (31st) day of December, 1978 in the area hereinafter defined. e (2) Lands Subject to By-Law Lots 33, 34 and 35, Concession 9, Geographic Township of Clarke, Town of Newcastle Region of Durham, and more specifically described as MOSPORT PAPK. (3) Specified Public Game or Sport Racing for Motor vehicles. (4) Compliance with other restricUons This by-law shall not be effective to reduce or mitigate any restrictions lawfully imposed by a governmental authority having jurisdiction to make such restrictious. . .. ',,' , , ~, . - 2 - By-Law 78-21 (5' By-Law Provisions The Public games and sports described in Section three (3) of this by-law shall be conducted in accordance with the following provisions: (i) No such game or sport shall be commenced before half past one in the afternoon of The Lord's Day and shall not continue after half past eleven in the evening of The Lord's Day. (ii) No such game or sport shall continue into Sunday from the previous day. (iii) Every such game or sport shall be conducted in an orderly and seemly manner. (iv) No such game or sport shall be held unless such game or sport is in accordance with a schedule of Sunday games or sports, approved by resolution of Council. (v) Every such schedule of Sunday games or sports, as approved by resolution of Council, shall be published in such newspaper as determined by Council from time to time, not less than two weeks prior to the scheduled date of each Sunday game or sport. (6) Violations and Penalties Every person who violates any prOV1S10n of this By-law or causes or permits a violation, shall be guilty of an offence and upon conviction therefor. shall forfeit and pay a penalty not exceeding One Thousand Dollars ($1,000.00) exclusive of costs for each such offence, and every such penalty shall be recoverable under The Municipal Act and The Summary Conviction Act. . (7) Repeal of By-Laws By-Law 77-4, passed by the Council of the Town of Newcastle on the 4th day of April, 1977 is hereby repealed.
