AMENDED BY BY-LAW #J1.:Q.'f.Z~ THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NO. 76-18 Being a by-law to license and regulate Refreshment Vehicles in the Town of Newcastle. BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law of the Corporation of the Town of Newc,stle by the Council thereof as follows:- 1. No person shall own or operate a vehicle from which refreshments are sold for consumption by the public unless such person has first obtained a Refreshment Vehicle licence convering such vehicle from The Corporation of the Town of Newcastle for the then current calendar year. 2. (1) Application for a Refreshment Vehicle licence shall be made at the office of the Town Clerk in writing, signed by the applicant and the application form marked as Schedule "A" hereto shall be completed. (2) The said application when properly completed and when the applicable licence fee has been paid shall be forwarded to Town Council for its consideration together with such other relevant information as the Clerk may obtain respecting the application. (3) The Town Clerk, upon approval by Town Council of the application and upon payment of the applicable fee shall issue a licence. (4) Notwithstanding subsection (1), (2) and (3) of this Section, the Town Clerk may issue a licence to any applicant who was the holder of a licence in tr,e immediately 1 .....'ceding year without requiring the completion ~ a written application and without referring such application to Town Council. 3. The licence sh'~ll be valid for the calendar year for which it is issued and shall, unless previously revoked, expire on December 31st, in the year of its issue. 4. The fee payable for a Refreshment Vehicle licence shall be $200.00 for the first vehicle licenced and $100.00 for each subsequent vehicle. 5. Every owner or operator of a Refreshment Vehicle in the Town of Newcastle shall comply with the following regulations: (. ( 'J , (h) l hi (i) tr .) i1 - 2 - By-Law No. 76-18 the vehicle and all foods sold therefrom shall comply with all health or sanitary regulations applicable thereto. the vehicle shall comply with all municipal and Provincial fire regulations. the licence issued under this by-law covering the vehicle shall be kept in the vehicle at all times and shall be produced on demand to any police officer or municipal inspector. the vehicle shall comply with all parking or traffic regulations applicable to such vehicles. the vehicle shall comply with all zoning by-laws of the municipality. the vehicle shall comply with all applicable Government regulations. mobile vehicles which move from place to place shall not remain lon'ger than one half hour at any' one location. 6. Any licence issued under this by-law may be revoked by the Town Council for a breach of any provision of this by-law but at least seven days' notice of the meeting at which revocation is to be considered shall be given to the licencee who shall be entitled to appear and be heard either personally or by his counselor agent at the meeting. 7. Any person who contravenes any provision of this by-law shall be guilty of an offence and liable upon conviction to a penalty of not less than $25.00 or more than $300.00 exclusive of costs for each offence. 8. This by-law shall come into force on the date of passing. 9. All by-laws or sections of by-laws of the former Townships of Darlington and Clarke, the Town of Bowmanville or the Village of Newcastle which are inconsistant with the terms of this by-law are hereby repraled By-law read a first time this 5th day of April By-law read a second time this 5th day of April 1976 1976 By-law read a third time and finally passed this 5th day of April 1976. " ~ '> t' TARIFF "A" BY DISTANCE One to ~our Passengers for the first one-eighth (1/8) mile or part thereof for each additional one-eighth (1/8) mile or part thereof for waiting time while under engagement, for one (1) minute for each additional passenger, adult or child (except babies in arms) a flat charge of BY TIME for the first hour or part thereof for each additional fifteen (15) minutes OTHER CHARGES for each trunk accompanying a passenger for each piece of hand baggage handled by the driver, in excess of(2)two pieces DRIVE-SELF CAB for 5 passenger cars, including oil and gasoline, per mi. for 7 passenger cars, including oil and gasoline, per mi.
