THE CORPORATION OF THE
TOWN OF NEWCASTLE

BY-LAW NO. 76-65
being a by-law to stop up and close and
authorize the conveyance of part of Smart
Avenue lying between Highway 401 and the
Base Line, in the Town of Newcastle
(formerly in the Town of Bowmanvil1e).
WHEREAS the Council of the Corporation of the Town of
Newcastle deems it desirable to pass this by-law;
AND WHEREAS notice of intention of the Council to pass
the said by-law in accordance with the requirements of Section
446 of The Municipal Act, R.S,O. 1970, Chapter 284, was published
in the Canadian Statesman on the
29th day of September, 1976

AND WHEREAS notice of the intention of the Council to pass
this by-law was sent by registered mail to the Regional Municip-
ality of Durham on the 20th day of April, 1976, and the Regional
Council by resolution dated the 26th day of May, 1976, granted
its approval to the proposed by-law;
NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED AS A
BY-LAW OF THE CORPORATION OF THE TOWN OF NEWCASTLE AS FOLLOWS:
1. Those portions of highway in the Town of Newcastle herein-
after described are hereby stopped up and closed:
ALL AND SINGULAR that certain parcel or tract of land
and premises situate, lying and being in the Town of
Newcastle (formerly in the Town of Bowmanville) Regional
Municipality of Durham, Province of Ontario and being
composed of part of Smart Avenue lying between King's
Highway #401 and the road allowance between Concessions
1 and Broken Front, all on Shortt's Plan of the Town of
Bo~~anville, formerly in theCounty of Durham, more
particularly designated as Part 3 according to Plan 10R276,
deposited in the Land Registry Office for the Registry
Division of Newcastle (No. 10) on December 3, 1973.
2. Those portions of the highway hereinbeforerescribed shall be
conveyed by the Corporation of the Town of Newcastle to
abutting owners.
