THE CORPORATION OF THE TO~~ OF NEWCASTLE By-Law Nc. 77-9 Being a by-law to stop up and close and authorize the conveyance of part of Mearns Avenue lying between Highway 401 and the Base Line, in the Town of Newcastle (formerly in the Town of Bowmanville). WHEREAS the Council of the Corporation of the Town of Newcastle deems it desirable to pass this by-law; AND WHEREAS notice of intention of the Council to pass the said by-law in accordance with the requirements of Section 446 of The Municipal Act, R.S.O. 1970, Chapter 284 was published in the Canadian Statesman on the following dates: February 2nd, 1977 February 9th, 1977 February 16th, 1977 February 23rd, 1977 AND WHEREAS notice of the intention of the Council to pass this by-law was sent by registered mail to the Regional Mu~icipality of Durham, on the 28th day of January, 1977 and the Regional Council has g~a~ted its approval to the proposed by-law; NOW THEREFORE BE IT ENACTED and it is hereby enacted as a By-law of the Corporation of the Town of Newcastle as follows: 1. Those portions of Mearns Avenue hereinafter described are hereby stopped up and closed: ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Newcastle, in the Regional Municipality of Durham, Province of Ontario and being composed of all that portion of the original side line road allowance between Township Lots eight (8) and nine (9) in the Broken Front Concession of the former Town of Bowmanville, more particularly designated as Parts One (1), Two (2), and Three (3) according to Plan lOR-672 deposited in the Land Registry Office for the Registry Division of Newcastle (110) on November 10, 1976. 2. Those portions of Mearns Avenue hereinbefore described shall be conveyed by the Corporation of the Town of Newcastle to abutting owners. By-Law read a first time this 7th day of March, 1977.
