By-Law No. 76-72
Being a by-law to stop up and close and authorize
the conveyance of part of the road allowance between
Concessions 5 and 6 through Lots 1, 2 and 3,
Township of Clarke (now in the Town of Newcastle).
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
desirable to pass this by-law;
AND WHEREAS notice of intention of the Council to pass the said by-law
in accordance with the requirements of Section 446 of the Municipal Act, R.S.O.,
1970, Chapter 284, was published in the Newcastle Reporter on the
3rd Day of November, 1976

AND WHEREAS notice of the intention of the Council to pass this by-law
was sent by registered mail to The Regional Municipality of Durham, on the 25th
day of October, 1976, and the Reginnal Council has no objection to the proposed

NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF THE
CORPORATION OF THE TOWN OF NEWCASTLE AS FOLLOWS:
1. Those portions of the road allowance in the Town of Newcastle hereinafter
described are hereby stopped up and closed:
FIRSTLY
ALL AND SINGULAR that certain parcel or tract of land situate,
lying and being in the Town of Newcastle, Regional Municipality
of Durham, Province of Ontario, and being composed of all that
portion of the original allowance for road between Lots 1 and 2
in the Fifth Concession of the Geographic Township of Clarke and
Lots 1 and 2 in the Sixth Concession of the said Geographic Township
of Clarke, all formerly in the County of Durham, more particularly
described as follows:
COMMENCING at the north easterly angle of said Lot 1, Concession 5;
THENCE WESTERLY in and along the northerly limits of said Lots 1
and 2, in the Fifth Concession of the said Geographic Township of
Clarke to the north westerly angle of said Lot 2;

THENCE NORmERLY in the production of the westerly limit of
said Lot 2, Concession 5, to a point in the southerly limit
of Lot 2, Concession 6;
THENCE SOUTHERLY in and along the southerly limits of Lots 2
and 1, Concession 6, to the south easterly angle of said Lot 1,
Concession 6;
mENCE SOUTHERLY in a straight line to the point of commencement.
SECONDLY
ALL AND SINGULAR that certain parcel or tract of land situate,
lying and being in the Town of Newcastle, Regional Municipality
of Durham, Province of Ontario, and being composed of the
easterly 332.50 feet of the original allowance for road allowance
for road between Lot Three (3) in the Fifth Concession of the
Geographic Township of Clarke and Lot Three (3) in the Sixth
Concession of the Geographic Township of Clarke, southerly
adjacent to Lot Three (3), Concession 6, all formerly in the
County of Durham and now within the limits of the said Town of
Newcastle.
2. THOSE portions of the road allowance hereinbefore described shall be
conveyed by The Corporation of the Town of Newcastle to abutting owners.
