ment and maintenance in perpetuity in a proper manner of lots
in a cemetery.
vii) "Lot" me_ an area of lend in the cemetery set apart for the
intument of not more than two human bodies in a single or
double depth graves.
viii) "flot" means two or more lots.
1%) ''M8:dter" means a memorial set flush with the grotmd or raised on

3) DUTIm OF THE CORPORATI01!
1) The Co~re.t1on shall, through its signing officers, eDCUte nll

Subject to the general control and supervis10n of the Direotor of
Public Works, it shall be the duty of the Superintendent end he shall
have power.

ot Publio Works.

il1) To keep the cemetery, buildi.n8B and fences in good repair and
have the seneral. oare and custooy of the oemetery iDcludiDg the
supervision of all employees, the keeping in good order of all
walks, drives and grounds, the enforcement of the provisions ot
this by-law and all lawful direotions of the Corporation;
provided that before removing erry trees or shrub. from a lot,
he 8hsl1, where reasonably possible} first give notioe thereof'
to the owner or such lot.
1v) To give signed orders for all interments and d.isintements and
to see that all are oonduoted in a decent and orderly manner and
that quiet and good order are at all times maintained and to
attend, or oa.use his delegate to attend, at every inteDl8nt end
disinterment.

Subject to the general oontrol and sup6rnSionof the Corporation,
it 8hall be the duty of the Seo:ret&ry'-~asurer to oa:rry out all the
U8Q81 duties of a Secretary-Treasurer and such other duties as mqbe
delegated to him by the Corporation and he shall have power,
1) to make all sales of lots and to keep reoords thereof, and prepaze
deeds for execution by the signing offioers of the Corporation.
11) to reoeiVE\ all monies p8\Va.ble to the account of the Corporation
for the sale of lots, perpetual care and all other monies or
properly given, devised, bequeathed or set aside for the purpose
of the upkeep or oare of 9ZJY lot or portion of a oemetery, and
all other monies or property reoeivable by the Corporation with
respeot to the oemetery whether by wa:y of gift, bequest or
otherwise.
i1i) to set aside for the perpetual oare thirty-five percent, or such
greater amount as is from time to time prescribed under the
Cemeteries k.ot, of all monies received on the sale of lots as
prescribed by the sa.i.d Aot, and to set aside for perpetual care
all other monies received for perpetual care, 6nd to set aside
for the purpose of the upkeep or oare of any lot or portion of
a oemetery, 8DY money or otter property given, devised, bequeathed
or set aside for such puJ:'pOse, and to invest the same, subject to
the approval of the Treasurer, in such securities as ms..v f'.rom time
to time be authorized by the provis4,ons of The Trustees Act or
The Cemeteries Aot;

iv) to receive and transfer to the Perpetual Care account of the Corporation
all interest received from perpetual care fund investments and all interest
and all other income from lOOney invested or from other property given,
devised, bequeathed or set aside for the purpose of the upkeep or care
of any lot or portion of a cemetery;
v> to prepare and subnit to the Corporation a monthly statement of all monies
received by him, to and for the use of the Corporation and all accounts,
in connection with the operation of the Cemetery.
vi) to prepare and submit reports to the Minister, at such times and with INch
information as required by The Cemeteries Act and regulations thereunder.
6. _LOYEES NOT TO SOLICII' BUSINESS
No officer or employee shall canvass or solicit business in connection
with any monwnent or other structure to be erected, or 1n connection
with any work to be done in a cemetery, save and excepting the sel11ng
of lots by persons authorized so to do.
7. SALE OF LOTS AND CEMETERY SERVICES
i) Site Plan
"The Secretary...Treasurer shall keep available for inspection by prospective
purchasers, maps showing all lots available for purchase.
11) Charges
The charges for lots and for all cemetery services shall be as set forth
in the Tarriff of Rntcs appended hereto as Schedule "A".
ill)
Deed
-
Upon payment in full of the purchase price of a lot, the Secretary-1'reasurer
shall prepare a deed according to the form set forth in Schedule "B"
appended hereto and shall, after execution thereof by the signing offic;ers
on behalf of the Corporation, deliver it to the Purchaser and record S8JDe
in a Register kept for that purpose.

