77-23
A By-law to amend Restricted Area By-law 1653, as amended, of
the former Township of Clarke
WHEREAS, the Council of the Corporation of the Town of Newcastle deems it advis-
able to amend Restricted Area By-law Number 1653, as amended;
NOW THEREFORE, the Council of the Corporation of the. Town of Newcastle ENACTS
as follows:
1. Section 9 of By-law 1653 is hereby amended by adding thereto the
following subsection 9.3 -
"9.3 SPECIAL PROVISIONS
(a) "OS-I" - Lot 28, Concession 5
Notwithstanding any provisions of subsections 3.11, 3.12,
9.1 or Appendix 2 of this by-law to the contrary, that
part of Lot 28, Concession 5 which is designated "OS-I" on
Schedule "A", may be used for the purposes of an arena and
grandstand in accordance with the fOllowing provisions:

. a) Lot Frontage (abutting Park Street) (minimum) 100 feet
b) Lot Area (minimum) 10,000 sq.ft.
c) Lot Coverage (maximum) 5% of the lot area
d) Front Yard (abutting Park Street) 20 feet
(minimum depth)
e) Rear Yard (minimum depth) 35 feet
f) Side Yard (minimum width) 10 feet
g) Setback (minimum distance from centre line 40 feet
of Park Street)
h) Height of Building (maximum) 40 feet
i) Location of Entrances:

The principal public entrance to the arena and
grandstand and all other entrances where
facilities are provided for the collection of
admission charges or tickets shall be located
in the southernmost wall of the arena or adjacent
to the southernmost wall of the grandstand.

(2)
j) Parking Requirements (minimum.)
the greater of:
(i) one parking space
for every 5 fixed seats
or ten feet of bench
space; or9
(ii) one parking space
for every 100 square feet
of floor area available for
public use exclusive of
areas occupied by fixed
seats or benches.
1) Location of Parking:
All required parking shall be located within
650 feet of the nearest public entrance to
the arena or grandstand."
2. Map 3 of Schedule "A" to By-law Number 1653, entitled "Detail of Orono
Police Village Area" is hereby amended by changing to OS-1 the zone
symbol of the lands designated "ZONE CHANGE TO OS-I" on Schedule "X"
hereto.
3. This By-law shall become effective on the date hereof, subject to rec-
eiving the approval of the Ontario Municipal Board.
