THE CORPORATION OF THE
TOWN OF NEWCASTLE
BY-LAW NO. 77-70
being a by-law to establish certain policies
and benefits for employees not covered by the
Union Agreements
WHEREAS it is deemed expedient to establish working conditions, sick
leave benefits, annual vacations, statutory holidays and other benefits
for the employees of the Town of Newcastle who are not covered by a Union
Agreement;
THEREFORE, the Council of the Corporation of the Town of Newcastle
ENACTS AS FOLLOWS:
l. Hours of Work
The Hours of Work shall be as follows:
Office Personnel
- Monday through Friday
8:30 a.m. to 5 p.m. with
one hour off for lunch
Works Superintendent
Works Foremen
Purchasing Agent &
Shop Foreman
Note:
- 7 a.m. to 3:30 p.m. with
~ hour off for lunch
- 8 a.m. to 4:30 p.m. with
~ hour off for lunch
- 40 hours per week at times
arranged with Director of
Parks & Recreation
- 40 hours per week
8 a.m. to 5 p.m. with 1
hour off for lunch
The Dog Pound is open from 8 a.m. to 12 noon
on Saturday with the employee on duty taking
Friday afternoon off.

2.
Probation Period
Each new employee will be on a probation period of six months.
3. Pa1 Days
Payment will be semi-monthly on the working day nearest the 15th
and the last working day of the month, except the pay days for the
Director of Public Works, Secretary of the Director of Public Works,
Public Works Foremen and Superintendents, who shall be paid bi-weekly.

4. Termination of Employment
Employment may be terminated on account of:

4. (a) Retirement
Employees other than Firemen shall retire at age 65 and Firemen:
at age 60, except for the Fire Chief.

abolition of job or reduction of staff at
the discretion of Council.

5. Medical Examination
New employees shall be subject to medical examination.
6. Employee Grievances
Salaried employees are free at any time to discuss a personal
grievance with their Department Head. If not satisfied, they
may ask for an interview with the Personnel Committee and
failing satisfaction, Council.
7.
Employee Benefits
(a) Vacations
Salaried Employees viII receive the following vacations:
Employees who have completed one (1) year of continuous service
will be allowed two (2) weeks vacation with pay.
Employees who have completed five (5) years or more service will
be allowed three (3) weeks vacation with pay.
Employees who have completed eleven (ll) years or more service
will be allowed four (4) weeks vacation with pay.
Employees who have completed twenty (20) or more years of
service will be allowed five (5) weeks vacation with pay.
Vacation periods will be on the basis of Seniority.
Vacation to be taken within the calendar year except with special
permission of Council.

(b) Statutory Holidays
Days listed hereunder will be recognized as statutory holidays
without loss of pay provided the employee completes the work day
immediately prior to, and the day following the holiday unless
otherwise approved by the Council. The holidays are:
New Years Day
Good Friday
Victoria Day
Dominion Day
Civic Holiday
Labour Day
Remembrance Day
Thanksgiving Day
Christmas Day
Boxing Day
and any other holiday proclaimed by the Federal or Provincial
Governments, also one other day during the year to be taken at the
discretion of the Department Head. In the event any of the above days
fall on a Saturday or Sunday, another day shall be granted.

(c) Leave of Absence
i) Each person shall be allowed 3 days leave of absence, with pay
in the event of a death of a member of the immediate family (fathert
mother, brother, sister, wife, son, daughter, husband, father-in-law,
or mother-in-law). One day shall be allowed to attend the funeral of
a brother-in-law or sister-in-law or grandparent.
ii) An employee called for jury duty or as a witness in any court
will be granted leave of absence without loss of pay for the duration
of such jury duty less any fee paid for the service and subject to the
Clerk of the Court certifying same.
iii) An employee will be allowed time off with or without pay by the
Department Head for one day or part of a day for a cause or purpose
which he considers appropriate.
iv) Leave of Absence without Pay - Leave of Absence for any other
period without pay t shall only be granted by Council.
(d) Pension Plan
From the date of employmentt employees will be enrolled in Canada
Pension Plan and the Ontario Municipal Employees Retirement System
as required by Statute.
(e) Hospital and Medical
The Town will pay 100% of Ontario Health Insurance Plan Premium.

(f) Group Insurance
After three months employment the Town will pay 100% of the premium
for Group Insurance based on one and one half times salary.
Drug Plan
After three months employment the Town will pay 100% of Drug Plan
approved by Council, which will be the 35~ per prescription Plan.

(g) Sick Leave Credit Benefits
The Town ahall establish as of January 1, 1974, a system of sick leave
credits as follows:
An employee who has completed the probationary period of employment
will be entitled to eighteen (18) days per year accumulative sick
leave, one and one half (1~) days per month at the regular rate of
pay which will be l!ccumulative to a maximum of two hundred and forty
(240) days. No credits shall be allowed to any employee in any
calendar month, who is absent from duty in that month, without
permission, except for sickness.
i) One half (~) of the unused accumulated days (not to exceed two
hundred and forty days) will be paid to the employee upon cessation
of employment after the employee has completed five years of service,
but only up to maximum allowed by The Municipal Act.
ii) If an empJoyee dies before retirement, one half (~) of the
unused accumulated days (not to exceed two hundred and forty days)
will be paid to his beneficiary but only up to the maximum allowed
by The Municipal Act.
iii) When claiming sick pay, an employee will, if required to do
so, furnish a doctor's certificate after the third day of illness.
iv) Any employee who qualified for sick leave pay shall receive
full pay so long as his or her credits last.
As of January 1, 1974, the following credits will be established
for former Employees of the Township of Darlington, the Township
of Clarke, Town of Bowmanville and Village of Newcastle:
Townships of Darlington and Clarke - balance at employee's credit
as of December 31, 1973.
Town of Bowmanville and Village of Newcastle - 3 days credit for
every year of service with a maximum credit of 30 days.

(h) Section 7 (d), (e), (f) and (g) will apply only to permanent
employees with the exception of Canada Pension Plan and Unemployment
Insurance.
(i) Workmens Compensation
An employee prevented from performing his regular work with the
Corporation on account of an occupational accident that is recog-
nized by the Workmens Compensation Board as being compensible
within the meaning of the Compensation Act, shall receive from
the Corporation the difference between the amount payable by the
Workmens Compensation Board and his net salary so long as he
remains on full compensation.

8. Mileage Allo~ance
Employees re~uested to use their own vehicles for business purposes
will be reimbursed at the rate of 22 cents per mile for all miles
travelled for thB Corroration with effect from July 1, 1977.
9. By-laws 74-89, 76-44, 76-74 and 77-62 and any By-law not consistent
with this By-law are hereby rep~aled.
BY-LAW READ A FIRST, SECOND AND THIRD TIME and finally passed this