iv) Limitation of Deeds
~
The deed of a lot shall convey only the right of burial of hwnan remains
therein, and of placing a marker or monument, and such rights shall be
subject to the provisions of The Cemeteries Act and regulations thereunder,
and of this By-law as amended from time to time, and no purchaser shall
acquire any right, title or interest except as aforesaid, or pursuant to
the Act or other Acts in that behalf.

thereof, the Secretary-Treasurer shall upon payment of a fee of two
dollars, prepare and have executed by the owner thereof, or by the
authorized personal represen.tative of a deceased owner upon satisfactory
evidence of their authority, a transfer in duplicate, in the form set
forth in Scehdule "e" appended Mr.J7,to, and shall enter the transfer in
the Register and deliver one copy et the transferee and keep the other
for his records; In the case of a transfer where an owner is deceased,
a notarial copy of probate or of letters of administration shall be
procured by the Secretary-Treasurer or a satisfactory statutory declaration
with IUch particulars, including the names and addresses of the heir.

Removals
Wherever the owner of a lot procures the rcnnval of all remains from
all graves of which he is the owner, and delivers to the Corporation
the deed to the lot, together with a release of all his interest
therei~ he shall be credited with the amount originally paid, leas
the charge for removal, or where the removal charges are greater than
such amount, he shall be charged with the difference.
vii) Payments for Perpetual Care where mt oriRinally establiehed
In the case of lots formerly sold for a price from which no part
was set aside for perpetual care, any person may pay to the Board
for the perpetual care of any such lot, a sum calculated at the rate
88 shown on Schedule "A" Tarriff of Rates, and perpetual care shall
then be provided for every such lot, and all such sums shall be
transferred

to the. Secretary-Treasuer, and by him added to the perpetual care
fund, and in every such case the Treasurer shall prepare and
have executed and give to the person making such payment, a
certificate in the fonn set forth in Schedule "D" appended hereto. .
8. FUNERALS AND INTERMENT~
i) Burial of ~_ower Animals.
No burial of the body of any lower animal shall be allowed in
any of the cemetery.
ii) Hore Than Two in O~e Grave..
Not more than two burials shall be allowed in one Lot.
li1) Burials on a ~t:.atutor"y Holiday or Sunday.
No burial shall be made on a Statutory Holiday or on a Sunday except
in the case of a written order of the ~~dical Officer of Health.

lY) Buria1s~on S~t~dq.
No burinl shnll be mnde on a Saturday without payment of an extra
charge as set forth in Schedule "A" appended hereto, save and
excepting in the case of a written order of the Medical Officer
of Health and in such case the extra charge shall not apply.
v) Time of DaY-ffile~ Buria}.! \Permitted.
No funeral shall be admitted to the cemetery and ~ burial shall
be allowed, except between the hours of nine o'clock in the fOrenBO&
and five. o'clock in the afternoon, Local Time; provided that a
funeral or burial may be allowed at other times by special permission
of the Superintendent and payment of such additional amount as is
required as sh:>wn on Schedule "A" Tarriff of Rates.
vi) Notice P!:!2r to !3~~.
At least o~enty-four hours notice shall be given to the office
of the Superintendent during business hours, of the date and time
desired for a burial, and unless such notice is in writing the
Corporation shall not be responsible for errors.

:vii) Order for Burial.
Prior to every burial there shall be delivered to the Office of
Secretary-Treasurer, by the undertaker, or some other person,
a death cer'.:ificate properly completed with the information
therein indicated as being required, whereupon the Sec.retary-
Treasurer shal: issue and deliver to the Superintendent a
burial permit in the form set forth in Schedule liEU appended
hereto; and no grave shall be opened without the Superintendent
or his delegate being in attendance.
viii) Route of Funeral
Funerals, within the cemetery shall follow the route prescribed
by the Superintendent or his delegate.
9. MJiH)RIAL SERVICE~
Before any Memol'ial Service is held in a cemetery, the Superintendetlt
shall be given at least ten days notice in writing together with
a satisfactory undertaking that the cost of repairing any damage
whic:h may be oceasioned, will be paid"
10. CEMETERY SERVICES SUPPLIED BY THE CORPORATION
i) Save as herein otherwise provided, cemetery services available
from the Corporation shall not be allowed to be supplied by
any other person and for the purpose of this provision "cemetery
services" shall mean all services normally supplied by the
Corporation and shall include,
1) cutting grass and general care of lots,
2) planting trees, shrubs and grass,
3) setting grave markers, meroorials and corner posts"
4) construction of foundations for IOOnuments and markers,
5) opening and c10s iog gr aves,
6) disinterment or rerooval of remains.

