AMENDED BY AMENDED J { BY-LAW ,7t:g~Y.LAW il1.:Q~~1 THE CORPORATION OF THE TOWN OF NE'tlCASTLE By-law Number 76-67 A by-law to amend By-law 76-25, being a by-law to regulate signs in the Town of Newcastle WHEREAS, the Council of the Corporation of the Town of Newcastle deems it expedient to amend By-law 76-25 of the Town of Newcastle, NOW THEREPORE, the Corporation of the Town of Newcastle ENACTS as follows: 1. Section 3(11) of By-law 76-25 is hereby amended by changing to "highest" the fifth word in the third line. 2. Section 3(20) of By-law 76-25 is hereby amended by deleting the words after "ground sign" and replacing them with the following: "......., wall sign or roof sign located on a lot occupied by more than one professional or business establishment in a Commercial or Ind- ustrial Zone for the purpose of indicating the names of the occupants and/or the use of the lot." 3. Section 3(21) is hereby amended by deleting the word "occupant's" and by adding the words "of the occupant or occupants" after the word "address". 4. Section 3 of By-law 76-25 is hereby amended by adding thereto the following subsection after Section 3(29): "(30) SIGN, TRAFFIC CONTROL means any sign, other than a pUblic use sign, which is used for no other purpose than the control and dir- ection of traffic movement." 5. Sub-sections 3(30), 3(31), 3(32), 3(33), 3(34), 3(35} 3(36) and 3(37) are hereby amended by changing their numbers to 3(31), 3(32), 3(33), 3(34), 3(35), 3(36), 3(37) and 3(38) respectively. Section 4(3) (b) of By-law 76-25 is hereby amended by adding thereto the following: "This provision shall not apply to signs located more than 25 feet from any street line." 7. Section 4(8) of By-law 76-25 is hereby amended by inserting a comma after the word "Institutional". 8. Section 4 of By-law 76-25 is hereby amended by addinq thereto the following section 4{9): "(9) TRAFFIC CONTROL SIGNS A Traffic Control Sign having a sign area not greater than 10 square feet is permitted in any zone n . 9. Section 8(2) (a) (ii) of By-law 76-25 is hereby amended by adding the words "for each street line on the lot, plus 1 additional if the lot frontage exceeds 400 feet" after the number "I". 10. Section 8(2) (a) (iii) of By-law 76-25 is hereby amended by deleting the numbers and words follow- ing the word "Zones" and substituting therefore the following: "I for each professional or business establishment plus 1 additional if the lot fronts on more than one street, except that where a lot is occupied by more than one professional or business estab- lishment, no identification sign may be a ground sign. it 11. Section 8(2) (b) (v) of By-law 76-25 is hereby amended by deleting therefrom the words "30 square feet" and adding thereto the following: "..... in the case of a ground sign, 30 ~quare feet or 0.1% of the lot area, whichever ~s the greater provided that in no case shall any sign exceed 100 square feet in area. - in the case of a wall sign, 30 square feet or 10% of the area of the wall, whichever is the greater." . . , . . e . , , (3) 12. Section 8(2) (b) (vi) of By-law 76-25 is hereby amended by deleting therefrom the words "3D square feet" and adding thereto the following: "- in the case of a ground sign, 30 square feet or 0.1% of the lot area whichever is the greater provided that in no case shall any sign exceed 100 square feet in area. - in the case of a wall sign, 30 square feet or 10% of the area of the wall, whichever is the greater." 13. Section 9(2) (a) (i) of By-law 76-25 is hereby amended by adding the words "for each street line on the lot, plus 1 additional if the lot frontage exceeds 400 feet" after the number "1". 14. Section 9(2) (a) (ii) of By-law 76-25 is hereby amended by deleting the words following the word "Zones" and substituting therefore the following: "I for each professional or business establish- ment plus 1 additional if the lot fronts on more than one street, except that where a lot is occupied by more than one professional or business establishment, no identification sign may be a ground sigr.." 15. Section 9(2) (b) (iv) of By-law 76-25 is hereby amended by deleting therefrom the words "3D square feet" and adding thereto the following: " in the case of a ground sign, 30 square feet or 0.1% of the lot area, whichever is the greater provided that in no case shall any sign exceed 100 square feet in area - in the case of a wall sign, 30 square feet or 10% of the area of the wall, whichever is the greater." 16. Section 9(2) (b) (v) of By-law 76-25 is hereby amended by deleting therefrom the words "3D square feet" and adding thereto the following: "- in the case of a ground sign, 30 square feet or 0.1% of the lot area, whichever is greater, provided that in no case shall any sign exceed 100 square feet in area - in the case of a wall sign, 30 square feet or 10% of the area of the wall, whichever is the greater. II . .A . .. . ;.. (4) . 17. Section 11(3) of By-law 76-25 is hereby amended by inserting the word "not" between the words"area" and "greater". 18. Section 11(4) of By-law 76-25 is hereby amended by inserting the word "not" between the words "area" and "greater". 19. This by-law shall become effective on the date of final passing hereof.
