THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NO. 76-11
Being a by-law to authorize speed limits on Highways
under the jurisdiction of the Corporation of the
Town of Newcastle
.
WHEREAS Section 82 of The Highway Traffic Act (R.S.O. 1970, Chapter
202) authorizes the Council of a city, town or village and the tru-
stees of a police village by by-law to prescribe a rate of speed
for motor vehicles driven on any highway or portion of highway under
its jurisdiction;
NOW THEREFORE, BE IT ENACTED AND IT IS HEREBY ENACTED, as a by-law of
The Corporation of the Town of Newcastle through its Council thereof
as follows:
(1) When any highway or portion of highway set out in compl-
iance with the regulations under the Highway Traffic Act
the maximum rate of speed thereon shall be the rate of
speed prescribed in the Schedules A, B, C, and D appended
hereto is marked in compliance with the regulations under
The Highway Traffic Act, the maximum rate of speed there-
on shall be the rate of speed prescribed in the Schedule.
(2) The penalties provided in Subsection 16 of Section 82
of The Highway Traffic Act shall apply to offences against
this by-law.
(3)
By-law 2282, 2372, 2390, 2419, 2444 of the former Township
of Darlington and By-law 75-8 of the Town of Newcastle and
any other inconsistent by-laws insofar as they apply to
highways under the jurisdiction of The Corporation of the
Town of Newcastle are hereby repealed.
(4) This by-law shall come into force on the date that it is
approved by the Council of the Regional Municipality of
Durham and when signs to the effect are erected.