ii) Disinterment and R~..!I.
No disinterment or removal ot any remai"., shall be allowed
exoept under the supervision and direotion of the Medical Otfioer
of Health and in the presence of the Superintendent or his del_te
and upon due observance of all other requirements of The Cemete:ies
Act end regulations made thereunder.
ill) OVersized Shells and Ve.ul ts.

Where a shell or vault has a width of more than two feet and
six inches, or a length of more than seven feet end six 1ncheB
the Superintendent shall not be obliged to pe1'm1 t the burial
unless there is suffioient space to accommodate it; and shall
not be obliged to pe:rmi t the ereotion of any mormment where
there is insuffioient room left fo% the foundation.
11) ~~" r.IONUMEmTS AND VAULTS
i) General.
1) Permission of Own~r
No marker or monument shall be placed or allowed to remain .
wi thout; the written order in the form set forth in Schedule
"Gll signed by an owner of the lot or grave and. delivered to
the 8uperintendent.
2) P..e1'm1ssion 0 t Superintendent
No markers, monument or vaults shall be brought into aoeme~

and in such aanner and in such place as is authorized by the
3uperintendent.
3) Removal Orde~
No marker or monument ehall be removed without a written o%(\$r
in the form set forth in Schedule flF" signed by the owner and
delivered to the Superintendent.

4) Inscriptions
no inscrJ.ption which is scandalous shall be made or allowed
to remain, on any marker or monument in a cemetery, and no
inscription shall be made without the peI.'mission of the owner
of the lot.
5) Hours of ~
110 work shall be done or allowed except between eight 0' olock
in the forenoon and five 0' olock in the afternoon of Mo~,
Tuesdqs? Wednes~s, Thursdqs and Fri~s, and between eight
0' clock in the forenoon and twelve 0 I cloc.k noon on Sa~,
Local Time; and all litter and debris and loose earth shall
be removed at the time above set forth for oessation of wo:m.
6) To Avoid D~.

Due care shall be used, by the use of planks and otherwise,to

No work shall be oarried on in the vicinity of a funeral or

shall be aubject to the direction of the Superintendent; and

debris left contrary to the provisiOns of th18section.

2)Looation
Every marker shall be placed only by employees of the Corporation
and the su:rfaoe shall be level end without projeotions, and
shall be flush with the ground. Uot more than one marker allowed
on one gre;ve, and no marker at the same end as a monUJDBnt.
3) Siz~
Every marker for a single grave shall be of a size 88 nearly
as practicable, of 18 inches by 24 inches, with a thickness of
from 3 to 8 inches.
Ut) MONUMENTS
.
1) !1aterials
Every mOIlUl!1ent shall be of granite or other as :1urable stone
with no vertical joint and no ornament of stone, metal or
other material shall be attached thereto.
All monuments shall be mounted only on a Eltone or concrete base
or footing end shall be constructed by the Corporation and I set
flush wi .~h the level of the adjoining ground.
2) Looation
A monument Dhall be located at the head of a lot or plot and
not more than one monument shall be allowed on one lot or on

There shall be delivered to the office of the Superintendent,
at least two weeks prior to the date desired for the ereotion
of a monument, an order in the form set forth in Sohedule I;G"
with the information thereon indioated, inoluding the dimensions
of the monument, and the order for the foundation.

Flower pots 1ll8\Y' be placed and flowers planted at the front of
a grave not more than 2 feet from the marker or monument and
under the supervision and direction of the Superintendent.

of June in any year shall,after notice to the owner, if availabl.,
of the burial lot, be removed and PU~li in storage by the Super-
intendent, and if not claimed by the said owner within 90 ~
after removal of same, shall be destroyed.

