THE CORPORATION OF THE TOWN OF NEWCASTLE

BY-LAW # 77 -- 'It
being a by-law to recommend to the Minister
for an order to rectify and correct any
deficiency or irregularity in the title to
part of Lot 8, Concession 3, Town of New-
castle (formerly Township of Clarke).
WHEREAS certain lands in the Town of Newcastle, in the
Regional Municipalty of Durham (formerly in the Township of
Clarke, in the County of Durham) being part of Lot 8, Con-
cession 3 of the said Township, were described as containing
by admeasurement ten and eight one-hundredths (10.08) acres
be the same more or less, as shown on Parcel 3 on a Plan of
Survey made by Robert p. Leeper, O.L.S. and dated March 2,
1968;
AND WHEREAS relying on the said recital the lands were
reganded as a validly created 10 acre parcel of land under
the laws of the Province of Ontario as they then existed;
AND WHEREAS ithas: now been ascertained that the said survey
was in error in that it did not properly take into account
certain lands acquired by the Corporation of the United
Counties of Northumberland and Durham in or about the 23rd
day of July, 1948, which lands were acquired from the then
owner, Bertha Maude Reid, Grantee of Instrument No. 14971,
registered the 19th day of November, 1948;
AND WHEREAS the error has gone undetected until recent times;
AND WHEREAS the deficiency in land area puts the question of
title to the lands held by subsequent owner, who, without
notice and for good and valuable consideration, acquired the
said lands relying on the defective survey;
AND WHEREAS it is now deemed expedient to recommend to the
Minister that an Order be made by him under Section 29a of
The Planning Act, the purpose of such order to be to fully

rectify and correct any deficiency or irregularity in title
caused by the said deficient survey;
NOW THEREFORE BE IT ENACTED:
THAT the Minister of Housing is hereby requested to make an
order under Section 29a of The Planning Act in respect of the
lands described in Schedule "A!l attached hereto and forming
part of this by-law.

SCHEDULE "A I'
