THE CORPORATION OF THE TOWN OF NEWCASTLE By-Law No. 77-49 A Being a by-law to authorize the Mayor and Clerk to execute a quit claim deed, under the corporate seal of the Town in favour of Zichy-Thyssen Real Estate Limited. WHEREAS the Corporation of the Town of Newcastle by deed of conveyance dated the 22nd day of September, 1975 and registered in the Registry Office for the Registry Division of Newcastle (No. 10) on the 9th day of January, 1976, as Instrument No. 76006, conveyed the lands referred to therein and which deed contained the following covenant, namely: AND the said grantee covenants and agrees to complete the construction of an industrial building having a floor area of not less than 30,000 square feet exclusive of office space on the above described land within one year from the date of closing and which building shall be in accordance with a site plan submitted to and approved by the grantor prior to construction being commenced. In the event that th~ said building is not constructed within the said period of one year from the date of closing, then in such event, the ownership of the land conveyed shall revert to the Grantor upon payment by the Grantor to the Grantee of 90% of the purchase price of $87,720.00 less the entire balance owing on any encumbrance against the property, including the mortgage being given back to the Town of Newcastle, and the Grantee shall, at the request of the Grantor and for purposes of greater assurance, execute a re-conveyance back to the grantor of the said land. AND WHER2AS the said Courtice Specialty Steels Ltd. by deed of conveyance dated the 13th day of January, 1976, and registered in the said Registry Office on the 11th day of February, 1976, as Instrument No. 76394 conveyed the lands to Zichy-Thyssen Real Estate Limited. AND WHEREAS the terms of the aforesaid covenant have been complied with. AND WHEREAS the owner of the land has requested the Town execute a quit claim deed to release the covenant. NOW THEREFORE BE IT ENACTED by the Council of The Corporation of the Town of Newcastle, as follows: 1. For the purpose of releasing the covenant and agreement made in a deed dated the 22nd day of September, 1975 and registered in the Registry Office for the Registry Division of the Town of Newcastle (No. 10) on the 9th day of January, 1976, as Instrument No. 76006, the Mayor and Clerk, on behalf of The Corporation of the Town of Newcastle, are hereby directed to execute a quit claim deed under the corporate seal of the Town in favour of Zichy- Thyssen Real Estate Limited, for the following lands and premises, namely: .....2 . - 2 - By-Law No. 77-49A ./ {' ALL AND. SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Newcastle, in ~he Regional MUnicipality of Durham, and being formerly in the Town of Bowmanville, in the County of Durham, and being composed of part of Blocks 10 and 13 as shown on the Smart Estate Plan by L.H. Shortt, P.L.S. being part of the original Township Lot 9 in the Broken Front Concession of the Geographic Township of Darlington and which said land is now more particularly described as Parts 4 and 5 shown on a Reference Plan lOR 276 deposited in the Registry Office on December 3, 1973, a photocopy of a portion of which is attached hereto.
