THE CORPORATION OF THE TOWN OF NEWCASTLE
By-law Number 77-8
Being a by-law to amend Zoning By-law Number 1587 of the former
Town of Bowmanville (Participation House)
WHEREAS, the Council of the Corporation of the Town of Newcastle deems it
adviseable to amend By-law Number 1587 of the former Town of BOWmanville;
NOW THEREFORE, the Municipal Council of the Corporation of the Town of
Newcastle, pursuant to Section 35 of the Planning Act, R.S.O. 1970, Chapter
349, and amendments thereto, hereby ENACTS as follows:
1. By-law Number 1587 of the former Town of Bowmanville is hereby amended
by adding thereto the following Section 21B
Institutional 1-2 Zone:
SECTION 21B: INSTITUTIONAL 1-2 ZONE
No person shall within any Institutional I-2 Zone use any land or erect, alter
or use any building or structure except in accordance with the following prov-
isions:
21B. 1 Permitted Uses
a) A Charitable Institution for the resjdential accommodation,
education, employment, therapeutic treatment and recreation
of severely handicapped persons.
b) Uses, buildings and structures accessory to the foregoing
permitted use.
2IB. 2 Regulation for Charitable Institutions
a) Minimum Lot Frontage 400 feet
b) Minimum Lot Area 3 acres
c) Minimum Front Yard 50 feet
d) Minimum Side Yard 40 feet
e) Minimum Rear Yard 25 feet
f) Maximum Lot Coverage 25%
g) Maximum Height of Building- 35 feet
2. Section 7.16 of By-law Number 1587 is hereby amended by deleting from item
11 of the table entitled "Minimum Parking Requirements for Certain Ur- 'Js"
the words "Public or private hospitals and nursing homes" and substituting
therefore the words "Public or private hospitals, nursing homes, and
charitable institutions."

3. Section 7.17 of By-law Number 1587 is hereby amended by adding to the
table entitled "Minimum Loading Requirements" the following item
4: Charitable Institutions ~- 2 loading spaces
4. Section 7.22(a) of By-law 1587 is hereby amended by adding the words
"1-2 Institutional" immediately below the words "1-1 Institutional"
5. Map 1 of Schedule "A" to By-law Number 1587 is hereby amended by changing
to 1-2 the zone designation of the lands indicated "ZONE CHANGE TO 1-2"
on the attached schedule "X" hereto.
6. No part of the By-law comes into force without the approval of the Ontario
Municipal Board, but subject to such approval, this By-law takes effect
on the date hereof.
