By-Law No. 78-101
Being a by-law to autho~ize the ente~ing
into an Ag~eement with The Cent~al Lake
Onta~io Con~e~vation Autho~ity.
The Council of the Corporation of the Town of Newcastle
hereby enacts as follows:-
I
THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and
seal with the Corporate Seal an Agreement between The Cent~al
Lake Onta~io Con~e~vation Autho~ity and the said Co~po~ation
dated 23rd day of October, 1978, which is annexed hereto on
Schedule "A".
READ a first, second and third time and finally
passed this 31st day of October, 1978.

OF THE FIRST PART,

CENTRAL I~AKE ONTARIO CONSERVATION AUTHORITY,
herein called the AUTHORITY
OF THE SECOND PART.
~EREAS the Authority has granted a construction permit to the Parties
of the First Part to construct a storage building on Part Lot 10, B.F. Concession, Town'
of Newcastle (Bowmanvi 11e) subject to their execution of the agreement
herein set out.
WITNESSETH that in consideration of the premises the Parties of the
First Part jointly and severally convenant and agree with the Authority
1. To indemnify the Authority and Her Majesty the Queen in right of the
Province of Ontario from and against all claims, damages and costs whatsoever incurred
by the Authority or by Her Majesty the Queen in right of the Province of Ontario in
_the event of flood damage to the property of the Parties of the First Part subsequent
,.,to the issuance of the permit aforesaid and including any claim for personal or
" property damage made by any person or coproration for which the Authority and/or Her
Majesty the Queen in right of the.Province of Ontario is liable.
2. The Authority and/or Her Hajesty the Queen in right of the Province of
Ontario shall obtain the approval of the Parties of the First Part to any sett1emen t
or compromise respecting any such claim.
3. Th~s agreement shall ensure to the benefit of and be binding upon the
parties hereto and their respective successors and assi~ls.