No trirod or stand for flowers shall be placed on any grave,
and any so placed shall be removed by the Superintendent.
iv) Glass Blocks or Hinter Wreat~.
No glass blooks or winter '\'11'eaths shall be permitted on a grave
or lot after the first my of April in any year and up to the
last dair of October following and any box,container ,)wreath, etc.,
so placed shall be removed by the Superintendent.
v) Visi tinR Hours
No person shall enter or be wi thin any oemetery grounds before
eight o'olock in the forenoon or after sundown, exoept a Polioe
Constable, the Corporation and their emplo,yees in the performanoe
of their duties.
vi) YO\UlR Children
No child under or apparently under the age of twelve sball enter
or be wi thin any oemetery grounds except when under the proper
control of an adu1 t.

Being a by-law to provide for the maintenanoe, ma.n&gement,
regulation and control of the Bowmanville Cemetery.
WHEREAS the Revised Statutes of Ontario 1970, Chapter 57, and the Regulations
passed thereunder provides rules and. regulations governing Cemeteries and the
use thereof; and
WHEREAS Section 42 of the said Act provides that the owner of a Cemetery Dl8\V
make further regulations for l~ out and selling lots, managing the cemetery
and otherwise generally respecting the use of the grounds and for the execution
of conveyance of lots or plots in the oemetery.

i) "Bowmsnvi1le Cemetery" means a parcel of land situate in part
of Lot 8, Concession 1, Bowmanville.

double depth graves.
viii) "Plot" means two or more lots.
ix) "Marker" means a memorial set flush with the ground or raised on
a slight slope above the ground.
x) ''Monument'' means a memorial placed upright on the ground.
e 3) DUTIES OF THE CORPORATION
1) The Co;rporation shall, through its signing officers, execute all
conveyances of lots in the Cemetery.
ii) The Corporation shall, appoint a Superintendent who shall hold
office during the pleasure of Council.
i11) The Corporation sh811, appoint a Secrctary-Treasurer who shaJ.l
hold office during the pleasure of Council.
4) DpTm3 OF THE SUPERINTENDENT
Subject to the general control and supervision of the Director of
Public Works, it shall be the duty of the Superintendent and he sbaJ.l
have power.
i) To prepare and present the periodic P€l\1 sheets to the Director
of Public Works.

1i) To keep 811 neoessary recorda of interments, disinterm.ents and
removals, and all other neoessary records, and submit monthlY, to
the Secretary-Treasurer, a proper report together with requisite
sta.tements.

ill) To keep the cemetery, buildings end fenoes in good repair and
have the general. oare and custoOy of the oeme~ including the
supervision of all employees, the keeping in good order of all
wslks, dri vus and grounds, the enforcement of the provisiOns of
this by-law and all lawful directions of the Corporation~
provided that before removing any trees or shrubs from a lot,
he shall, where reasonably possible} first give notice thereof
to the owner ot such lot.

iv) To give signed orders for all interments and disinterments and
to see that all are conducted in a decent and orderly manner and
that quiet and good order are at all times maintained and to
attend, or cause his delegate to attend, at every interment and
disinterment.
$) p~ OF THE SECRETAll~-~_
Subject to the general control and supervision of the Corporation,
it shall be the duty of the Seoretar.r-Treasurer to carry out all the
usual duties of a Secretary-Treasurer and such other duties as IDa\Y' be
delegated to him by the Corpora.tion and he shall have power,
e
1) to make all sales of lots and to keep records thereof, and prepare
deeds for execution by the signing officers of the Corporation.
ii) to receive all monies payable to the a.ccount of the Corporation
for the sale of lots, perpetual care and all other monies or
property given, devised, bequeathed or set aside for the purpose
of the upkeep or care of any lot or portion of a. cemetery, and
all other monies or property receivable by the Corporation with
respect to the cemetery whether by ~ of gift, bequest or
otherwise.
iii) to set aside for the perpetual care thirty-five percent, or such
greater amount as is from time to time pres~ibed under the
Cemeteries Act, of all monies received on the sale of lots as
prescribed by the said Act, . and to set aside for perpetual care
all other monies received for perpetual care, 6lI.d to set aside
for the purpose of the upkeep or care of any lot or portion of
a. cemetery, any money or other property given, devised, bequeathed
or set aside for such purpose, and to invest the same, subject to
the approval of the Treasurer, in such securities as IIIS\V' f'.rom time
to time be authorized by the provisd.ons of The Trustees Act or
The Cemeteries Act;

iv)
to receive and transfer to the Perpetual Care account of the Corporation
all interest received from perpetual care fund investments and all interest
and all other income from lOOney invested or from other property given,
devised, bequeathed or set aside for the purpose of the upkeep or care
of any lot or portion of a cemetery;
v)
to prepare and submit to the Corporation a IOOnthly statement of all monies
received by him, to and for the use of the Corporation and all accounts,
in connection with the operation of the Cemetery..
vi)
to prepare and submit reports to the Minister. at such times and with such
information as required by The Cemeteries Act and regulations thereunder.
6.
ItIPLOYEES NCYX TO SOLICrI' BUSINESS
No officer or employee shall canvass oJ; solicit business in connection
with any IOOnwnent or other structure to be erected, or in connection
with any work to be done in a cemetery, save and excepting the selling
of lots by persons authorized so to do.
7. SALE OF LOTS AND CEMETERY SERVICES
i) Site Plan
The Secretary-Treasurer shall keep available for inspection by prospective
purchasers, maps showing all lots available for purchase.
ii) Charges
The charges for lots and for all cemetery services shall be as set forth
in the Tarriff of Rntes appended hereto as Schedule "A".
i11) Deed
-
Upon payment in full of the purchase price of a lot, the Secretary.:rreasurer
shall prepare a deed according to the form set forth in Schedule "B"
appended hereto and shall, after execution thereof by the signing officers
on behalf of the Corporation, deliver it to the Purchaser and record same
in a Register kept for that purpose.

iv) Limitation of Deeds
The deed of e lot shall convey only the right of burial of In.unan remains
therein, and of placing a marker or IOOnwnent, and such rights shall be
subject to the provisions of The Cemeteries Act and regulations thereunder,
and of this By-lal'l as amended from time to time, and no purchaser shall
acquire any right, title or interest except as aforesaid, or pursuant to
the Act or other Acts in that behalf.. 10

Transfer of Lots
No purported transfer of any lot shall be recorded or recognized by
the Corporation where the price is greater than the current price
charged. by the Corporatiolle Upon the transfer of a lot by the owner
thereof, the Secretary-Treasurer shall upon payment of a fee of two
dollars, prepare and have executed by the owner thereof, or by the
authorized personal representative of a deceaoed owner upon satisfactory
evidence of their authority, a transfer in duplicate, in the form set
forth in Scehdule "C" appended hereto, and shall enter the transfer in
the Register and deliver one copy of the transferee and keep the other
for his records; In the case' of a transfer where an owner is deceased,
a notarial copy of probate or of letters of administration shall be
procured by the Secretary-Treasurer or a satisfactory statutory declaration
with such particulars, including the names and addresses of the heirs
and the name and address of the person authorized to sign a transfer.
vO Removals
Wherever the owner of a lot procures the rC11Dval of all remains from
all graves of which he is the owner, and delivers to the Corporation
the deed to the lot, together with a release of all his interest
therei~ he shall be credited with the amount originally paid, less
the charge for removal, or where the removal charges are greater than
such amount, he shall be charged with the difference.
vii) P a:vments for Perpetual Care where nc. t originally establ ished
In the case of lots formerly sold for a price from which no part
was set aside for perpetual care, any person may pay to the Board
for the perpetual care of any such lot, a sum calculated at the rate
as shown on Schedule "A" Tarriff of Rates, and perpetual care shall
then be provided for every such lot, and all such swns shall be
transferred

to the Secretary-Treasuer, and by him added to the perpetual care
fund, and in every such case the Treasurer shall prepare and
have executed and give to the person making such payment, a
certificate in the form set forth in Schedule "D" appended hereto.
8. FUNERALS AND INTERMENTS
i) Burial of lower Animals.
No burial of the body of any lower animal shall be allowed in
any of the cemetery.
iO }fore Than Two in One Grave..
Not more than two burials shall be allowed in one lot.
iiO Burials on a Sta,tutory Holiday or Sunday.
No burial shall be made on a Statutory Holiday or on a Sunday exc.op't
in the case of a written order of the Medical Officer of Health.
tv) Burials on Saturdayo
No burial shall be made on a Saturday without payment of an extra
charge as set forth in Schedule "A" appended hereto, save and
excepting in the case of a written order of the Medical Officer
of Health and in such case the extra charge shall not apply.
v) Time of Day When Burials Permitted.
No funeral shall be admitted to the cemetery and no burial shall
be allowed, except between the hours of nine 0 I clock in the foreraor.
and five ofclock in the afternoon, local Time; provided that a
funeral or burial may be allowed at other times by special permission
of the Superintendent and payment of such additional amount as is
required as shown on Schedule "A" Tarriff of Rates.
vi) Notice Prior to Burial.
At least twenty-four hours notice shall be given to the office
of the Superintendent during business hours, of the date and time
desired for a burial, and unless such notice is in writing the
Corporation shall not be responsible for errors.

:vii) Order for Burial..
Prior to every burial there shall be delivered to the Office of
Secretary-Treasurer, by the undertaker, or some other person,
a death cer~ificate properly completed with the information
therein indicated as being required, whereupon the Secretary-
Treasurer shall issue and deliver to the Superintendent a
burial permit in the form set forth in Schedule "E" appended
hereto; and no grave shall be opened without the Superintendent
or his delegate being in attendance.
viii) Route of Funeral
Funerals, within the cemetery shall follow the route prescribed
by the Superintendent or his delegate.
9.
MEMORIAL SERVICES
Before any Memorial Service is held in a cemetery, the Superintendent
shall be given at least ten days notice in writing together with
a satisfactory undertaking that the cost of repairing any damage
which may be occasioned, will be paid~
10. CEMETERY SERVICES SUPPLIED BY THE CORPORATION
i) Save as herein otherwise provided, cemetery services available
from the Corporation shall not be allowed to be supplied by
any other person and for the purpose of this provision "cemetery
services" shall mean all services normally supplied by the
Corporation and shall include,
1) cutting grass and general care of lots,
2) planting trees, shrubs and grass,
3) setting grave markers, memorials and corner postsy
4) construction of foundations for monuments and markers,
5) opening and closing graves,
6) disinterment or removal of remains.

ii) Disinterment and R~o~s.
No disinterment or removaJ. of any :rema.:f.ns shall be allowed
exoept under the supervision and direotion of the Medioal Offioer
of Health and in the presenoe of the Superintendent or his delegate
and upon due observanoe of all other requirements of The Cemeteries
Aot and regulations made thereunder.
111) Qyssized Shells and Vaults.
Where a shell or vault has a width of more than two feet and
six inches, or a length of more than seven feet and six inches
the Superintendent shall not be obliged to permit the burial
unless there is suffioient space to acoommodate it; and shall
not be obliged to permit the ereotion of any monument where
there is insuffioient room left for the foundation.
11) MARKERS. NONUMENTS AND VAULTS
1) General.
1) Permission or Own~r
}To marker or monument shaJ.l be placed or allowed to remain
without the written order in the form. set forth in Schedule
"G" signed by an owner of the lot or grave and delivered to
the Superintendent.
2) Permission of Superintendent
No markers, monument or vaults shall be brought into a oemetery
or any materials plaoed or any work done, except at suoh time
and in suoh manner and in suoh place as is authorized by the
Superintendent.
3) Removal Order..
No marker or monument shall be removed without a written ord6r
in the form. set forth in Sohedule IlF" signed by the owner and
delivered to the Superintendent.

4) Ins~t~tions
No inscription 'Which is scandalous shall be made or allowed
to remain, on any marker or monument in a cemetery, and no
inscription shall be made without the permission of the owner
of the lot.
.5) HO'UXD of "Tork
1Jo work shall be done or allowed except between eight 0' clock
in the forenoon and five 0' clock in the afternoon of MondB\Vs,
Tuesda\Ys, Wednesda3rs, Thursda\Ys and Fridays, and between eight
0' clock in the forenoon and twelve 0' clock noon on Saturda\vs,
Local Time; and all litter and debris and loose earth shall
be removed at the time above set forth for cessation of work.
6) To Avoid D~.
Due care shall be used, by the use of planks and otherwise, to
avoid causing any damage to any path or lawn or to anything
wi thin the cemete1"'J.
7) In Vicinity of Funeral.
No worJ: shall be carried on in the vicinity of a funeral or
burial service at any time while it is in progress.
8) Behaviour of vlorkmEtn.
The demeanour and behaviour of all worlanen employed by others
shall be subject to the direction of the Superintendent; and
every such ''1Orkman shall leave the cemetery when so ordered"
by the Superintendent.
9) Removal oJ Ii ttez:.
The Superintendent IIla\V remove any material, and any litter or
debris left contrary to the provisions of this section.
ii) MARKERS.
1) Materials
Every marker shall be monolithic and shall be of gra.ni. te or of
any sufficiently durable and non-corrosive metal. All markers

except B-ronze or other metallic ma..:rkers shall be mounted only
on a stone or concrete base or footing and such stone or ooncrete
base shall be at least four inches thiclc and not more than eight
inches tluclc.
2)Location
Every marker shall be p1aced only by employees of the Corporation
and the surface shall be level and without projections, and
shall be flush with the ground. l10t more than one marker allowed
on one grave, and no marker at the same end as a monunmnt.
3)~
Every marker for a single grave shall be of a size as nearly
as practicable, of 18 inches by 2h inches, with a thickness of
from 3 to 8 inches.
111) MONUMENTS
1) ~iateri~l.'!.
Every monument shaJ.I be of gra.ni te or other as durable stone
wi th no vertical joint and no ornament of stone, metal or
other material shall be attached thereto.
All monuments shall be mounted only on a stone or ooncrete base
or footing and shall be constructed by the Corporation and set
flush with the level of the adjoining ground.
2) Location
A monument shall be located at the head of a lot or plot and
not more than one monument shall be allowed on one lot or on
one plot save and excepting that Council may, at their dis-
cretion and from time to time, upon application, permit more
than one monument on a plot.

No monument shall exceed four feet in height, including base
or footing, above the level of the adjoining ground, and
(1) when located on a lot shall not exceed 10'% of the lot area,
(2) when located on a plot, the base shall not exceed 3'211 by

4) Not~e to Corporation
There shall be delivered to the offioe of the Superintendent,
at least two weeks prior to the date desired for the ereotion
of a monument, an order in the form set forth in Sohedule r;G"
wi th the information thereon indioated, inoluding the dimensions
of the monument, and the order for the foundation.
12) REGlJLA.TIONS 11A:DE UNDER TEE AUTHORITY OF THISJ3Y-~.li.

Flower pots m8\V be placed and flowers planted at the front of
a grave not more than 2 feet from the marker or monument and
under the supervision and direotion of the Superintendent.
11) Any flower pot not properly plaoed on or before the 20th de3r
of June in any year shall, after notioe to the owner, if available?
of the burial lot, be removed and puJc in storage by the Super-
intendent, and if not olaimed by the said owner within 90 c1.qs
after removal of same, shaJ.l be destToyed.
iii) Tripods or Stands
No trirod or stand for flowers shall be placed on any grave,
and any so plaoed shall be removed by the Superintendent.
iv) Q.l~s Blocks or "linter Wreat~
No glass blocks or winter wreaths shall be permitted on a grave
or lot after the first ia.y of April in any year and up to the
last day of Ootober following and any box, oontainer ;>wreath, eto.,
so placed shall be removed by the Superintendent.
v) Visi ting Hours
No person shall enter or be wi thin any oemetery grounds before
eight o'olock in the forenoon or after sundown, exoept a Police
Constable, the Corporation and their employees in the performanoe
of their duties.
vi) YOUIlIt Children
No child under or apparently under the age of twelve shall enter
or be wi thin any oemetery grounds except when under the proper
oontrol of an adult.

Uo person shall drive a vehicle at a speed of more than ten
miles per hour, or elsewhere than upon the roadways provided
for vehicles.
viii) .Pgade and Pro.gessions.
No person shall wi thin a cemetery take part in any parade or
procession, except a funeral procession, without prior approval
by the Corporation.
ix) Watering C~
Visi tors are expected to return watering cans to their place
at the water tap.

This By-law shall come into force when passed by the Council of The
O~ration of The Town of Newcastle, subject however to the approval.
of The Ministry of Consumer and Public Relations.
